Checkers previously appointed for entrance by the Select- men and sworn in by Town Clerk Charles A.Marks at 1:15 P.M.were Catherine D.Noonan,Barbara A.Williams, Louise M.Ahearn,Mary Fiori,Margaret E.Buckley and Mary Isabelle Ainslie. Tellers appointed by the Moderator and sworn in at 1:55 P.M.were Z.Thaxter Lapham,John L.Emery,Thomas G.Keating and Frank E.Jason. The number of voters present as checked on the incom- ing voting lists was 555. The meeting was called to order at 2:15 P.M.by Moder- ator Robert B.James and the Town Clerkproceeded to read the call of the meeting. The invocation was given by Reverend William G.Sewell. ARTICLE 1.VOTED:that the Selectmen be and hereby are authorized and directed to appoint all Town Officers not required to be elected by ballot. ARTICLE 2.VOTED:that the reports of the various town officers as printed in the Annual Town Report for the year 1962 be and hereby are accepted. ARTICLE 3.To hear the report of any committee here- tofore chosen and act thereon. Fire and Police Station Building Committee VOTED:that the report of the Fire and Police Station Build- ing Committee be continued in existence. School Facilities Committee VOTED:that the reoirt of the School Facilities Committee be considered one of progress and that the Committee be con- tinued in existence. 15 Committee to Investigate the Administration Functions of Town Officers VOTED,that the Committee be discharged. Harbor Dredging Committee VOTED,that the Committee report of progress be ac- cepted and the Committee be continued. Transportation Committee VOTED,that the Committee report of progress be ac- cepted and the Committee be continued. Incinerator Committee VOTED,unanimously by a voice vote,that the Committee report of progress be accepted and the Committee be contin- ued. Committee to Investigate Acquisition of the Ammunition Depot Property VOTED,that the Committee report of progress be ac- cepted and the Committee be continued. Conservation Commission VOTED,that the Committee report of progress be ac- cepted and the Committee be continued. Government Island Property Committee VOTED,that the Committee report be accepted and the Committee be discharged with a vote of thanks. RESOLUTION BY HOLLIS T.GLEASON WHEREAS,Frederick A.Thayer has served the Town of Cohas s et continuously for the past thirty-eight years as Town Counsel,and is now retiring from that Position: NOW THEREFORE BE IT RESOLVED —that the citizens of Cohasset,in Town Meeting assembled,hereby record their keen appreciation of the dis- tinguished service rendered in their behalf by Frederick A. Thayer as Town Counsel of Cohasset throughout the long per- iod from 1925 to 1963,a service marked by conscientious effort and proficiency,sound legal steps and common sense in protecting the interests of the Town,a calm and human approach in dealing with many a problem,and a friendly at- mosphere contributing to harmonious proceedings ;and they further express the hope that with the continuing esteem of his fellow -citizens he may live long and prosper. VOTED,in the affirmative. ARTICLE 11.VOTED,thatthe sum of $800.00 be raised and appropriated for maintaining,during the ensuing year, the mosquito control works as estimated and certified to by the State Reclamation Board in accordance with Chapter 112 of the Acts of 1931. 26 ARTICLE 12.VOTED,that the Town of Cohasset join in a Mosquite Control Project in conjunction with the City of Quincy and other Towns joining therein including Hing- ham,Braintree,Hull,Weymouth and Milton or any com- bination of them in accordance with and authorized by the provisions of Chapter 252 of the General Laws as amended and the sum of $4,200.00 be and hereby is raised and appro- priated for the purpose of paying Cohasset's share thereof, the funds to be paid to the Massachusetts Reclamation Board in the discretion of the Board of Selectmen if sufficient other municipalities join to justify such action. ARTICLE 13.VOTED,that the sum of $1,517.00 be and hereby is raised and appropriated to be used with the balance of prior unexpended appropriations for the Town's proportionate cost for the control of insect,vegetable and animal life in Strait's Pond for 1963 as advised by the State Reclamation Board and as provided by Chapter 557 of the Acts of 1955 as amended,said appropriation to be made available for expenditure provided the Town of Hull appro- priate its share of money for said purpose. ARTICLE 14.VOTED,that this Article be indefinitely postponed. ARTICLE 15.VOTED,that this Article be indefinitely postponed. ARTICLE 16.VOTED,that the Town assume liability in the manner provided by Section 29 of Chapter 91 of the Gen- eral Laws,as amended by Chapters 516 and 524,Acts of 1950,for all damages that may be incurred by work to be performed by the Department of Public Works of Massachu- setts for the improvements,development,maintenance and protection of tidal and non-tidal rivers and streams,harbors, tide-waters,foreshores,and shores along a public beach outside of Boston Harbor,including the Merrimac and Con- necticut Rivers in accordance with Section E of Chapter 91 of the General Laws,and authorize the Selectmen to execute and deliver a bond of indemnity therefor to the Common- wealth. ARTICLE 17.VOTED,that the sum of $29,741.55 be and hereby is appropriated for the use of the South Shore Re- gional School District for 1963. ARTICLE 18.VOTED,that the sum of $1,100.00 be and hereby is raised and appropriated towards land damages awarded as such for any taking which may be necessary un- 27 der a certain layout of Atlantic Avenue,between Cunning- ham's Bridge (so-called)and the intersection of Atlantic Avenue,Beach Street and Hobart Lane,said layout having been made by the Norfolk County Commissioners,a copy thereof being on file in the Town Clerk's office. ARTICLE 19.VOTED,that the Town establish as a Town Way and accept the layout of Rustic Drive as laid out by the Selectmen and shown on plan and layout on file in the Town Clerk's office;authorize the Selectmen to acquire by eminent domain or otherwise such rights,titles and easements in such land as is necessary therefor and to accomplish said purpose;and the sum of $50.00 be and hereby is raised and appropriated for the purchase and taking thereof. ARTICLE 20.VOTED,that this Article be indefinitely postponed. ARTICLE 21.VOTED,that the sum of $4,500.00 be and hereby is raised and appropriated for the reconstruction and resurfacing of Beechwood Street from Route 3A to Mill Lane. ARTICLE 22,VOTED,that the sum of $3,000.00 be and hereby is appropriated for Maintenance of highways under Chapter 90 of the General Laws and to meet said appropria- tion,$1,000.00 be raised in the current year's tax levy to meet the Town's share thereof and $2,000.00 be transferred from free cash in the Treasury to meet the State's and Coun- ty's shares,reimbursements from the State and County to be restored upon their receipt to the Excess and Deficiency Account in the Treasury. ARTICLE 23.VOTED,that the sum of $1,500.00 be and hereby is raised and appropriated for the reconstruction and resurfacing of existing sidewalks in need thereof. ARTICLE 24.VOTED,that the sum of $7,500.00 be and hereby is raised and appropriated for the reconstruction, resurfacing and installation of necessary drainage on Pleas- ant Street from Cushing Road to Reservoir Road. ARTICLES 25 and 26.VOTED,that Article 25 and Arti- cle 26 of the Warrant be considered and acted upon in one vote and that the sum of $16,000.00 be and hereby is appro- priated for Chapter 90 Highway Construction for Forest Ave- nue,and to meet said appropriation $12,000.00 to be taken from free cash in the Treasury to meet the State and County share thereof and the sum of $4,000.00 to be taken from the proceeds received or to be received from the Commonwealth 28 of Massachusetts under the provisions of Chapter 782 of Acts of 1962;reimbursement from the State and County to be re- stored upon their receipt to the Excess and Deficiency ac- count in the Treasury. ARTICLE 27.VOTED,that the sum of $11,363.52 be and hereby is appropriated from the funds received or to be received from the Commonwealth of Massachusetts in accor- dance with Chapter 782,Acts of 1962,Section 4 for the re- construction,resurfacing and installation of necessary drain- age on King Street. ARTICLE 28.VOTED,that $1,000.00 be and hereby is raised and appropriated for the demolition and or removal of the Police Station Building situated at the junction of Main Street and Elm Street and that the Board of Selectmen be and it is hereby authorized to contract on behalf of the Town in all matters necessary or expedient to accomplish the same and matters incidental thereto unless on or before May 1, 1963,the Cohasset Historical Society shall submit a request in writing to the Board of Selectmen requesting a lease or other occupation agreement of said building,whereupon the Board of Selectmen be and it is hereby authorized to lease or enter into an other occupation agreement upon such terms, conditions and restrictions as the Board of Selectmen may deem in the best interests of the Town. ARTICLE 29.VOTED,that $2,000.00 be and hereby is raised and appropriated for the demolition and or removal of the building known as Central Fire Station situated at the junction of Summer Street and Border Street and that the Board of Selectmen be and it is hereby authorized to con- tract on behalf of the Town in all matters necessary or ex- pedient to accomplish the same and matters incidental there- to. ARTICLE 30.VOTED,that the provisions of Chapter 90, Section 18A of the General Laws (Ter.Ed.)as most recently added by Chapter 409 of the Acts of 1962 which Act authori- zes the Selectmen to adopt rules regulating the use of ways by pedestrians and providing for the non-criminal desposi- tions of violations,thereof be and hereby are accepted. ARTICLE 31.VOTED,that the laying out,use and con- trol of playgrounds in Cohasset and the powers conferred by Section 14 of Chapter 45 of the General Laws (Ter.Ed.) shall be exercised by and are hereby placed under the Re- creation Committee. 29 ARTICLE 34.VOTED,that this Article be indefinitely postponed. ARTICLE 35.VOTED,that the Town amend Section 4 of Article 16A of the present By-Laws of the Town,said Arti- cle being entitled Harbor Regulations by striking out Sections 1 through 10 inclusive and inserting in place thereof Sections 1 through 4 as follows: Section I —In construing this By-Law the following words shall have the meaning herein given unless a contrary inten- tion clearly appears. "Cohasset Harbor"—shall mean all that body of water in Cohasset lying inside a line projected across the channel in a straight line from White Head Dolphin at Long's Point to White Rock and by the same course and shall not include the channel extending seaward beyond that point. T,Harbor Master"—shall me an harbor master,assistant harbor master and deputy harbor masters all duly appointed by the Selectmen. "Boat"—shall mean every description of water craft — other than a seaplane on the water —used or capable of be- ing used as a means of transportation on the water. "Persons"—shall mean individuals,corporations,so- cieties,associations and partnerships . "Skin Diver"—shall mean swimmers using fins and/or mask and/or snorkel tubes as self-contained underwater breathing devices . Section II —No master or person acting as master,owner, custodian or other person shall moor any boat within the limits of Cohasset Harbor without first obtaining a permit to moor said boat from the Harbor Master.Such permit must be obtained for each calendar year.The application for such permit shall be made to the Harbor Master on a form prescribed by the Selectmen.The application shall set forth the name and address of the owner,the size and type of boat to be moored,the size and type of the mooring,and if the mooring is already in the water the location thereof with sufficient details to enable the Harbor Master to locate it. The Harbor Master shall prepare regulations governing the size and specifications for moorings,their hardware and pennants,and shall submit the same to Selectmen for ap- 30 proval.Upon approval the regulations shall be published once in a newspaper regularly circulated in the Town,and at the Harbor Master's office at the Town Pier,and shall be available upon request.The regulations may be amended from time to time in the same manner. If the Harbor Master shall determine that any mooring applied for will conform to the requirements of said regula- tions,he shall issue the permit and assign a location for the mooring provided such a location is available . If the Harbor Master has determined that the mooring will not conform to the requirements of said regulations,or if he shall for other valid reasons deem it improper to issue such mooring permit he shall refuse to issue the permit. The Harbor Master shall issue or deny such permit within two weeks from the date of application. The applications for mooring permits and permits for tie up of small boats shall be issued by the Harbor Master and a duplicate thereof filed at the office of the Selectmen. No boat shall be made fast to a Town Landing or Pier for more than 30 minutes,except by permission of the Harbor Master . The Harbor Master snail keep accurate records and books and shall issue receipts in duplicate for mooring tie up per- mits ,the original of which shall be given to the applicant for the permit and the duplicate shall be filed at the office of the Selectmen. Boats anchored or moored in such a manner as to con- stitute a hazard to navigation or property may be moved at the expense of the owner.As far as practical,the Harbor Master shall require all commercial boats to be moored in a common area. Winter mooring buoys must be removed from Cohasset Harbor and suitable floating buoys attached by May 1.It shall be the duty of the Harbor Master to give written notice of two weeks to the owner and then to affix a proper buoy at the owner's expense. Section III —No person carrying passengers for hire shall embark or disembark such passengers from any boat at the Town Landings without permission of the Harbor Master. Section IV —No boat shall exceed a speed of four (4)nauti- cal miles per hour or cause a disturbing wake within the con- fines of Cohasset Harbor. 31 Section V —Any person skin diving in Cohas set Harbor shall (a)display a diver's flag consisting of a red field and a white diagonal stripe of sufficient size not less than twelve (12)inches square. (b)display such flag on a float or other similar device holding said flag upright at a height sufficient to be visible to passing boats . (c)tow the aforesaid float and flag with him while he is submerged in the water and surface thereunder,un- less for commercial purposes,permission is granted in writing by the Harbor Master to otherwise display flags for the protection of divers in Cohasset Harbor. (d)no skin diver shall operate in Cohasset Harbor except from a boat and attended by another person. Section VI —No person shall operate a boat in Cohasset Har- bor while towing water skiers,aqua -planes or other similar device except in connection with water carnivals and exhibi- tions authorized by the Selectmen,or in an area designated by the Selectmen.No person shall operate such boat or e- quipment in the vicinity of swimmers at any of the beaches of Cohasset. Section VII —Lobster pots,lobster cars,crab pots and other obstacles which will cause or create a hazard to navi- gation will not be placed in areas usually used for navigation. Section VTH —Discharging or depositing,or causing to be thrown overboard,oil,refuse,or waste into the harbor is prohibited. Section IX —Small sailing classes will be allowed to race within the Cohasset Harbor area when under the jurisdiction of an authorized race committee recognized by the Harbor Master.Such small boats shall respect the maneuvering problem of larger vessels in the Harbor. Section X —The proper usage of the Town launching ramps shall be determined by the Harbor Master.This shall in- clude the proper parking of trailers and motor vehicles at the approach to the ramp. Persons using Town ramps for hauling of larger boats requiring cradles shall apply to the Harbor Master for a written permit.Such cradles and/or boats shall not remain on the Town ramps for more than one tide. 32 Section XI —No person shall clean fish on Town floats or piers. Section XII —No person shall load or unload lobster pots, bait or other gear on or from any landing places,or floats or piers thereof except those designated by the Harbor Mas- ter. Section xm —No person shall leave ropes,pots,barrels, rocks or boards upon any Town landing places,floats or piers thereof for longer than is reasonably necessary in the act of loading or unloading the same to and from boats . Section XIV —Nothing contained herein shall be held or con- strued to supersede or conflict or interfere or limit juris- diction of the United States Government with respect to the enforcement of the navigation,shipping,anchorage,and as- sociated laws of the United States,or any lawful regulation of the Division of Waterways of the Department of Public Works,or the Division of Motor -boats of the Registry of Motor Vehicles,or to conflict with any of the laws of the Commonwealth of Massachusetts. The Forest Avenue construction project was completed by the bonding company .Mr.Louis F.Eaton,Jr.acted as counsel for the Town in the resolution of this matter.The new Cunningham T s Bridge was ready in ample time for the increased summer traffic. Final details of the purchase of the land of Margaret A. Kline and Martin Guida as well as the layout of James Lane are being worked out by counsel and should be completed in the very near future. The Board has continued liaison with Federal and State agencies in respect of the disposition of the Hingham Ammu- nition Depot Annex so-called,and also with regard to the prospects for a Federally aided harbor dredging project. Although analysis of final studies of the dredging project had not been completed as of the writing of this report,the Board has been advised that preliminary indications are fa- vorable.We hope to have more information in this regard to present to the Town Meeting or very shortly thereafter. The disposition of the Ammunition Depot Annex has been held up pending re -examination of possible continued Fede- ral agency use. The Cohasset Nike Site has been declared surplus by the Federal Government.Consideration of this in concert with all Town departments,committees and commissions which might be interested has thus far developed a present defin- ite use for a very small portion of the launcher area as a location for a water system standpipe.Negotiations to ob- tain such a location are being carried out by your Board. Throughout the year the Board has received the whole- hearted cooperation of all Town employees and department heads.We take this opportunity to express publicly our ap- preciation. Looking back 15 years for comparison ...there was a to- tal of 128 alarms,73 bell alarms and 55 still alarms.Com- paring these figures with 1963 we find an increase of 68%in bell alarms and an increase of 332%in still alarms .The department today has not one more piece of apparatus than it had in 1948 and the ON-DUTY manpower is the same today as it was in 1948.With these increases in response,in- creases in population,increases in valuation,increases in number of buildings ...mercantile,residential and civic, increases in types of hazards,increases in number of year around homes,increases in number of automobiles and trucks ...I feel that the ON-DUTY MANPOWER of the department should be INCREASED.Further delays in providing these additional firefighters can result only in closing of the North Cohasset and Beechwood Fire Stations. In this past year a new engine and transmission were in- stalled in Engine 4 and the hose body enlarged,making this a most useful and valuable part of the department.The Forest truck which is subjected to difficult work in entering the woods and traversing rough terrain was extensively re- paired.The other apparatus was repaired as the need arose.Over all,the apparatus is in good condition.The hose body of Engine 2 was modified to increase the hose car- rying capacity and enable it to lay parallel lines if neces- sary. In handling the 361 alarms in 1963 the department raised 1,362 feet of ladders and used 57,350 feet of hose.All hose of the department was washed,tested and inspected.Replace- ments were made for the defective lengths .All of the many small hand tools and fittings,inhalators and masks are cleaned and checked weekly and after use. The new Fire Headquarters building is of tremendous ad- vantage and convenience in the operation and maintenance of the department. The buildings which house the companies at North Cohas- 62 set and Beechwood are fast becoming out -dated and more dif- ficult to maintain.Changes in apparatus assignment are al- most impossible due to the limitations in floor space and height.These changes are necessary from time to time to provide proper coverage in the absence of the regular com- pany from its quarters. I recommend the following for your consideration in the immediate future. 1.Increase the rate of pay through the various grades of officers and men.The present pay scale falls short of that paid to the surrounding towns . 2 .The addition of 5 permanent firefighters to the depart- ment.This would allow the minimum on-duty man- power to cover all necessary apparatus during periods of sickness and vacation. 3 .A study of the possibilities of relocation of the sta- tions at North Cohasset and Beechwood,keeping in mind the service rendered by these companies not only to the immediate neighborhood but to the entire town. 4 .The construction of a training area which would in- clude a ladder training tower,a combination smoke house and fire combat building and a pumper test and drafting pit. In the year 1963 the following Call Firefighters retired: Austin L.Freeman,assigned to Ladder 1,who served from August 4,1942 to February 28,1963. Rufus A.James,assigned to Engine 3,who served from May 5,1928 to July 31,1963. Both of these men served the Fire Department and the Town of Cohasset faithfully for many years. CHARLES PIEPENBRINK Chief of Fire Department 63 CIVIL DEFENSE REPORT I herewith submit the Civil Defense report for the year ending December 31,1963. During the past year the emphasis has been on fallout shel- ters as directed by the Federal Government.Several build- ings in Town,having capabilities of offering some protection, have been submitted for approval.To date three areas loca- ted in the High School have been approved and stocked under the Federal Program and issued directly to the Town.Some P R Bunkers in the Ammunition Depot Annex have been ap- proved and stocked through the Commanding Officer of the South Weymouth Naval Air Station. Civil Defense Programs as they effect the local community are being updated by the Federal Government with consider- able changes being recommended in the areas of communica- tion,radiological monitoring,surplus property and match- ing funds . A seven week course in first aid was sponsored for the regular and auxiliary police forces . Program papers have been prepared and approved as re- quired. Regular visits to surplus property depots have been made in order to take advantage of any material or equipment the Town might acquire at greatly reduced costs . Three radiological monitoring stations have been estab- lished and equipped with radiological monitoring kits. The base stations for the Police and Fire Department ra- dios were installed in the Control Center at the High School along with the Civil Defense Station there,this installation insures complete radio coverage in case of any emergency. HARRY H.REED,JR.,Director SEALER OF WEIGHTS AND MEASURES I herewith submit my report as Sealer of Weights and Measures for the year ending December 31,1963. All weighing and measuring devices have been tested. 115 were sealed,7 adjusted. The amount of $100.70 for sealing fees was collected and paid to the Town Treasurer. NICHOLAS J.SINOPOLI,JR. Sealer of Weights and Measures 64 BOARD OF WATER COMMISSIONERS Both the total water pumped to supply and the total reve- nue committed reached record levels for the year 1963. New supplies were connected for the year,and all system facilities have been maintained in good operating condition. Outstanding projects over and above regular operations completed during the year are as follows: 1.Six hundred feet of 12'main was laid to connect the 12 T main on Pleasant Street to the one on Reservoir Road. 2.An 8 T main was laid across Cunningham Bridge.This insulated main gives us an all year connection at this point for the first time . 3.All 190 fire hydrants in town were inspected and re- paired as needed. 4 .A primary power installation was obtained for the treating plant,thus effecting a worth-while economy. 5 .The leaching bed for Aaron Brook water was tripled in capacity.This will augment materially our utilization of summer drainage from this important element of our water- shed. Water Department operations show a surplus for the year. It is planned to suggest that a good portion of this be appro- priated for certain high priority system improvements dur- ing the coming year. We wish to express our thanks to all Town Officials and Department Heads for their co-operation,and to Water De- partment Personnel for their loyal and efficient service. M.FRANK KNOY,Chairman Board of Water Commissioners 65 REPORT OF THE AARON RIVER COMMITTEE This Committee was appointed to investigate flooding con- ditions on the Aaron River ,and after visual inspection and subsequent surveys,the following conditions are hereby re- ported: 1.Flooding during high runoff periods occurs and cre- ates a nuisance and possible health hazard generally in the area from Doane Street westerly to Beechwood Street and the Cohasset Annex of the Hingham Ammu- nition Depot. 2.It is reported that the severity of flooding has in- creased during later years. 3.A lack of stream clearance maintenance has resulted in a heavy growth of brush and collection of various debris . It is advised that two possible methods of relieving flood- ing would be as follows: 1 .An annual program of brush clearing and cleanup main- tenance. 2.A Massachusetts Department of Public Works,Chap- ter 91 project for stream clearance. Because the Aaron River contributes to the present and future source of water supply,it is recommended by this Committee that a continued study be conducted by a commit- tee of five appointed by the Board of Selectmen to include the following: 1.Member of the Water Commission. 2.Member of the Planning Board. 3 .Member of the Board of Health. 4.Highway Surveyor. It is further recommended that the proposed committee initiate an appropriation to resolve the flooding conditions reported above at or before the next annual Town Meeting.
