HomeMy WebLinkAboutMinutes - BoS - 04/12/2017 Selectmen Meeting April 12, 2017 Selectmen Meeting Town Hall-Selectmen's Office 41 Highland Ave. Cohasset, MA Selectmen Present: Kevin McCarthy, Chairman Paul Schubert Diane Kennedy Jack Keniley Steve Gaumer Others Present: Christopher Senior,Town Manager Jim Lampke, Special Counsel Chairman McCarthy called the meeting to order at 7:00 p.m. Roll Call Vote: Jack Keniley-Present, Kevin McCarthy-Present, Paul Schubert-Present, Steve Gaumer-Present. Pledge-Recited Public Comments-None Decision-Entertainment License Hearing on complaints regarding noise and disturbances, Cohasset Harbor Group, LLC, d/b/a Cohasset Harbor Inn, 124 Elm Street, Cohasset—Attorney John Lawler, and Owner Gerd Ordelheide were present. Attorney Lampke stated they have drafted some changes to the entertainment license. Attorney Lawler asked if Mr. Ordelheide could speak briefly before they review the changes. Chairman McCarthy agreed. Mr. Ordelheide spoke briefly about his business and how any restriction to the license would negatively affect his businesses. Attorney Lampke reviewed the document. Attorney Lawler objected to any language about amplified sound produced beyond the lot line. After a lengthy discussion the Board agreed to change the language to include "unreasonably audible beyond the lot line". Motion by Selectman Schubert to take a five minutes recess, seconded by Selectman Keniley and the vote was unanimous(5-0). The board recessed at 8:37 p.m. Chairman McCarthy called the meeting back to order at 8:44 p.m. Attorney Lampke distributed the amended document. The Board and Attorney Lawler agreed to the document as presented. Motion by Selectman Gaumer that based on the findings made as to violations on September 25, 2016 at 8:08 p.m., CAD No. 16048036 and at 9:04 p.m., CAD No. 1604804,we find that the Licensee; 1. Failed to protect members of the public from disruptive conduct 2. Failed to prevent an unreasonable increase in the level of noise in the area caused by noise generated by the licensed activities and as such violated the terms of the license and G.L. c. 140,sec. 183A,seconded by Selectman Keniley. Roll Call Vote;Jack Keniley-Aye, Diane Kennedy-Aye, Kevin McCarthy-Aye, Paul Schubert-Aye,Steve Gaumer-Aye. 1 Selectmen Meeting April 12, 2017 Motion by Selectman Gaumer in view of the above findings and findings made on March 7, 2017, move to; 1. Issue a reprimand and warning to the licensee due to these violations. Any further violations will result in administrative action. 2. Modify the licensing terms and conditions by making the following with the changes to the existing license accepted by the Board tonight, April 12,2017 as attached hereto. 3. Additionally approve the renewal of the existing license as amended for the balance of the 2017, seconded by Selectman Keniley. Roll Call Vote;Jack Keniley-Aye, Diane Kennedy-Aye, Kevin McCarthy-Aye, Paul Schubert-Aye,Steve Gaumer-Aye. Motion by Selectman Kennedy to adjourn, seconded by Selectman Schubert and the vote was unanimous (5-0.
