HomeMy WebLinkAboutMinutes - BoS - 03/28/2017 Selectmen Meeting March 28, 2017 Selectmen Meeting Town Hall-Selectmen's Office 41 Highland Ave. Cohasset, MA Selectmen Present: Kevin McCarthy, Chairman Paul Schubert Diane Kennedy Jack Keniley Steve Gaumer Others Present: Christopher Senior,Town Manager Chairman McCarthy called the meeting order at 7:00 p.m. Roll Call Vote:Jack Keniley-Present, Diane Kennedy-Present, Kevin McCarthy-Present, Paul Schubert-Present,Steve Gaumer-Present. Chairman McCarthy asked for a motion to go into Executive Session-Exemption#3—To discuss strategy with respect to litigation if an open meeting may have a detrimental effect on the litigating position of the Town, and the Chair so declares. The Board will discuss Local Vines&Gourmet LLC v.TOC; Christopher Tosi &Tatiana Tosi v. Paul &Jill Tedeschi &Coh ZBA; Rustam Devitre &Virginia Shahinian v. Coh ZBA&John and Jane Steinmetz;TOC ZBA v. Eric Kupperstein, George Henry and Kathleen Fox; Alexander Koines&Stephen Crummey v.TOC ZBA. The Board will have periodic updates on litigation matters. Motion moved by Selectman Schubert and seconded by Selectman Gaumer. Roll Call Vote: Jack Keniley-Present, Diane Kennedy-Present, Kevin McCarthy-Present, Paul Schubert-Present, Steve Gaumer-Present. The Board returned to open session at 7:30 p.m. Public Comments-None Licenses/Permits/Events-Acting Director of South Shore Art Center William Houser gave an overview of the events planned for the weekend of the festival. Motion by Selectman Kennedy to approve the use of the common from June 13-18, 2017 for the South Shore Arts Festival, seconded by Selectman Schubert and the vote was unanimous (5-0). Motion by Selectman Kennedy to approve an entertainment license for the South Shore Arts Festival from June 15-18, 2017,seconded by Selectman Schubert and the vote was unanimous (5-0). Motion by Selectman Kennedy to approve one day liquor license 6/15 on the common and 6/16 at the South Shore Art Center,seconded by Selectman Gaumer and the vote was unanimous (5-0). Community Compact-Mr. Senior gave an overview of the Community Compact program. The Town of Cohasset applied for and was officially awarded two grants. One grant is up to $25,000 toward the cost of Performing a Cyber Security Assessment and another grant is up to $30,000 towards the cost of Inventory and Geo-Coding all public works assets. There will be a formal community signing. He will let the Board know when the date is set. Article#3-Sewer Commission-Sewer Rate Increase-Motion by Selectman Gaumer to put Article#3- Sewer Rate Increase on the Warrant for Annual Town Meeting, seconded by Selectman Keniley and the vote was unanimous(5-0). The Board had a brief discussion and decided to wait on recommendation since the Advisory Committee had not yet voted on the article. 1 Selectmen Meeting March 28, 2017 Article#5-Unpaid Bills from Previous Years-Motion by Selectman Schubert to put Article#5-Unpaid Bills from Previous Years on the Warrant for Annual Town Meeting, seconded by Selectman Kennedy and the vote was unanimous(5-0). Motion by Selectman Kennedy to recommend Article#5-Unpaid Bills from Previous Years to Town Meeting, seconded by Selectman Schubert and the vote was unanimous(5-0). Article#6-Supplemental Appropriations for Fiscal 2017-Mr. Senior reviewed the funding for various departments. Motion by Selectman Gaumer to recommend Article#6-Supplemental Appropriations for Fiscal 2017, seconded by Selectman Kennedy and the vote was unanimous(5-0). Article#7 Stabilization and other Special Funds-Mr. Senior explained the article. After a lengthy discussion the Board decided to remove $171,000 Sewer Estimated Revenues to Sewer Capital Stabilization and take that up at Special Town Meeting. Motion by Selectman Gaumer to amend Article #7 Stabilization and other Special Funds by removing the request for$171,000 from Sewer Estimated Revenues to Sewer Capital Stabilization,seconded by Selectman Keniley and the vote was unanimous (5-0). Motion by Selectman Schubert to put Article#7 Stabilization and other Special Funds, as amended, on the Warrant for Annual Town Meeting and recommend to Town Meeting the remaining five items, seconded by Selectman Kennedy and the vote was unanimous (5-0). Article#8-Capital Improvements Budget-Chairman of Capital Budget Sam Wakeman was present and discussed the proposed funding. The Board had a lengthy discussion about splitting the article into 2 sections (8a & 8b). Motion by Selectman Gaumer to recommend Article#8 Capital Improvements Budget as presented,with the exception of$406,000 for Bound Brook borrowing,seconded by Selectman Keniley and the vote was unanimous(5-0). Motion by Selectman Kennedy to recommend Article renamed 8b for$406,000 for Bound Brook borrowing, seconded by Selectman Keniley and the vote was unanimous(5-0). Article#9-General Bylaw-Departmental Revolving Funds-Mr. Senior explained the article. Motion by Selectman Schubert to place Article#9 General Bylaw-Departmental Revolving Funds on the Warrant for Annual Town Meeting and recommend adding to the language that fees and fines are revenue sources and to recommend Article#9 General Bylaw-Departmental Revolving Funds to Town Meeting, seconded by Selectman Gaumer and the vote was unanimous (5-0). Article#10-Funds for Road Repair and Maintenance-Motion by Selectman Kennedy to recommend Article#10 Funds for Road Repair and Maintenance,seconded by Selectman Keniley and the vote was unanimous (5-0). Article#11-Funds for Facilities Projects-Mr. Senior recommended the Board removed the article as there are not any projects suggested at this time. Motion by Selectman Gaumer to remove Article#11 Funds for Facilities Projects from the Warrant for Annual Town Meeting, seconded by Selectman Schubert and the vote was unanimous(5-0). Article#11-Allocation of Funds for One Time Cost-Mr. Senior explained the article. After a brief discussion the Board will hold off on voting for$25,000 from free cash to Equipment to permit broadcasting from the Senior Center. Mr. Senior stated he just received the dollar amount and he has not gone to Capital Budget but certainly can. Motion by Selectman Kennedy to recommend Article#11 Allocation of Funds for One Time Cost which includes$6000 for New Fire Hose, $6000 for New Motor, 2 Selectmen Meeting March 28, 2017 Town workboat and $20,000 for Cohasset Harbor Study(Town match to state grant),seconded by Selectman Schubert and the vote was unanimous (5-0). Article#12 New Water Main Loop-Motion by Selectman Schubert to recommend Article#12 New Water Main Loop to Town Meeting, seconded by Selectman Gaumer and the vote was unanimous (5-0). Article#15 Community Preservation Committee-Mr. Senior gave the Board the updated request for the Parker Avenue Boat Ramp of up to $50,000 for consulting services to assess the ramp, prepare a design and bid specifications for repair, and prepare for the filing of all necessary permits from other governmental levels. Motion by Selectman Gaumer to recommend Article#15-CPC to ATM, seconded by Selectman Schubert and the vote was unanimous (5-0). Article#16-Denial of Licenses and Permits-Motion by Selectman Schubert to put Article#16 Denial of Licenses and Permits on the Warrant for Annual Town Meeting and recommend to Town Meeting, seconded by Selectman Kennedy and the vote was unanimous (5-0). Article#17-Temporary Moratorium on Marijuana Establishments-Motion by Selectman Gaumer to recommend Article#17-Temporary Moratorium on Marijuana Establishments to Town Meeting, seconded by Selectman Schubert and the vote was unanimous(5-0). Article#18-Amendments to Cohasset General By-Laws-Motion by Selectman Kennedy to recommend Article#18 Amendments to Cohasset General By-Laws to Town Meeting, seconded by Selectman Schubert and to vote was unanimous(5-0). Article#19-Sewer Commission-Betterment Refund-Motion by Selectman Gaumer to put Article#19 Betterment Refund on the Warrant for Annual Town Meeting and recommend to Town Meeting, seconded by Selectman Keniley and the vote was unanimous (5-0). Article#20-Amend and Re-Allocate Special Education Stabilization Fund-Motion by Selectman Schubert to put Article#20 Amend and Re-Allocate Special Education Stabilization Fund on the Warrant for Annual Town Meeting and recommend to Town Meeting,seconded by Selectman Kennedy and the vote was unanimous (5-0). Article#26-Amending the Large Home Review Process-Motion by Selectman Kennedy to recommend Article#26 Amending the Large Home Review Process to Town Meeting,seconded by Selectman Schubert and the vote was unanimous(5-0). Article#27-Citizen's Petition to Create a Scenic Roads Bylaw-Tom Callahan-35 Hillside Drive spoke on the article. He stated he will be indefinitely postponing the article on the floor of ATM. The Board had a lengthy discussion and agreed to make a couple of changes and put the article on the Warrant as their article. Motion by Selectman Kennedy to adopt Article#27 as a Board of Selectmen article, seconded by Selectman Keniley. The vote was 4-0. Selectman Gaumer abstained from the vote. Motion by Selectman Kennedy to put Article#27 Scenic Road Bylaw on the Warrant for Annual Town Meeting,seconded by Selectman Keniley and the vote was unanimous(5-0). Amendments: Motion by Selectman Kennedy to amend Article#27 Section 1, seconded by Selectman Schubert and the vote was unanimous(5-0). 3 Selectmen Meeting March 28, 2017 Motion by Selectman Kennedy to amend Article#27 Section 3, seconded by Selectman Schubert and the vote was unanimous(5-0). Motion by Selectman Kennedy to amend Article#27 Section 6, seconded by Selectman Schubert and the vote was unanimous(5-0). Motion by Selectman Schubert to amend Article#27 Section 5 H-1,seconded by Selectman Gaumer and the vote was 3-2. Selectmen Kennedy and Keniley voted against. Recommendation: Motion by Selectman Kennedy to recommend Article#27 Scenic Road Bylaw to ATM with amendments made, seconded by Selectman Keniley and the vote was unanimous(5-0). Article 28-Citizen's Petition to Create a Scenic Roads Bylaw-Motion by Selectman Kennedy to recommend to Town Meeting to indefinitely postpone Article#28, seconded by Selectman Schubert and the vote was unanimous(5-0). Article 29-Citizen's Petition Amending Large Home Review Process-Motion by Selectman Kennedy to recommend to Town Meeting to indefinitely postpone Article#29, seconded by Selectman Keniley and the vote was unanimous(5-0). Article#30-Citizen's Petition New Land Alteration Regulations-Mr. Callahan spoke about the proposed article. Mr. Senior stated the Planning Board will discuss on 4/12/17. The Selectman will discuss after the Planning Board meeting on 4/12/17. Article#31-Citizen's Petition Amendment of the Table of Area Regulations-Motion by Selectman Kennedy to recommend to Town Meeting to indefinitely postpone Article#31,seconded by Selectman Schubert and the vote was unanimous(5-0). Article#32-Citizen's Petition Expansion of Central Cohasset Waste Water Sewer System-Mr. Senior advised the Board the proponent has sent an email that he will be withdrawing his article at ATM. Motion by Selectman Gaumer to recommend to Town Meeting to indefinitely postpone Article#32, seconded by Selectman Schubert and the vote was unanimous (5-0). Motion by Selectman Kennedy to close the Warrant for Annual Town Meeting and approve for publication,seconded by Selectman Schubert and the vote was unanimous(5-0). Chairman McCarthy asked Mr. Senior about $65,000 in the budget for a town planner. Mr. Senior said a job description will be created. The Board had a lengthy discussion. Selectmen Update-Selectmen Gaumer received an email from a neighbor about trees on Pond Street being removed or pruned by National Grid. The neighbor is concerned it will change the look of the street. Mr. Senior will look into this. Selectman Schubert attended the Safe Harbor Coalition. The Chief of Police from Walpole was the speaker and discussed their approach to the marijuana law. Chairman McCarthy attended the Health and Recreation Fair. It was a great event thanks to the Recreation and Public Health departments. Selectman Kennedy stated the Board attended the Town Hall Renovation Advisory Committee meeting. The Long Range Planning group has produced a lot of useful information on their one drive and would like to have the group come to a future meeting and update the Board on their progress. Selectman Kennedy attended an arts lobbying day at the State House. She met with Senator 4 Selectmen Meeting March 28, 2017 O'Connor and his staff; Senator O'Connor plans to submit a bill to fund the School Resource Officer across the state. Town Manager Update—FY17 Fiscal Update-Mr. Senior stated the current budget is in balance. Motor Vehicle Excise Tax revenue is up 15%from this time last year. Fees and permits have flattened from last year. The Town has started the implementation of the new Human Resources Payroll system. The new phone system at town hall should be installed within a couple of weeks. Mr. Senior thanked Mary Goodwin,Ted Carroll, Susan Sarni and all of their staff for a great Health & Recreation Fair. \ Minutes-Motion by Selectman Schubert to approve the minutes of 3/16/17,seconded by Selectman Keniley and the vote was unanimous(5-0). Motion by Selectman Gaumer to adjourn,seconded by Selectman Keniley and the vote was unanimous (5-0).
