HomeMy WebLinkAboutMinutes - BoS - 09/22/2015 Minutes-Board of Selectmen September 22, 2015 Selectmen's Office-Town Hall 41 Highland Avenue Cohasset, MA Selectmen Present: Steve Gaumer, Chairman Kevin McCarthy,Vice Chairman Diane Kennedy Karen Quigley-arrived 6:59 p.m. Paul Schubert Others Present: Christopher Senior,Town Manager Paul DeRensis,Town Counsel Chairman Gaumer called the meeting to order at 6:32 p.m.and asked for a motion to go into executive session for Exemption#3-to discuss strategy with respect to collective bargaining or litigation if an open meeting may have a detrimental effect on the bargaining or litigating position of the public body,and the Chair so declares. The Board will have an update on negotiations with school unions. Exemption#6-to consider the purchase,exchange, lease or value of real property if the chair declares that an open meeting may have a detrimental effect on the negotiating position of the public body and the Chair so declares. The Board will get an update on 91 Sohier Street. Exemption#3-to discuss strategy with respect to collective bargaining or litigation if an open meeting may have a detrimental effect on the bargaining or litigating position of the public body,and the Chair so declares. The Board will get an update on town union negotiations. Selectman Schubert moved the motion,seconded by Selectman Kennedy. Selectman McCarthy expressed concern that there is not enough time to discuss all the issues. He also has issues with discussing 91 Sohier Street in executive session. He believes it should be discussed in public session. The Board had a brief discussion. Roll Call Vote; Kevin McCarthy-Aye,Steve Gaumer-Aye, Diane Kennedy-Aye, Paul Schubert-Aye. The Board went into executive session at 6:41 p.m. The Board came out of executive session at 8:07 p.m. Chairman Gaumer called the meeting back to order at 8:12 p.m. Public Comment-None Pledge of Allegiance-Recited Selectmen Update Selectman McCarthy discussed a letter the Board received from Norfolk County Sheriff's Office and asked if the Board would invite them in for a conversation about drug and alcohol addiction in the community. Chairman Gaumer will put on a future agenda. Assignments of Fiscal Forecasting Forums-The Board had a brief discussion. Most members will be attending all of the forums. Mr.Senior just wanted to be sure a Selectman would be present. i Legislative Liaison-Chairman Gaumer suggested to the Board that this liaison position sit with the Chairman. He stated it would rotate year by year. The liaison would report Lack to the Board. It does not preclude any other member or give the liaison authority to represent or react. The liaison would work in conjunction with the Town Manager. Motion by Selectman Kennedy to create the position of legislative liaison to establish communication with the state and federal delegations,seconded by Selectman McCarthy and the vote was unanimous(5-0). 1 Selectmen-9.24.15 TC Initial Minutes-Board of Selectmen September 22,2015 Town Manager Report-Mr.Senior advised the Board Chrissie Dalhstrom started as an administrative assistant in Permits& Inspections department this week. Ken Thayer retired from the DPW this week after 17 years of work with the Town of Cohasset. The harbor dredging project is still on target to begin on October 1, 2015. All information about the dredging is on the town website. Sandy Beach will be closed and off limits until the dredging is completed. National Grid has started the gas main replacement in the Village area. Most of the work will be done at night.All information on this project is on the town website. Advance of Funds in Lieu of Borrowing Treasurer/Collector Paula Linhares stated that Article#19 was approved by town meeting on November 13, 2006 for Sewer Inflow and infiltration. Motion by Selectman Schubert to approve the advance of funds in lieu of borrowing as voted by Town Meeting in 2006,Article 19,seconded by Selectman Kennedy and the vote was unanimous(5-0). Liquor License Transfer-Sa"an Enterprises, LLC(update on progress) Joginder& Deborah Sajjan, owners of Sajjan Enterprises were present. Mr.Sajjan stated he is in the process of purchasing the property at 807 Chief Justice Cushing Highway. They have submitted an application for approval of a site plan and septic design to the Planning Board. Chairman Gaumer reminded Mr.Sajjan that the Board continued the transfer application until October 271h. License/Perm its/Events One day liquor license-South Shore Art Center Motion by Selectman Kennedy to approve a one day liquor license for 10/17/15 for the Artoberfest at South Shore Art Center,seconded by Selectman Schubert and the vote was unanimous(5-0). Halloween Event-South Shore Community Center Director of South Shore Community Center Ann Madden was present. She gave an overview of their Annual Halloween Fair. Motion by Selectman Kennedy to approve the event application for the South Shore Community Center Halloween Fair for October 25,2015 from 12:30-4:30 pm,seconded by Selectman Schubert and the vote was unanimous(5-0). Chairman Gaumer acknowledged Mr. Robert Fowkes from Congressman Lynch's office was present. FEMA LOMR Update Director of Project Management Brian Joyce and Peter Williams of GZA were present. Mr.Williams discussed the results of the analysis and the calculations to support the LOMR. They did find issues that were questionable with the wind data. They are prepared to submit the LOMR with the maps and changes to FEMA. Mr.Joyce suggested the Town go forward and request the LOMR. They have done a lot of research and have a more realistic map. Ralph Dormitzer-111 Atlantic Avenue asked Mr.Williams about elevation in his area and if he could see the maps they are referring to. Mr.Joyce advised Mr. Dormitzer that the maps are on the town's website. Motion by Selectman Quigley to move forward with the next phase and submit a request for a LOMR, seconded by Selectman Kennedy and the vote was unanimous(5-0). Energy Reduction Plan-proposal prepared by AEC for the Green Communities application. Co-Chairman of AEC Mary Jo Larson and Member Patricia Gooding were present on behalf of the AEC. They discussed the criteria#3 for the MA Green Communities Grant Program. 2 Selectmen-9.24.15-TC Initial Minutes-Board of Selectmen September 22,2015 Motion by Selectman McCarthy to accept the document as presented and authorize the Town Manager to draft a cover letter stating the Board of Selectmen accepted the Energy Reduction Plan on 9/22/15,seconded by Selectman Kennedy and the vote was unanimous(5-0). Budget Message 2017 Chairman Gaumer asked for any changes members forwarded. There were no changes forwarded. The Board had a discussion and suggested changes. Selectman Kennedy will make the edits as discussed. Chairman of Advisory Peter Pescatore of 12 Lantern Lane asked if the Board was going to revisit and make any edits to the Financial Management Policies. Chairman Gaumer suggested the Board revisits the Advisory Committee comments on the Financial Mgmt. Policies and put on an agenda in the future before Special Town Meeting. Motion by Selectman Schubert to approve the Budget Message for FY17 as amended,seconded by Selectman McCarthy and the vote was unanimous(5-0). Special Town Meeting Update Mr.Senior distributed a draft warrant for STM on November 2, 2015. He discussed briefly the proposed 11 draft articles. He asked the Board to look over and review. He noted it is a working document. Minutes Motion by Selectman Kennedy to approve the minutes of 9/8/15 as amended,seconded by Selectman McCarthy and the vote was 4-0-1. Selectman Quigley abstained from the vote. Topics not reasonably anticipated by Chairman 48 hours in advance Chairman Gaumer stated the Board will need to re-enter executive session for the reasons stated earlier as they did not complete their discussion. He asked for a motion to go back into executive session for Exemption #6-to consider the purchase,exchange, lease or value of real property if the chair so declares that an open meeting may have a detrimental effect on the negotiating position of the public body and the Chair does declare. The Board will get an update on 91 Sohier Street. Exemption #3-to discuss strategy with respect to collective bargaining or litigation if an open meeting may have a detrimental effect on the bargaining or litigating position of the public body, and the Chair so declares. The Board will get an update on town union negotiations. The Board will come out of executive session into open session for the purpose of adjourning. Selectman Schubert moved the motion,seconded by Selectman Kennedy. Roll Call Vote; Kevin McCarthy-Aye, Karen Quigley-Aye,Steve Gaumer-Aye, Diane Kennedy- Aye,Paul Schubert-Aye. The board entered into executive session at 10:29 p.m. The board came out of executive session at 12:19 a.m. Motion by Selectman Schubert to adjourn,seconded by Selectman Kennedy and the vote was unanimous (5-0).
