'resent Voted: To approve the minutes of meeting held on December 26, 1979 as submitted. 8:30 p.m. bids for high pressure cleaner were opened as follows: 1) Automotive z•larehouse Co. - Uatertown $1350. 2) 1obile- Fleet Services, Inc., 1laynard- 01571.50 Voted: To twee these bids under advisement. 3:35 p.m. Dr, p'ompeo, Iiarold Litchfield, Hi hc•ray Supt. were present to discuss the managemcnt over the dump. Dr. Pompeo said the Board of Health could be responsi- ble for inspections and supervisory but they !-,now little concernin0 the management of fill etc. or machinery or equipment. They could still be the watch-doS but the high`ray supt. and dump supt. could work together. It might be more efficient because the highiTay and dump could share their manpower. 9:00 p.m. Chief Feola eras present to discuss his budget for training new officers. fir. Clark said if the classes start after this neat July there has to be money in this new budget. One patrolman has to go now and there are two more coming and there is $500. in the budget now. In answer to the question of hcxr many radios there are available (used) . There are: 4 radios, l base station, 6 portables, 2"yuk%ie" portables and some chargers. I1r. Clark said 3 radios (or mobiles) are needed by Highway, Water and Tree & Park and hold 2 in reserve. Voted: To accept with regret the resignation of A.J. Antoine as our Town Constable (he will serve until we find his replacment) Voted: To open the warrant for the Special Town leeting on Feb. 14, 1900. (will be closed on Friday, Jan. 4) Ins. Voted: To accept the bid of 1 aclntyre , Faye and Thayer , Newton for fire and casualty insurance for the Town for 091,563. for a period of three years. Voted: To grant a rn:!-day auctioneer license for Saturday, January 12, 1980, to Bernard Ciampi, Braintree. Voted: To grant permission for Eastern Edison Co. to upgrade the street lighting in the area of the village, parking lot and Elm Street to Hugo's Motel- changing 12 incandescent street lights to 1001mtt mercury vapor costing an increase of $125.00 per year to the street light budget. Voted: to approve the plans for the annual roadrace on April 6, 1980 for the Cohasset Jaycees (Mr. Roy Fitzsi=ons was present) . Voted: To e.:ecute the contract with Mace, Inc., Norwell for the study of the heating system in the police and fire stations for the sum of "200. (not including inspection and drawings) Voted: To appoint Lot E. Bates, who is now our sealer of weights & measures as one of the wood & bark measurers, in place of Peter Laugelle. Voted: To recommend that the Personnel Committee reclassify Betty Reddie from S-1 to S-4 2nd step (sec:�ctary to Bldg. Insp. and Health AS.) Voted: To renew the Class I license for Spensley Chevrolet, Inc. for 1980. Voted: To renew the Class II license for Silvia's Garage for 1980. Voted: To award the bid for a high pressure - hot steam cleaner for the tree & park department to Mobile Fleet Services Inc. of Maynard for $1571.50 D ISCUSSION: Selectman Laugelle said the old '61 pick-up at the cemetery should be moved out of there. We will take clAmmd bids for it. We should have the police and fire chiefs into our ne:,t meeting to discuss cooperation in answering medical calls 3 REGULAR. MEETING OF THE BOARD OF SELECTMEN HELD ON JANUARY 16, 1980 All Present Voted: To approve the minutes of January 9, 1980 as submitted. 8:15 p.m. Chief Piepenbrink and Chief Feola of the fire and police departments were present to discuss better communications for medical calls. Mr. Laugelle asked them if the police were notified on ambulance runs and if not they should be. Chief Feola said the radio and scanner is on at the station and the alarm rings 3 times. Chief Piepenbrink said the majority of calls originate at the police station and are sent to the fire dept. after. The maintenance of the police and fire building was discussed. It was agreed that the Selectmen would accept jurisdiction for the maintenance of the outside of this building. Joe Hamilton was present to express his interest in the vacancy of Town Constable. He submitted a letter with signatures. Voted: To order the dog of Clifford Nitman, 178 South lain Street restrained to the property because of attach on John Linsley, 63 Nichols road in front of library. Voted: To reaffirm order to Claus :'iae^,,,e a n, Jerus. Rd. to -Weep his do restrained because of another complaint. Interim Action: The warrant for the Special Town P-leeting on Feb. 14, 1980 was signed. i REGULAR MEETING OF THE BOARD OF SELEMM ;<LD ON JANUARY 23, 1930 All Present Voted: To approve the minutes of meeting held on January 16, 1930 as submitted. Barbara Elliot, candidate for Town Constable and Joe Hamilton, also a candidate were preseet to express their interest in this vacancy. 8:15 p.m. Harold Litchfield, Highway Superintendent was present to discuss the Highway Dept, taking over the operation of the dump. Mr. Litchfield said he would try it for one year and see how it works free of compensation. After that it will take a vote of Town 11eeting to change his salary as an elected official. The Board of Health will still be responsible for inspections. Selectman Ainslie discussed with the Highway Superintendent, the possibility of cutting down the hill on Margin Court three (3•) inches - this would be an article for the warrant. Mr. John Rousseau, Atty. was present to be interviewed for the vacancy on the Board of Appeals. He isTAt.th a commercial real estate company and did not feel he would be in conflict. Voted: To move Myrna Putziger, I`ing Street, up from associate to regular member of the Board of Appeals to fill the vacancy caused by the death of John D. Londergani Voted: To appoint Atty. Jobn Rousseau, Fernway, as an associate member of the Board of Appeals to fill the vacancy caused by moving Myrna Putziger up to a full member. llt. Edwin Young was present to discuss the progress of the new appointed Sewer Advisory Committee - their choice was the Jones site and they want to discuss it with other Town Officials for input and ramifications so there are no surprises at Town I'leetin; and am7ar question will get a fair chance. S REGULAR IEEE= OF THE BOARD OF SELECTMEN HELD ON Fu'aruaryr 6, 1930 All Present Voted: To approve the minutes of meeting held on January 31, 1930 as submitted. Voted: To have the Town Election time start at 7:00 a.m, and and at 3:00 p.m. (1101 4, 1930) - primary Voted: To grant a one day brine license to Nancy O'Toole for Feb. 10 at St. Stephens for campaign. Voted: To approve the list of checkers for the Special Town Meeting on Feb. 14, 1930. Voted: To amend the letter to Chief Feola regarding the appointment of Charles E. Stockbridge as Lt. in Charge to read : 'be shall assume the duties of Chief o! Police during the time that the Chief is on vacation". Voted: To request from the Advisory Board a total of 05,150. for the initial cleaning-up of the Police Station and the weekly cleaning 5 days a week to be allocated in the budget. 2ir. and Mrs. Irwin, Bingham were present to discuss the drive- way leading into their property off of Beachwood Street. Mr. Clark said the Town will recove the post and cable along the road but the Town cannot pay far cutting down the high spot. Selectmen Ainslie asked that they bring in plans for the drive. At the invitation of the Board of Selectmen, 'Robert Haxilmrias present to offer more information regarding his plans for an Elderly Hous>3 Project on Cedar Street. George Benedict, Pat Barrows and Lloyd Prescott rare present from the Cohasset Housing Authority. Mr. C1ar'h read the application to HUD„ and a question and answer period followed. Selectman Laugelle requested the need for one way signs in the Village parking lot. VOTD: To approve these signs. Totm Counsel appeared and said his opinion was final and we must follow the advice of the Secretary of State. Feola Jr. The motion was made by Selectmen Laugelle and seconded by Selectman Ainslie and it was VOTEp as follows: to appoint six permanent inter- mittent police officers in sequence as taken from the Civil Service List based an experience in police work as follcmm; David C. Cogill, Daniel F. Ainslie, Edward R. Connor, John I1, Small, Richard Yocum, and Lawrence D. Ainslie. (Selectman Clark abstained ftm the above vote) (2 ti BOARD OF SEMI,CTMW s. Minutes of Executive Session March 19, 1980 Following a unanimous vote to go into executive session, resumes and notes taken during personal interviews were reviewed on all eleven (11) applicants. Selectman Ainslie expressed the opinion that members of the auxiliary police force, as a Board sponsored activity, should receive consideration for their training, experience and years of devoted service to the community without pay. He further stated that they were by far the most qualified and already have obtained at their own expense the required training, consisting of Police Combat and Criminal Justice Training Council programs, to exercise powers of arrest. He suggested that an equitable basis for selection within criteria set forth in Civil Service Form 16, Part II would be to select the highest ranking veteran, the highest ranking non-veteran, the highest ranking auxiliary police officer, the other two auxiliary police officers in order of experience and finally the only experienced veteran. Chairman Clark indicated that he had already gone on public record as favoring selection in numerical order regardless of experience, except for the second named whom he considered to be a non-resident. Mr. Ainslie suggested that in the eyes of civil service all applicants are residents even though the two top persons on the list have since moved to Scituate and Weymouth respectively. Selectman Laugelle said that he favored preference for veterans and auxiliaries in order of their ranking and moved that the following persons be appointed: Cogill, David C.; Ainslie, Daniel F.; Connor, Edward . ; Small, ohn xI. ; Yocurn, Richard; an4 Ainslie, Lawrence D. This flag was a gift to him and had once flown over the Capital above the U.S. Senate. 0:10 p.m. Charles Butman, son and daughter-in-law were present to complain of motorcycles and other vehicles speeding along the railroad bed by Spring Street creating a dangerous situation there. Ile suggested that the railroad bed be bloc%ed off writh piles of stones. Kasperowicz : The following is our response to your written complaint that at a Cohasset Selectmen' s meeting on March 19 , 1980 , Selectman Henry Ainslie voted on the appointment of a group of permanent intermittent police officers that included his nephew and his second cousin. Mr. Ainslie has verified the basic facts and added that he is aware of the relationship but is not personally acquainted with the second cousin. Thisoffice is responsible for enforcing certain criminal conflict of interest sections in G.L. c . 268A. Sections 18 , 19 and 20 define criminal violations by municipal employees . Section 19 (a) states that it is a violation for a municipal employee to participate as such in a particular matter in which "his immediate family" has a financia'1 interest. The definition of "immediate family" in G.L. c . 268A is expressly limited by Section 1 to "the employee and his spouse, and their parents, children, brothers and sisters . " It follows that a Selectman' s vote on the appointment of a nephew or second cousin is not a violation of the criminal provisions of this act. A second important factor in this case is that one of the other Selectmen had abstained from the votes in question , and if Selectman Ainslie had abstained the validity of a vote by only one participating member of a three member board would be open to question. The Supreme Judicial Court has recog- nized that in some cases in similar circumstances "participa- tion despite disqualification, under a rule of necessity" may be necessary and permissible. Graham v. McGrail , 370 Mass . 133 (1976) . Also present were neighbors, friends and family of the White family. The Selectmen signed the copies of the conservation restrictions. © RRMAR MEETING OF THE BOARD OF SELECTM HELD ON DECEMBER 17, 1980 All Present Voted: To approve the minutes of meeting held on December 10, 1980. 8:45 p.m. - the Harbor Study Committee was present: (Charles Fink, Chairman, Bernard Salvador, Kenneth Cook and Harry Ritter) Mr. Fink explained that his committee would like to increase the revenues of the Harbor in order to offset the required cut in the budget of the Harbor. If mooring fees were raised from $1.00 to 1.50 per foot It would be enough to make up for the cut. Mr. Ainslie said the increased fees should go into the general fund and build up surplus revenue for the benefit of all. Mr. Clark said the feeling of the Advisory Board is that every department has to feel a cut. If they don't cut, it has to come double from somewhere else. Night Patrol for instance, would save money if it were on a vol� basis. It was agreed that the night patrol would not be cut but that a 5 percent cut must be made. Voted: To raise the mooring fees from $1.00 to $1.50 (this does not apply to the 5 percent cut) Voted: To appoint J. Michael Roberts as our Assistant Town Counsel to fill the vacancy caused by the resignation of Maurice McLaughlin. Voted: To write a letter to the Mass. Department of Natural Resources regarding the stocking of the reservoir of alewives in March & April (at recommendation of the fish warden). INTERIM ACTION: Permission was given to the Highway Surveyor to sand Aaron River Road as an emergency measure and as a one-time operation to alleviate a dangerous situation. Mr. Collins complained of Devins dog being lose after ordered restrained and causing a nuisance. The dog officer recommended that this dog be either restrained or removed from Town or destroyed. Mr. Devin said he will restrain the dog until he could find a new hone out of town. 8:30 p.m. - bids for the design of the new Beechwood Fire Station were opened as follows: 1) Strekalovsky & Hoit, Hingham - $4,000. 2) Schwartz/Silver, Boston - $2,900. 3) Maurice Kennedy, W. Selectman Laugelle reported talking to the Police Chief and to the Highway Surveyor. Selectman Ainslie read the laws of Hingham, Hull and Norwell regarding parking during winter, and said this would be discussed again at our next meeting.
