STEPHEN CLEARY,PAUL CLEARY—BRIEF ADMINISTRATION DISCUSSION: SITE PLAN REVIEW AND SPECIAL PERMIT FILING, 8 JAMES LANE - Stephen Cleary and Paul Cleary in attendance. Application was filed on March 5, 2009. Deadline to open public hearing is April 3,2009. Board would like to wait until after town elections to open public hearing so new Planning Board member is in attendance from the first public hearing for this combined special permit and site plan review application. Clearys are more than agreeable to waiting until April 8,2009 meeting. Clearys will submit letter requesting extension for opening public hearing to April 24,2009. Public hearing will be scheduled for April 8,2009 at 7:00 PM. 7:10 P.M. 11 JERUSALEM ROAD, LARGE HOME REVIEW PUBLIC HEARING —OWNER: PAUL &DEBRA BOWEN, APPLICANT: HEIDI CONDON, filed on: Feb. 12,2009 Member Samuelson read public hearing advertisement. In attendance to represent application: Applicants Paul&Debra Bowen; Architectural Designer—Heidi, Condon, HC Design; Builder—Steve Fabrizio. Public signed in at Public Hearings: Janice Crowley, 392 Jerusalem Rd., Kimberlee Revoir, 13 Haystack Lane. The existing dwelling is to be restored to the original 1840's design which includes the addition of a second and third level as originally existed but were removed in the 1950's. This will result in a 7,040 SF single family residence on this 51,456± SF lot. The proposed footprint is approx. 2500 SF. Building coverage increases from 9.9% to 10.0%±. Lot coverage increases from the existing 20.9%to 21.3 f. Building height increases from the existing 25'± height to 344". All measures conform with zoning requirements. There are no conservation issues and, since there is not a net increase of>500 SF, there are no Stormwater Management issues. Blasting will not be required. The home is currently on septic but will be on sewer as soon as possible. One significant point was Woody Chittick's (ZBA)comment regarding the measurement of the height of the structure as cited above. To be conservative,Heidi Condon measured the midpoint of all roofs and took an average of those measures which she measures as 34.4'. Building Inspector Egan agrees with Ms. Condon's measurement. Since the dormers are not full shed dormers,Egan does not think they increase the height. However, Egan felt this should be further discussed with Chittick until all parties are satisfied with the measurement approach. Condon agreed and indicated that if the measurement approach has to be changed, it will not change the roof design as she will redesign the dormers so they do not impact the height measurement. Comments forwarded by other boards are on file in the Planning Board Office. Abutter comments included: Janice Crowley, 392 Jerusalem Rd.,the closest abutter to the property,noted that the applicants have been very conscientious about speaking with all the neighbors and that they have done a very good job of working with landscaping to mitigate the massing of the home. She does not have any problems with these plans. Kimberlee Revoir, 13 Haystack Lane, noted that the home will be nestled among a lot of trees which will contribute to shielding it from other properties. She also does not have any issues with these plans. Chartis and Ned Tebbetts, 9 Jerusalem Road Drive, (via a March 5,2009 email which was submitted to the Planning Board for the files) noted how much construction and"activity"has gone on in the area over the past Planning Board Meeting APPROVED MINUTES 2 of 2 March 9,2009 several years and requested: that the workday, including deliveries,not begin before 7 a.m. and not go past 5 p.m.; that a little peace and quiet on Saturday and Sunday would be appreciated; and,that there be a limit on the number of delivery vehicles carrying large/heavy loads that arrive at the beginning of the work day . MOTION: by Member Samuelson to recommend that the Building Inspector issue building permits for this Large Home project at 11 Jerusalem Road Drive,subject to: 1. A resolution of Woody Chittick's concerns about the height measurement. The Planning Board would like a report indicating how the height concerns have been resolved. 2. The applicant comply with the comments and requirements of other Boards including the Water Department and Board of Health comments which are on file in the Planning Board Office and were forwarded to the applicant and, agents for the applicant. 3. The applicant should adhere to the commonly recognized practices for construction work hours: 7 AM to dusk and, no construction work should take place on Sundays or legal holidays. 4. The applicant is encouraged to continued dialogue with neighbors throughout the course of this construction project. SECOND: Member Brewer VOTE: 3 - 0 MOTION CARRIES 7:30 P.M. PUBLIC HEARING, ZONING BYLAW AMENDMENT—INCLUSIONARY ZONING - ARTICLE WITHDRA WN—HEARING CANCELLED 7:30 P.M. ADMINISTRATION • VOTE TO APPROVE FEBRUARY 23,2009 MINUTES MOTION: by Member Samuelson to approve the February 23, 2009 minutes SECOND: Member Brewer VOTE: 3 - 0 MOTION CARRIES • SET APRIL MEETING DATES- Board wants to move meetings back to Wednesdays beginning in April after Mike Westcott's term ends. April meetings : April 8 and April 22. • SIGN"CERTIFIED LIST OF PLANNING BOARD AUTHORIZATIONS" FOR REGISTRY OF DEEDS MOTION: by Member Samuelson to sign "Certified List of Authorizations"indicating Al Moore as authorized signature. SECOND: Member Brewer VOTE: 3 - 0 MOTION CARRIES LSHORT DISCUSSION—SUBDIVISION RULES &REGS.AND SMART GROWTH—Member Brewer d mentioned including"Smart Growth" in the update of the Subdivision Rules &Regulations. Modzelewski indicated this would change the estimate he provided for this update,which is now before the Advisory Committee for review. Board thinks we should continue with the General Article for the Subdivision Rules&Regulations update as we need to investigate the"Smart Growth"component further. • OTHER BUSINESS/COMMENTS - New home on corner of Beechwood St. and Rt. 3A—looks very good, definite improvement Dumpsters at Discovery Museum to be removed as soon as contractor can come to remove them 226 CJC Hwy. also looking even better than expected - Member Brewer presented the Suburban Mobility and bike rack information to the BOS at recent meeting MOTION: by Member Brewer to adjourn at 8:30 P.M.
