Office Business: • Next Board of Health Meeting—June 5, 2012 • Office Business Update • Medicare Fund Discussion with Mary Goodwin -- All future money to go into general fund_ Milanoski stated that $15,000.00 will go into budget. Will be supplemented if needed. Little Harbor Sewer Connection and Enforcement-Update with Sewer Commissioner Br an Baldwin and Town Manager Mike Milanoski Discussion about raising fine for disobeying order from $100 to $300 per day. Board determined not to raise fee at this time but will revisit at June meeting. Sewer has raised their connection fee. Group to meet with AG soon. All must be connected by July 1, 2012. Having a contract is not satisfactory at this time. Chapman was worried about Town Counsel and enforcement. Not much response for 247 Forest Avenue. Those living in the barn at 13 Haystack Lane must connect barn by July 1, 2012. Board will send notification. 799 C C Highway Septic System Repair,Phil S ath P.E. Abutters list in order. The Board of Health granted three local upgrade variances and approved a plan to upgrade a failed septic serving an existing facility containing five bedrooms and 1675 square feet of office space for total flow of 676 gallons per day. The plan which was approved consists of three (3) sheets and is described below: Title: Sewage Disposal System Repair Location: 799 Chief Justice Cushing Highway, Cohasset Designer: Phillip H. Spath, P.E. #29304 Date: March 29, 2012 Estates of Cohasset Definitive Subdivision Plan Toll Brothers Board approved plan without conditions 2-0. Email: boh@townofcohasset.org New Business: • Beach Sampling Discussion — Tradd to put together letter to Beach owners including cost which should include enough money for the sample taken to sample Black Rock Beach, the only town— owned beach. Invite beach operators to meeting if they want to discuss anything. • Landfill Monitoring Budget Discussion—This was removed from the BOH FY 2013 Budget. • Little Harbor Sewer Connections Concerns / Loan Program Criteria — Board agreed that any money for those loans should come from the Town. Money should not come from. the State Loan Program because Board promised Advisory Committee that the program would have minimal cost for the Town. • Cohasset Housing Authority Tobacco Control Update — There is no money for a cessation program. Board should see if Medicare would cover any of the costs. The Nursing Gift Fund Haight be able to offer scholarships for those in financial need. Smokers should bear the majority of the cost of the program. • Local Upgrade Approval Notification from DEP Discussion — At the present time the Board will not snake any changes to the regulation regarding the type of notification required for local upgrades. If the Board proposes some other regulatory changes, this could be included. • 379 Atlantic Avenue, Sewer Connection — Send out letter to remind the property owner that at this time everyone must be connected by July 1, 2012. • 381 Jerusalem Road, Sewer Connection - Send out letter to remind the property owner that at this time everyone must be connected by July 1, 2012. • Amendment to the Supplement Rules and Regulations to Title 5 Discussion — Board is looking for more guidance from DEP. Board needs more information regarding empty lots. These lots are in the watershed but not included in the Judgment. Dan Coughlin believes these empty lots could be built on. Board and staff members present are listed above. Sewer Connection Update Seventy-three percent(73%) of homes are connected. Twent-seven percent(27%)were not connected. Three (3)homes have done nothing. Discussion about allowing a loan for a person with tax liens on the property. The Board has the -_"-.uthority to allow this loan. Motion to allow this loan to a person with tax liens. Carried 3-0 Milanoski recommended going forward with fines. RML moved to start the fine process of the three properties who have done nothing toward connecting, with agent to initiate fines using the ticketing bylaw. Carried 3-0 203 South Main Street—Septic upgrade with local upgrade approvals Plan presented by Darren Grady,PE, with discussion following. Board voted to grant the local upgrade approvals for 310 CMR 15.405(l)(b). Reduce the setback between the SAS and the cellar wall and increase the maximum cover on the SAS up to a maximum of seventy-two(72)inches to keep the existing grade. System is vented. Depth of the SAS hole##2 to be verified at time of construction. Carried 3-0. Motion to approve the plan with las revision of July 9, 2012. Carried 3-0. 247 Forest Ave Discussion Tenant moved in when house was condemned. Discussion resulted in Board having agent set up conference call with Milanoski Zemel, Godzik and Atty. Sallant to see how we should progress. Also determine how the Homestead Act is involved with this issue. New Inspector/Health Administrator Selection made to have Felix Zemel. Milanoski is negotiating hiring. BOH Minutes 07/12/2012 Page 1 of 2 Solar Array The Alternative Energy Committee has proposed placing solar panels on the roof of the middle-high school and at the Cedar Street Landfill. Project should be amortized over twenty (20) years. Sampling Agreement for Beach Associations The MA Department of Public Health is only paying for sampling at public beaches. Sandy Beach and Bassing Beach are not public beaches. An agreement to sample these beaches by the Board of Health for the Sandy Beach Association and the Cohasset Conservation Trust needs to be drawn up. Fee will be $50.00 per week to include laboratory costs_ Cohasset Water,Department Water quality issues. Board discussed possibly lowering Fluoride concentration to 0.7 mg/L, as recommended by USEPA. Also noted the low concentration of chloride ion in the distribution system. There is no standard,but MassDEP recommends no less than 0.2 mg/L. (DA) The meeting was called to order at 7:32 PM with MSC and RML in attendance. Also present were I~IZ and JRG. FIZ left the meeting due to a personal problem at approximately 7:45 PM. HEALTH ADMMISTRATOR/INSPECTOR REPORT • Lido Juice Bar bas been opened and permitted « Sushi Avenue at Shaw's is open,with a new manager in place just one(1)week after opening. • Cohasset Candy Company had been operating without a permit,but an inspection has now been performed and they have applied for a Permit to Operate a Food Service Establishment. • Brisa Tapas and Wine at the Cohasset Harbor Inn has been operating without a permit all summer. They were issued an order to apply for the appropriate permit,and did not comply with said order. A non-criminal disposition citation was issued for$100 for failure to comply with a BOH order. They have requested another copy of the application. • The swimming pool at Scituate Racquet and Fitness has been issued a Permit to Operate a Swimming Pool. They will be in later this evening to discuss a request regarding their lifeguard situation. • Commented that the Board of Health currently has a non-criminal disposition regulation,and associated fine schedule, in place,and that further discussion is not required at this time. If changes must be made,they will be addressed by the Board of Health,as needed,in compliance with State laws. NEXT MEETING DATE The next meeting was set for October 4,2012 at 7:00 PM. Meeting Minutes of the Cohasset Beard of Health—September 11,2012 Public Hearing Page 1 of 4 SEWER ODOR COMPLAINTS UPDATE PIZ reported that the Sewer Commission has indicated a goal of solving the odor problems prior to March 31,201 ,as previously discussed. No new complaints have been received,as of the time of inspection. 48 OLD COACH ROAD—Septic System Upgrade/Plan Review(Cavanaro Consulting) The applicant, DS,was present and represented by BS. The Board of Health approved a Local Upgrade Request to 310 CMR 15.405(1)(a)to reduce the setback to the property line from the SAS from 10 feet to 5 feet in a unanimous vote. The Board of Health approved the use of the proposed Hoot I/A system to reduce the size of the SAS by 50%and to reduce the required separation to groundwater from four(4)feet to two(2) feet. The Board of Health unanimously approved the submitted plan,with the last revision date of September 11,2012. 15 LAMBERT'S LANE-Septic System[. yade/Plan Review rady Consulting The applicant was represented by RG. This application was continued until October 9,2012 at 7:30 PM because the applicant was missing documentation from Hoot regarding the efficacy of the proposed VA technology with regards to nitrogen reduction capabilities. 85 LINDEN DRIVE—New On-Site Wastewater Treatment S stem Plan Review(Morse En 'neeriu The applicant,MC,was present,but was represented by JH. A letter from the Cohasset Sewer Commission,dated September 11,2012,was submitted. The letter was entitled"re: Sewer Connection for 81 Linden Drive,Parcel IDs: 11-044& 11-045,"and entered into the record. Since this letter indicated that there would be at least a twenty-four(24)month wait for a sewer connection to become available,the Board decided that connection to the municipal sanitary sewer was not feasible. JH presented the application,with a plan last revision date of August 7,2012. The Board of Health unanimously approved the submitted plan. COHASSET BOARD OF HEALTH SUPPLEMENTAL RULES AND REGULATIONS TO 310 CmR 15.000 UPDATE &DISCUSSION The Board of Health reviewed each section of the proposed revised regulation and made changes,which they deemed appropriate. Participating in the discussion were PS,BS and MM. The changes will be incorporated into a new dxaft of the final proposed regulation,which will be further discussed,and possibly adopted,during the public hearing on September 17,2012 at 7:00 PM. SCITUATE RACMT AND FITNESS POOL—Lifeguard Discussion The applicant was represented by CH,President. Meeting Minutes of the Cohasset Board of Health--September 11,2012 Public Hearing Page 2 of 4 The Board of Health reviewed a proposal by CH,and discussed questions regarding the proposal. Per CH,all swimming instructors are certified as lifeguards,and he will not permit any birthday parties or other parties where large numbers of children will be present,without having a certified lifeguard present. The Board of Health unanimously voted to permit Scituate Racquet and Fitness Club to operate the swimming pool without any lifeguards from zero(0)to twenty(20)swimmers and/or bathers,and will require at least one(1)lifeguard to be present at the swim ruing pool for every twenty(20)swinuners and/or bathers that may be using the pool thereafter, pursuant to the request by CH. PROPOSED C BASSET BOARD OF HEALTH NON-CRDIINAL DISPOSITION REGULATION This regulation is in place,and will stand as currently promulgated. BEALTH NOTES DISCUSSION Tabled until the October 9,2012 Public Meeting. 247 FOREST AVENUE UPDATE DA indicated that new tenants moved in on September 10,2012. The Board of Health directed that FIZ talk to the new occupants as soon as possible,and explain the tight tank situation to them. 45 PLEASANT STREET'(3PDATE Selectwoman.MG indicated that she goes by the house every day and has seen raccoons in the yard and on the roof The yard is still overgrown with weeds. MM indicated that the Town should be worldng on a"blight"regulation in the future. FLUORIDE REDUCTION DISCUSSION WITH AOUARION A meeting to discuss the possible reduction of Fluoride levels in the Public Water Supply(PWS),in order to comply with CDC/HHS recommendations will be held on September 19,2012 at 7:00 PM in the Hingham Town Hall,in conjunction with the Hull and Hingham Boards of Health. MSC is planning on attending. Because there will be no quorum present at this meeting,it is not a formal Board of Health meeting,and does not need to be posted,pursuant to OML. LITTLE HARBOR SEWMR CONNECTION I OLD COLONY PLANNING COUNCIL UPDATE There was no update from the Sewer Commission. There was a brief discussion about 41 North Main,Street,and their wish to connect after odor issues have been resolved. TOPICS NOT REASONABLY ANTICIPATED BY THE CHAIRPERSON FORTY-EIGHT(48)HOURS PRIOR TO THE MEETING The Board of Health will meet in Joint Session with the Board of Selectmen on October 16,2012 at 7:00 PM in order to discuss and select a replacement for the remainder of Steve Bobo's unexpired term on the Board of Health,following his resignation. AQUARION WATER COMPANY: PUBLIC WATER SUPPLY FLOURIDATION The Board hosted a discussion with members of the Hull Board of Health,the Cohasset Board of Health, and Aquarion Water Co. regarding the issues of public water supply fluoridation. Council On Scientific Affairs",JADA Dee. 1995 Fluoride Ion Concentration in Drinking Water table • Website printout,Heather Senison,LIC/Astoria Journal`Battle Over Fluoride Returns"Apr. 2012 • Website printout, Fox.News.com"Dentists Warn of Excessive Fluoride Intake in Infants"Feb. 2007 • Website printout, partial article, "50 Reasons to Oppose Fluoridation" • Website printout, partial article, "Prestigious Organization Calls for Lowering Fluoride Limits in Tap Water" The Board discussed the following issues: • In 2011,the federal government lowered their public water supply recommended level of fluoride supplementation from a range of 0.7— 1.2 mg11 down to just 0.7mg/l. • Massachusetts has their own recommended range of fluoride supplementation from 0.9— 1.2mg/l. • Aquarion Water Co. currently targets 1.0mg/1 of fluoride supplementation as their policy. • Dr. Barry discussed the risks and benefits of supplemental fluoride. She said the greatest risks are with infant and toddler populations ingesting excessive fluoride because of a child's high fluid intake relative to their small body mass. • Dr. Barry added that supplemental fluoride is pervasive being found in most or health products, especially toothpaste. She mentioned that pediatric care must include advising patients/parents on proper techniques and practices for avoiding excessive fluoride ingestion.This includes not swallowing toothpaste. • Fluoride is reportedly present in most processed foods and beverages whenever water is added as an ingredient including reconstituted powers and liquid concentrates or packaged in water. Hence the concern over powered infant formula. • Dr. Barry believed that public education about this public health issue is certainly needed and something the three Boards of Health may want to include on their respective websites. • A Hull resident attending the meeting said her child was diagnosed by its pediatrician as having dental fluorosis. A dental physician attending the meeting said he has not witnessed dental fluorosis in his own local dental practice. • Hull BoH members said they discussed fluoridation following the new federal 2011 recommendation. They said they have since incorporated information about excessive fluoride into their well baby program. • Cohasset BoH members said they also discussed fluoridation following the 2011 recommendation and subsequently met with their water dept. about changing the supplemental fluoride concentration in Cohasset's municipal water supply. The Cohasset BoH was (erroneously)told by their water dept.that the state mandates fluoride supplementation levels in the Commonwealth and the Cohasset BoH could not impose changes to fluoride levels in Cohasset's municipal water system. • The vast majority of Cohasset residents obtain their drinking water from the Cohasset municipal water system; the Aquarion Water Co. services only about 320 residences in northern Cohasset. • State statute gives local BoHs the legal authority to initiate fluoridation within their community and to adjust upward the level of fluoride supplementation once enacted. The statute also identifies a Town Meeting and local referendum process for the public to stop fluoridation once a BoH has ordered it or seeks to increase it. The statute also requires concurrence from a majority of the health boards if their water supplier services multiple communities. However,the statute is silent on how to adjust"lower"the level of fluoride supplementation. • Dr. Shilts said that the local BoHs are the only entities identified by statute that can order changes to community fluoridation, subject to public redress via the process identified above. He argued that BoHs would never be prohibited from ordering a lower level of fluoride supplementation to better protect the health of the community they are charged to oversee. He added that a water supplier, including Aquarion, has no authority to initiate, alter or cease fluoridation on its own. 2 Hhr hmn&oar d of Health Public.Weeiing Septen7be:r 19. 20.12 + Dr. Shilts suggested that if the Hingham, Hull and Cohasset BoHs each voted to order a"reasonable" lowering of Aquarion's fluoride supplementation, Aquarion would be compelled to act accordingly. Thereafter,the Board asked each Board of Health located in Aquarion's Hingham/Hull District,more specifically the Hull,Cohasset and Hingham Boards of Health,to notify the other two Boards in writing if said Board were to affirmatively vote to have Aquarion Water Co. either raise or lower the level of fluoridation within the Hingham-Hull water district. Furthermore,Mr. Capman was asked to coordinate among the three Boards of Health if any written order from the Hull, Cohasset or Hingham Board of Health were to be received requesting to raise or lower the level of Aquarion's fluoride supplementation; and if unanimity among the three Boards were to occur for a defined action,follow-through with the drafting of a public notice and mutual order on behalf of the three Boards of Health. The Board recessed at 8:20PM The Board reconvened at 8:27PM , SEWAGE DISPOSAL CONSTRUCTION PERMIT VARAINCE REQUEST: 8-10 EVERGREEN ROAD The Board reviewed a request from Suzanne Merle&Leslie Carter for variances from the Hingham Supplemental (septic) Regulations relative to proposed new construction. Shea, including a draft"Notice of Alternative Sewage Disposal System"dated 9/4/12 • Letter from Mr. Gaskell, describing an `Option A' & `Option B' dated 9/8/12 • Updated architectural plans(revised) 7/23/12 The Board discussed the following issues: • The revised proposal is to construct a 3-bedroom dwelling rather than a 4-bedroom. • The revised proposal lowers the height of the retaining wall from 4-5' down to 2-3'. • The revised proposal depicts an approx. 4,600 sq. ft. dwelling on a 38,000 sq. ft. lot. • The revised proposal also moves the proposed dwelling out of the 100' wetland setback. • Both options A&B necessitate variances to VI.9,V1.12(a) &V1.3. • Option A necessitates an additional variance V1.2 regarding a property line encroachment. The draft utility easement document does not appear to give the(infringed) property owner ample safeguard that his property will be returned to existing conditions after any repair to the underlying system. + Option B necessitates an additional variance VI.5 regarding a wetland setback. Any wetland setback would need to obtain Conservation Commission approval. + Mr. White inquired whether the engineering team had thought about a transposition, linking the proposed new dwelling to the existing(rear) septic system area that currently services 8 Evergreen Rd., and connect the residence at 8 Evergreen to the(front) septic system area being proposed.
