COHASSET ZONING BOARD OF APPEALS

Chairman S. Woodworth Chittick called the meeting to order at 7:30 PM. The Chairman introduced the Board members
that were present. Chairman Chittick also recognized that Mr. Lacy,Associate Member,has been on the Zoning Board of
Appeals for over 20 years and will not be renewing his term. Chairman Chittick and the Board thanked Mr.Lacy for his
time with the board and wished him well.

The Board confirmed the next meetings of the Cohasset Zoning Board of Appeals as Tuesday,July 17 and August 7,2018
CONTINUED HEARINGS
SPECIAL PERMIT—Filed by Paul Mirabito of Ross Engineering, on behalf of landowners, Marvell
Homes, LLC. Special Permit per sections 0.7 0.6 and any relief the Board deems appropriate.
Applicants, seeks to raze and reconstruct the dwelling at 23 Border Street. File#18.04.03.

This is a continued hearing. The application was filed by Paul Mirabito of Ross Engineering,on behalf of the landowners,
Marvell Homes. Per the discussion at the previous hearing,many revisions have been made to the plans. Mr. Mirabito
presented the revised plans showing the existing and the proposed house to the board. The plans now show more clearly
the existing and proposed dwelling utilizing different colors for each. The applicant has also lowered the height of the
proposed house. The proposed height is now 17.5 ft. measured from the average grade up to the mid-point of the ridge.
This is 3.5 feet higher than the existing house.
The applicants also addressed the neighbor's concerns regarding the drainage. They will be installing a drain pipe from
the roof that will come down the sides of the house and go underground and into a catch basin. The applicant has been
given permission from Department of Public Works to tie into the catch basin that is located in front of the property. In
addition,pervious pavers will absorb the water coming down from the rear of the property, and grass swells will help take
any excess water out to the street. The applicant will file for a Storm Water review with the Conservation Commission.

Chairman Chittick asked if anyone in the audience wished to speak. Marleen Winn, of 25 Border Street, an abutter has
concerns with the elevation of the house. She is concerned about her privacy,natural light, and air flow. She stated that
there is only 9ft. 4"between the two houses. Mr. Hugh Kelly, of 15 Border Street, asked how much higher the building
would be in the back. The applicant reviewed the heights. Attorney Kathleen O'Donnell,representing the Karoffs and
the Andelas, abutters to the parcel, asked additional questions regarding the height and if it included the fill, or is from the
preexisting grade. Chairman Chittick and Mr. Lacy both answered that is always the pre-construction grade. Mrs.
O'Donnell would like the special permit to contain conditions about the water runoff and any screening that is there
should be maintained if the plans are approved. Pam Kelly,of 15 Border Street, an abutter, stated that the building is a
non-conforming structure on so many levels and it still will be non-conforming all the way around. The height is going to
change the complexion of the neighborhood.
Chairman Chittick stated that the board still has to go over the plans themselves and deliberate.
