7:34 PM-APPEAL—Filed by John and Adrienne MacCarthy of 85 Doane Street of the Building Inspector's Denial of
Enforcement at 90 Doane Street(landowners Andrew D. and Linda W.Ash). File#15.10.01.

Materials for this agenda item: Draft on a Decision on behalf of the Zoning Board of Appeals from Mr. Chittick
Mr. Chittick's drafted decision state that the appeal, based on the findings in file#15-10-01, appealing the Building
Commissioner's decision not to take action is allowed and the Building Commissioner is instructed to place a cease-
and-desist order against the current use of 90 Doane Street as a multi-family dwelling until and unless Special
Permits can be obtained from the Zoning Board and Board of Health.

8:03 PM—APPEAL—Filed by Stephen W. Rider, Esquire, on behalf of his client, David F. Crowley-Buck, Trustee of
the Crowley Family Qualified Residential Trust(Janice Crowley representing), of 392 Jerusalem Road,of the
Building Inspector's Notice of Cease and Desist dated June 15, 2015. File#15.07.13.
In attendance for this agenda item: Richard Henderson,Attorney for 392 Jerusalem Road
Originally the neighbors of 392 Jerusalem Road appealed Mr. Egan's failure to enforce i.e.to require the light posts
be removed at 392 Jerusalem Road. The Zoning Board of Appeals(ZBA)decided there were zoning violations and
this decision has been appealed. If the neighbors want to withdraw their appeal to this board, it is too late,since it's
gone to court. If the court remands the case, 392 Jerusalem Road would have to design a new light plan with
consideration of height and location that satisfies the bi-law. Mr. Henderson will send the ZBA an extension to at the
time with which it must make and file its decision of this appeal until June 30, 2016.

8:20 PM—SPECIAL PERMIT—Filed by Cavanaro Consulting on behalf of clients, Julie and Joseph Guerra, seeks to
change grade and build an addition in the floodplain at 81 Elm Street. File#16.01.06.
Mr.Chittick recused himself from this hearing.

DECISION: By unanimous vote of Goedecke, Lacy, and Higginson the Zoning Board approved the granting of a
special permit under Section 9.7 subject to the following conditions:
1. The project will be constructed in accordance with the submitted site plan and construction drawings
and other documents presented at the hearings.

2. The construction will conform to all Federal, State, and Municipal requirements and all applicable
stipulations and recommendations of other Boards and Agencies having jurisdiction over the project.
3. Two sets of as-built plans shall be submitted to the Building Department for its approval prior to the
issuance of an Occupancy Permit.Any changes other than minor field changes must also be submitted
to the Zoning Board to ensure compliance with this decision.
