7:00 PM—Chairman S.Woodworth Chittick called the meeting to order.
Chairman S.Woodworth Chittick declared: As the Chair of the Zoning Board of Appeals, I declare that an open
meeting may have a detrimental effect on the litigation position of the Board with respect to:
392 Jerusalem Road—Consideration of litigation matters regarding David F. Crowley-Buck,Trustee of the
Crowley Family Qualified Personal Residence Trust,et al.v.Town of Cohasset,et al., Land Court C.A.#15

1 move that the Zoning Board of Appeals enter into executive session to discuss strategy with respect to litigation
where an open meeting may have a detrimental effect on the Town's litigation position, and the Chair has so
declared, pursuant to section 21 (a)(3)of chapter 30A of the General Laws with respect to:
The appeal of the Board's decision regarding 392 Jerusalem Road and the above-referenced litigation.
Chairman Chittick: "I need a Second and a Roll-call Vote."
Member Ben Lacy: "The motion is seconded by Ben Lacy."
Chairman Chittick: "Having a Second,we will now have a Roll-call vote."
Member Charles Higginson: "Aye."
Chairman Chittick: "Aye."
Member Benjamin Lacy: "Aye."
Chairman Chittick stated: Having passed by a vote of 3 to 0,the Open Session is now closed, and we will be
reconvening the Open Session.We are now in Executive Session.
Chairman Chittick banged the gavel and Zoning Administrator closed the door.
***EXECUTIVE SESSION***
Attorney Kimberly Saillant discussed the next steps of the appeal at 392 Jerusalem Road. Judge Scheier hasn't
made a decision on the filing submitted by Attorney Stephen W. Rider on January 20, 2016 and we don't know what
was submitted. Ms. Saillant is waiting for Protective Order from Judge Scheier.
Chairman Chittick moved to come out of executive session. Mr. Lacy seconded the motion:
Chairman Chittick: "I need a Second and a Roll-call Vote."
Member Ben Lacy: "The motion is seconded by Ben Lacy."
Chairman Chittick: "Having a Second,we will now have a Roll-call vote."
Member Charles Higginson: "Aye."
