Woodworth Chittick, Chairman Peter Goedecke Charles Higginson Benjamin Lacy David McMorris Member Absent: Jennifer Schultz Others Present: Jennifer Brennan Oram, Assistant Clerk, ZBA Meeting held in the Board of Selectmen's Meeting Room, 41 Highland Avenue, Cohasset, MA 02025 Chairman Chittick opened the meeting at 7:30PM. NEW HEARING APPEAL—Filed by Stephen W. Rider, Esquire, on behalf of his client, David F. Crowley-Buck,Trustee of the Crowley Family Qualified Residential Trust(Janice Crowley representing) ,of 392 Jerusalem Road, of the Building Inspector's Notice of Cease and Desist dated June 15, 2015, File#15.07.13. The applicant has requested that this hearing be continued until October 5, 2015. Chairman Chittick moved to open the hearing and continue it to Monday, October 5,2015. Mr. Peter Goedecke seconded the motion and the vote was unanimous. BOARD BUSINESS Wilmarc Charles—Request for extension of Comprehensive Permit for 25 Ripley Road— Mr. Charles did not attend the meeting. The Board discussed Mr. Charles' request to extend another year so he could wait until his loan modification is finalized. After a lengthy discussion, the Board asked that Mr. Charles submit his loan documents to the Board prior to the next meeting. Chairman Chittick moved to extend the Comprehensive Permit to October 5, 2015. Mr. Lacy seconded the motion and the vote was unanimous. CLE Engineering—Sign Chapter 91 License Form for Yacht Club—After some discussion, Mr. David McMorris signed the form. The Board agreed that the next meeting would be October 5, 2015. Minutes—Mr. Goedecke moved to approve the minutes of July 16, 2015 as amended. Mr. Lacy seconded the motion and the vote was unanimous. Mr. Lacy moved to approve the minutes of August 3, 2015 as amended. Mr. Goedecke seconded the motion and the vote was unanimous. ZBA—9.9.15-J BO 1 Minutes—Zoning Board of Appeals September 9, 2015 NEW HEARINGS Filed by Cavanaro Consulting,on behalf of their client,John P. McNulty to construct an addition to the existing garage in the Flood Plain and within the side yard setback at 468 Chief Justice Cushing Highway. §§9.6&8.7.2. File#15.07.24 Chairman Chittick opened the hearing. Mr.John Cavanaro of Cavanaro Consulting addressed the Board on behalf of his client, Mr.John P. McNulty. Mr. Cavanaro reviewed the lot which is 6.5 acres and has 433 feet of frontage. Mr. McNulty is a car collector. The addition is being proposed to the easterly side of the existing garage. Mr. McNulty's son does wood working and the addition would be used mostly for that. Mr. Cavanaro explained that they are before the Board because the addition falls within the flood plain. He stated that there is no flooding on the site and that everything flows south. There is drainage on Route 3A(Chief Justice Cushing Highway). They also have their own septic system. They have gone before the Conservation Commission and have received an Order of Conditions. The Commission was concerned with the amount of paving in the 50 foot buffer zone, so they are removing 2 percent of it. The rest of the coverage requirements they are well under due to the size of the lot. The new structure will be flood compliant with two smart vents in the front of the structure and two in the back. There was then a lengthy discussion regarding what they would use for the calculation for the ground area. Chairman Chittick stated that he felt the application would fall under§9.7.8 and that the entire ground area of the poured concrete floor would be used for the calculation. After further discussion, Chairman Chittick moved to continue the hearing. Mr. Lacy seconded the motion and the vote was unanimous. SPECIAL PERMIT—Filed by Pamela and David Maltz to construct a new detached garage that will replace the existing non-conforming detached garage at 183 Jerusalem Road. §8.7 File#15.08.07. Attorney for the applicants, Richard Henderson asked the Board to continue the hearing until October 5t". He stated there would be changes to the site plan and they wanted to amend the application and include §9. Mr. Goedecke moved to open the hearing and continue it to October 5, 2015. Mr. McMorris seconded the motion and the vote was unanimous. DELIBERATIONS SPECIAL PERMIT—Filed by John Cavanaro on behalf of his clients,Jennifer R.Schultz and Andrew C. Reed,for an addition within the Flood Plain and an addition within the side yards at 50 Stockbridge Street. §§9.11&8.7.2. File#15.05.13. Mr. Lacy recused himself from this deliberation. Chairman Chittick asked Mr. McMorris to review his draft decision. After a lengthy discussion, Chairman Chittick asked that the Board hold on voting until the end of the meeting so he could think about his vote. ZBA—9.9.15-JBO 2 Minutes—Zoning Board of Appeals September 9, 2015 Mr. Lacy returned to the meeting. SPECIAL PERMIT—Filed by Eric& Emily Davis,for a second story addition over the existing footprint at 75 Ripley Road. §§12.4&8.7.2. File#15.06.11. After a brief discussion, Mr. McMorris moved to approve the decision granting the relief sought under §8.7.2. Mr. Lacy seconded the motion and the vote was unanimous (Chairman Chittick, Mr. Goedecke and Mr. McMorris voting). SPECIAL PERMIT—Filed by Cavanaro Consulting on behalf of their clients Lucki Real Estate, LLC, seeks to raze and reconstruct a single family dwelling at 46 Stockbridge Street. §§8.7&9.11. File #15.06.15a. After some discussion, Mr. Goedecke moved to approve the decision granting the relief sought under §8.7.2. Mr. Lacy seconded the motion,and the vote was unanimous (Chairman Chittick, Mr. Goedecke and Mr. McMorris voting). SPECIAL PERMIT—Filed by John Cavanaro on behalf of his clients,Jennifer R. Mr. Goedecke seconded the motion, and the vote was unanimous (Chairman Chittick, Mr. Goedecke and Mr. McMorris). Chairman Chittick moved to adjourn the meeting. Mr. Lacy seconded the motion and the vote was unanimous. Meeting adjourned at 10:15PM.
