Meeting held in the Board of Selectmen's Office,Town Hall.
Chairman S. Woodworth Chittick called the meeting to order at 7:36PM.
Zoning Board Business
Minutes—Mr. Peter Goedecke moved to approve the minutes of May 5, 2014 as amended. Mr.
Benjamin Lacy seconded the motion and the vote was unanimous.
The Board agreed to meet on Monday, July 7, 2014.
DELIBERATIONS
APPEAL—Filed by Attorney Richard Henderson on behalf of his clients Richard Cate and Barbara
Wallner of 40B Nichols Road,to appeal the Building Inspector's denial of enforcement action at 42
Nichols Road (landowners Winthrop G. and Constance G. Minot). File#14.02.19. Closed.
Mr. Goedecke recused himself and left the room. Mr. Charles Higginson read the definition of structure
from the Zoning Bylaws aloud. After a lengthy discussion, the Board agreed that the appeal should be
denied. They reviewed a draft decision from Mr. Higginson and made several edits. After further
discussion, Mr. Lacy moved to deny the appeal. Chairman Chittick seconded the motion and the vote
was unanimous(Chairman Chittick, Mr. Higginson and Mr. McMorris voting).
SPECIAL PERMIT—Filed by Can Tiryaki of Tiryaki Architectural Design, on behalf of landowners,
Elizabeth and Will Kirkpatrick, seeks to construct a two story addition that would extend the non-
conformity on the East side of 48 Smith Place. §8.7.2. File#14.04.04.
Chairman Chittick recused himself and left the room. Mr. Goedecke stated that in reviewing the
application, the relief being sought is not the "slam dunk" he thought it was. Although a small addition
is being proposed, it is nearly doubling the massing in the back. However, overall, he does not feel what
is being proposed is more detrimental to the neighborhood. Mr. Goedecke stated that in reviewing the
plans, he now questions if the area even needs relief or if the plans have incorrect calculations. The
hearing is now closed, so this cannot be addressed. After further discussion,the Board agreed to
continue the deliberation to the next hearing. Mr. Goedecke moved to continue the deliberation to
July 7, 2014. Mr. Lacy seconded the motion and the vote was unanimous.

Other Business
25 Ripley Road—The Board discussed the request from Mr. Wilmarc Charles to extend the existing
Comprehensive Permit. After a brief discussion, Chairman Chittick moved to extend the expiration
date by one year. Mr. Charles will have to come in prior to that expiration and update the Board. If at
that time he wishes another extension, he can request so from the Board. Mr. Goedecke seconded
the motion and the vote was unanimous.
Dock Application—The Board reviewed the newly proposed dock application. It will be sent to counsel
for approval.
Chairman Chittick moved to adjourn the meeting. Mr. Goedecke seconded the motion and the vote
was unanimous. Meeting adjourned at 10:30PM.
