Continued Public Hearing for 179 Atlantic Avenue Large Home Review, filed by Edward Johnson of K&
E Construction Corp.

The Board received a copy of a clarification letter that was given to Bob Egan,Building Inspector,regarding the
square footage dated July 30, 2019; the letter was added to the file. Mr. Johnson reviewed the changes to the
plans. Exterior elevations details such as returns, trim, moldings, porch details, and columns were added to the
plan. Back elevation changes were made on the plan to the fire place, deck, and the skirt boards. Two water
tables were added. Mr. Johnson spoke with the neighbor to the rear of the dwelling and they had no objections
with the revised plans. Chairman Brewer recommended getting a letter from the neighbor for the hearing
process. Chairman Brewer would like a light fixture cut sheet and an updated landscape plan with screening
incorporated into the back of the property.
MOTION: By Brian Frazier to continue the public hearing until September 18, 2019 at 7:00 P.M.

Mr. Cavanaro reviewed the site plans to the Board. 63 Nichols Road is a 6 1/2 acre site that fronts little harbor
with a long driveway that goes over a causeway and a salt marsh area. Existing property is about 7600
residential gross floor area consisting of a main dwelling, attached 3 car detached garage that sits at a skew, a
detached carriage house, a pool, and a patio area. The property has town water and town sewer. An existing
cistern will collect rain water from the roof and be used for irrigation. The applicant is proposing to move the
garage, attached it to the house in a 90 degree fashion, and replace detached garage with a smaller detached
structure. The Conservation Commission has reviewed the plans for an order of conditions and a storm water
permit. There is a slight increase in the impervious surface. Cavanaro Consulting has mitigated the increase with
some storm water management and storm water infrastructure with infiltration chambers. Also a grass swale and
a small rain garden depression downstream was added. The Pool area is getting reworked to be closer to the
house. A professional landscape design was also included in the order of conditions. Mike Tartamella, of Patrick
Ahearn Architect, stated the house was originally built in 1906 with some renovations in the 1990's. Mr.
Tartamella is proposing to remain consistent with the house and bring it back to its original 1906 sensibility and
to freshen it up. Chairman Brewer would like light fixture cuts to be added to the plans. Lauren Masiar
mentioned the home currently has two equivalent dwelling units (EDU). One EDU is assigned to the barn, an
accessory dwelling. The second EDU is assigned to the main home. The EDU assigned to the home is for a four-
bedroom structure. If the applicant wants a five-bedroom structure the owner will have to purchase additional
sewer capacity.
MOTION: By Member Glasmeier based on the presentation the Board recommends this be approved
subject to the receipt of the information regarding the lights

Applicant is proposing to convert an existing barn into a single detached family home. Mr. Sullivan has been
through Conservation with this project and has an order of conditions. The Zoning Board (ZBA) hearing was
continued to September 1st due to a few minor changes the Board is requesting. The building has been relocated
to be more conforming to the rear yard setback. There will be one parking space the other proposed spaces were
eliminated from the plan. The structure in front of the barn is outside the flood plain and the new structure will
be inside the flood plan. There is a sewer easement,most of the sewer from the downtown area goes through the
property and then goes to the Sewer Treatment Plant. Sewer connection for the dwelling has been approved. Mr.
Brennan of Amory Engineering, peer review Engineer, mentioned an easement will be needed for the
underground wiring. Abutters have concerns with the barn already being non-conforming and becoming more
non-conforming, abutters would like square footage calculations. The board is requesting a facade calculation
and to add screening along the property line.
MOTION: By Member Frazier moves to continue the public hearing so the applicant can follow up
with the requested facade calculation, easement,and the Board would like the applicant to
review plans with the abutters before the next meeting on September 18,2019 at 7:15.

Jon Tiryaki reviewed the revised plans to the board. Instead of utilizing the shared driveway easement the
applicant is proposing a new curb cut on Windy Hill Road. The front portion of the driveway will be pervious
surfaces and the rear portion will be impervious asphalt as part of storm water calculations. The house foot print
will stay the same but, the house massing will be different. The previous house design style was a colonial
structure with 2 full stories with an attic level above. The applicant has eliminated the attic level due to the
Board and abutters concerns with house appearing too tall for the neighborhood. The dwelling will be more of a
cape style house. Mr. Tiryaki took the attic mass and added it to the left side of the house. The total massing has
dropped by 8 feet. The height is significantly lower than the 35 feet height regulation. David Cass, abutter,
appreciates the changes but, still has concerns with water runoff issues. What happens if the infilltration
chambers fail due to being inundated with water and can't keep up with the runoff? Where will the water go?
Attorney Henderson reminded the board that the applicant has already received approval from the other Boards
including Conservation for a Storm Water Permit. The Board agreed to continue the hearing and are requesting a
light cut sheet, an updated landscape plan with a schedule of plantings, and would also like Morse Engineering
to come in to review the Storm Water Permit.

Mr. Dorsay reviewed the plans to the Board. 29 Little Harbor Road is new construction. The applicant is
proposing a 4,949 square foot single family home consisting of 4 bedrooms, 4.5 Baths, and 3 car garage. The
Lot is about 27,000 square feet the house is 18 %of the lot size and 12% of lot coverage. The design style of the
house will be a gambrel to try to keep the height as low as possible. Building height from the mean grade to the
ridge is 31'Y and mid span to rafter is 28'2' which is well below height limits. For circulation purposes the
house is in the middle of the lot within the setbacks with a path from garage to front door. Mr. Flynn explained
there are three existing easements already on property. Two on the north side for Mr. Lanuto's driveway and
landscaping. There is also a 37.5 foot easement on the back of the property to create an additional buffer to a
new home being built at 231 Jerusalem Road. Donna Hayden, abutter, has concerns with the height of the new
home what does the 31 feet include? Mr. Brewer explained the 31 feet is from the top of the ridge to the
preexisting grade it is well below the 35 feet that is allowed. Tom Killilea, an abutter, has concerns with runoff
from the roof causing additional flooding. Bob Sheppard,previous owner of the property, went to conservation
for a storm water permit before selling the property to Mr. Flynn and there is a design plan that has been
approved to help with flooding. Sal Lanuto, an abutter, has concerns with who has reviewed the storm water
plan with the right expertise to know it's an adequate plan?Is there anyone going to monitor the implementation
of the plan? Chairman Brewer explained the Planning Board does the large home review the Board does not get
into flooding its more about how the proposed house will fit on the property. Chairman Brewer recommends the

abutters talk to the conservation commission with their concerns. BB McCarron, an abutter has concerns with
the lighting of the garage and the landscaping. Chairman Brewer recommended Ms. McCarron get together with
the builder to discuss the lighting and landscaping plan.
MOTION: By Brian Frazier to continue the Public Hearing of 29 Little Harbor Road to September
18,2019 at 7:30. The Board is requesting a light fixture cut sheet,landscape design plan, a
staging plan, a cut sheet for the fence, and the Board would like the applicants Engineer to
come to the next planning meeting to review the storm water process.

Planning Board Member Comments:
Member Glasmeier would like Town Counsel to explain the meaning of what is being stated in the harbor plan
so the Board members can understand what is being asked. Planning Director, Lauren Masiar stated it will go to
the Board of Selectmen for approval, not to the Planning Board. There will be a Selectman's meeting on
September 24,2019 that Ms. Masiar encourages the Board members to attend.
Ms. Masiar received a letter from the Attorney General on Monday for a procedurally defect in regard to the
notices that were sent out for the Public Hearing. The article has been put on hold and needs to be advertised in
the paper and publicly posted. There is a 21-day period anyone in town can make an appeal. Once all the
materials is turned in it will be sent back to the attorney General to resume their review of the By Law.
