7:00 P.M. Chairman Brewer called the meeting to order.
390 Chief Justice Cushing Highway—Discussion regarding Site Plan Modification
In attendance to represent this agenda item: Jack O'Leary, SITEC Environmental

The landowner of the property requested a conversation with the Planning Board to discuss the need
for moving the proposed, 60,000 square foot building further back then what had been approved on the
current Site Plan. Chairman Brewer asked Mr. O'Leary how far back they would need to push the
building. Mr. O'Leary stated it would be 30 feet. Chairman Brewer asked why they need to move it
back. Mr. O'Leary said that the major tenant (Stop & Shop)has some questions regarding improving
the turning radius for the tractor trailers making deliveries and moving the building back would allow
for more room for this. Chairman Brewer said that the turning radius for the trucks had been discussed
during the public hearing process.
Mr. O'Leary then reviewed the proposed changes, saying that the landscaping will remain the same
and the retaining wall behind the building will be lower. They will be able to add additional parking in
the front of the building using pervious pavers. They are also in talks with the Cook Estate and expect
a letter of support from them. The big issue they are facing is that they are on a tight time-frame; they
are hoping the Board will look at this as a minor modification. Chairman Brewer said he could see this
being a major modification based on the interest expressed by the Cook Estate at previous hearings.
There was then a discussion regarding the foot path and the vegetation near Feng Shui.
Member Brian Frazier stated that he thought moving the structure 30' back would be a major
modification. He does think adding additional parking is a plus. Chairman Brewer agreed, saying that
calling it minor modification would be a stretch. After further review, it was determined that moving
the retaining wall back would place it in a setback; which is not allowed as it is defined as a structure.
Mr. O'Leary said he would think about how to eliminate the wall from the plans. They will be in
touch regarding coming before the Board again.
