Brewer, Chair (CB) David Drinan,Vice Chair (DD) Brian Frazier, Clerk (BF) Michael Dickey,Liaison to CPC (MD) Erik Potter,Associate Member(EP) Board Members Absent: Charles A. Samuelson(CS) Recording Secretary Present: Jo-Ann M. Pilczak CALLED TO ORDER AT: 7:02 P.M. (DD)—Chaired tonight's meeting. Ask(EP)to participate as voting member. 7:02 P.M. PLANNING BOARD MEMBER UPDATES (MD)—updated Board on CPC requests and funding—spoke about playgrounds and rebuild of town boat ramp (CB) - Master Plan Committee Meeting on March 20—will review Phase I and grant application (DD) -Town Hall Committee kick-off mtg. Created calendar of target dates,meetings with BOS and Stakeholders 7:10 P.M. 827 CJC HWY. — INFORMAL DISCUSSION RE: PLANS TO RENOVATE PROPERTY AND BUILDING INTO A BAR-B-QUE AND TACO SHACK. JOHN KROEGER (BOUND BROOK LLC) & MORSE ENGINEERING. In attendance to represent agenda item: Jeff Hassett,Morse Engineering; John Kroeger. Plan is to open a Bar-b-que & Taco Shack for dine-in, take out and catering. Planning an 11' x 13' (152 sq.ft) addition right away and a second 825 sq.ft. in 2-3 years. Total sq.ft. including the added area is 350 sq.ft. Plan to clean up the outside and have outdoor seating. Seating is limited to 12 due to septic capacity. Ample parking on site. Wanted to know if they can go for building permit now without a site plan review — 152 sq.ft. addition does not trigger site plan review. (BF) advised that they consider the parking circulation on the site even if site plan review is not required. Modzelewski asked if outside seats have been taken into consideration in light of septic. 7:25 P.M. 8 JAMES LANE — REQUEST FOR MINOR MODIFICATION, CONDO DOCS, MASTER DEED In attendance to represent agenda item: Paul Sullivan Materials and documents submitted,utilized at this meeting (On file in Planning Board Office): • CDI 02/01/17 review and comment memo • Layout Plan C3 and Grading Plan C5, prepared by McKenzie Engineering Group, Inc., rev. date: 10/24/16 date stamped: 01/25/17 • Landscape Plan Drawing #6, prepared by Amy Martin Landscape Design, dated: 11/07/16, revision date: unknown, date stamped: 01/25/17 • Roberts 03/10/17 letter re: Modification Comments &Response, date stamped: 03/15/17 • Master Deed, date stamped: 02/27/17 • Declaration of Trust, date stamped: 02/27/17 Town Counsel advised that he has reviewed Condo Docs and Master Deed and both are, in his opinion, fine. Also advised that no vote is needed on these. Sullivan reviewed responses to Modzelewski 02/01/17 review and comment letter. Modzelewski noted: • has not had time to review modification docs as they were just submitted 03/14/17 afternoon—he would like the Planning Board Meeting APPROVED MINUTES 2 of 3 March 15,2017 does 7 days prior to a meeting • also commented that everything is piecemeal and still not clear for the Board to vote on the modifications—asks Sullivan to work on being more cohesive in his submissions • As-Built plans still have not been submitted for what is being done for water dept. and,Board should see these. • House numbers should be coordinated with the plan • May need easement from MBTA MOTION: By Frazier to continue minor modification review to March 22,2017 at 7:20 PM SECOND: Member Dickey VOTE: 5-0 MOTION CARRIES Sullivan indicated he could submit does by Friday,March 17 to give Board and Modzelewski time to review. 7:40 P.M. CONTINUED PUBLIC HEARING—PROPOSED ZONING BYLAW AMENDMENTS FOR THE MAY 1,2017 ANNUAL TOWN MEETING. 7.40 P.M. ARTICLE "T" - AMEND SECTION 2.1 DEFINITIONS — "RESIDENTIAL GROSS FLOOR AREA" - (CS) 03/09/17 updated version - Recommended Changes to Cohasset Zoning By-Laws and Rationale submitted by Village Development Partners, 03/08/17 - ANSI Square Footage—Method for Calculating—Approved June,2013 submitted by Michael Roberts (CS) — author and proponent of article not in attendance to address questions. Board reviewed article and made some edits incorporating ANSI industry standard. MOTION: By Frazier to modify language as discussed SECOND: Member Drinan VOTE: 5-0 MOTION CARRIES Some discussion continued and(MD) proposed new language resulting in an almost total rewrite. MOTION: By Frazier to modify previously agreed upon language SECOND: Member Potter VOTE: 5-0 MOTION CARRIES MOTION: By Brewer to recommend approval at Town Meeting with the modified language SECOND: Member Dickey VOTE: 5-0 MOTION CARRIES 8:25 P.M. ARTICLE#2 AMEND SECTION 5.5 - LARGE HOME REVIEW PROCESS In attendance to represent agenda item: Attorney Tom Callahan Materials and documents submitted,utilized at this meeting (On file in Planning Board Office • Callahan(Citizens for Cohasset's Future) 02/17/17 version, date stamped: 02/21/17 Town Counsel advised that approval with conditions means the conditions are required, not recommended. (MD) felt very strongly that the Planning Board should not lobby to give itself more power in the Large Home Review process — the Town should decide this and the Planning Board should remain neutral. He also has not seen problems with the Large Home Review process and wonders if the proponents are looking at a solution for a problem that does not exist. Building Inspector Egan was concerned about the large number of"shalls" in Section D 1-6. (EP) and(BF)think there are more problems with DI-6 in terms of specific criteria to be examined. ARTICLE#3- AMEND SECTION 5.3.1. TABLE OF AREA REGULATIONS In attendance to represent agenda item: Attorney Tom Callahan Materials and documents submitted,utilized at this meeting (On file in Planning Board Office 0 Callahan(Citizens for Cohasset's Future) 01/19/17 version Planning Board Meeting APPROVED MINUTES 3 of 3 March 15,2017 • Callahan(Citizens for Cohasset's Future) 03/15/17 memo re: Explanation of Proposed Change to table of Area Regulations and Analysis of Impacts in R-A District, date stamped: 03/15/17 • 10 page data chart of R-A District, date stamped: 03/15/17 • 3 page data chart of R-A District, date stamped: 03/15/17 Woody Chittick, ZBA thought this table is very dangerous proposition — will force people to go to ZBA for variance. He also asked Callahan what problem this article is trying to solve. (BF) thinks homeowners should be able to build to the setback. (EP) suggested this article is impacting the wrong target group. ARTICLED: AMEND SECTION 11 - REGULATIONS GOVERNING EARTH REMOVAL Board suggested that enforcement mechanisms be added and that the article should quantify how much can be cut down—for example, 10%of the trees on the lot. Member Brewer and maybe Member Drinan to attend March 22, 2017 Advisory Committee meeting to review the articles for the May 1 Annual Town Meeting warrant.
