(DD)—Town Hall design interviews cancelled twice due to weather— rescheduled for design candidate selection.
(CB) - Master Plan Committee meeting scheduled for next week
7:05 P.M. SCITUATE HILL COMMERCIAL SUBDIVISION — UPDATE ON TRI-PARTY
EXTENSION - Attorney Henderson attended to request postponement of this agenda item to the March 8, 2017
meeting at request of applicant. Board agreed.
7:20 P.M. PUBLIC COMMENT
Wayne Sawchuk, 432 Beechwood St.: Merrill Diamond no longer involved with So. Main project. Now plans to
construct a single, detached building behind Bates building. Is currently seeking permission from the BOS to move
the brook that is on his property. Will be coming in with a Site Plan.

7:30 P.M. PUBLIC HEARING—PROPOSED ZONING BYLAW AMENDMENTS FOR THE MAY 1,
2017 ANNUAL TOWN MEETING. (BF) read notice of public hearing.
• ARTICLE"T" AMEND SECTION 2.1 DEFINITIONS—"RESIDENTIAL GROSS FLOOR AREA"
After discussion, (CS) as author of article, will rework for next meeting. Discussion to continue to next meeting.
• ARTICLE "V" AMEND SECTION 9.7.8.b - SPECIAL PERMITS USES IN THE FLOOD PLAIN
AND WATERSHED PROTECTION DISTRICT Represented by Woody Chittick
(MD) suggested editing b to read: "b. If the land is subject to tidal action or adjacent to tidal waters, the
proposed structure or use is not less than ten feet above mean sea level."
MOTION: By Member Frazier to recommend approval at Town Meeting with (MD) recommended
language.

• ARTICLE"W"AMEND SECTION 2.1 DEFINITIONS- "DWELLING UNIT" and "FAMILY"
Dwelling Unit edits to be made: change"residential unit"to"housekeeping unit"
Family edits to be made: change "birth" to "blood, kinship" in two places; at end of point(a), change "or" to
"and/or"; in point(b), add after housekeeping unit- "excluding minor children,"
MOTION: By Member Samuelson to put on warrant and recommend approval at Town Meeting with
the above changes.

• ARTICLE "Y"AMEND SECTION 11—REGULATIONS GOVERNING EARTH REMOVAL
Charles Higginson and Woody Chittick to rework the language. Discussion to continue at upcoming meeting.
• ARTICLE "Z" AMEND SECTION 4.3.14 - INCLUSIONARY ZONING Represented by(CB)
Comments included: too burdensome for developers to pay up front fee before receiving any profit from sales;
may encourage the construction of larger houses; is adding burden to already burdensome development in the
Village Business District with the existing sq.ft. limits on housing. Discussion to continue at next meeting.
• ARTICLE "2" AMEND SECTION 5.3.1. TABLE OF AREA REGULATIONS
Article written and represented by Tom Callahan. On February 15,2017 he submitted a new copy with edits—date
stamped 02/15/17. Not discussed - Continue to upcoming meeting.
• ARTICLE "3"AMEND SECTION 5.5 - LARGE HOME REVIEW PROCESS
Article written and represented by Tom Callahan. On February 15, 2017 he submitted a new copy with edits—date
stamped 02/15/17 and, a copy of Muldoon vd Planning Board of Marblehead also date stamped 02/15/17.
