Chairman Jack Creighton called the meeting to order at 7:00 p.m.

Motion by Patrick Kennedy to approve the minutes of 6/19/14,seconded by Edward Graham and the
vote was unanimous(4-0).
Motion by Patrick Kennedy to approve the minutes of 7/10/14,seconded by Edward Graham and the
vote was unanimous(4-0).
The Commission took a recess until the 7:30 hearing.
7:30 P.M.—70 Whitehead Road—Show Cause Hearin continued
Joseph Yerardi was present on behalf of the property owner. He is an excavator. Paul Shea showed
pictures of the property that were taken in June including the excavation machine. The house above is
under construction. There is no question with Conservation Commission having jurisdiction here as
Treats Pond is visible in the pictures. There is loose sand going into the BVW. Paul Shea informed them
they needed to put in erosion control and they did put in a silt fence. He also issued a Cease and Desist
order. There is well over 5000 square feet of work here which requires an ATF SWP and NOL Mr.
Yerardi confirmed there is no work being done at this time. They have no issue applying for ATF SWP
and NOI as recommended by Paul Shea. He asked if he could build a wall on the property. Chairman

Creighton stated they cannot do anything until they submit plans to Paul Shea and receive a permit from
the Conservation Commission.
7:50 P.M.—559 Jerusalem Road(continued)
Greg Morse from Morse Engineering was present as well as Attorney Charlie Humphreys and Chris Ford.
Mr. Humphreys requested a continuance of the hearing. There are 4 Conservation Commission
members present and some of the members that are absent have been to the past hearings. The
hearing was continued until 9/4/14 at 7:00 p.m.
8:20 P.M.—Cohasset Harbor Dredging Project NOI#14-20
Chairman Creighton read aloud the public hearing notice. Director of Project Management and Planning
Brian Joyce, Harbormaster Lorri Gibbons and USACE Project Manager for Army Corps Craig Martin were
present. Mr.Joyce stated this is a Federal Navigation Project and normally wouldn't require coming
before the Conservation Commission. However, part of the project involves putting sand on the beach
therefore it requires an NOI. The project will run from October through January. Mr. Martin stated the
funding for this project came from Hurricane Sandy funding. He explained the sampling that was done
for the project. They will be using a hydraulic dredge. He spoke of the designated placement area and
the schedule. Justin Pimpare asked if they have answered all of DEP's questions. Mr. Martin stated they
are still negotiating. James Contis of Sandy Beach Association asked if the beach will be closed for 2
months. Mr. Martin stated it will be closed from October 15`h for two months. There was a discussion
about protecting the beach in the event of a nor'easter. Mr.Martin stated they will protect the beach.
This project will not be detrimental to the beach. Douglas McNary of 355 Atlantic Avenue stated he is in
favor of the project but has a concern with the impact to his property. He stated the property lines are
wrong and he owns part of the beach. Chairman Creighton asked Paul Shea to contact Mr. McNary and
discuss. Mr. Martin stated the work will be conducted 24 hours a day 7 days a week. They will follow
MA noise ordinances. Jack Keniley of 46 Black Rock Road stated the Town of Chatham did a similar
project and it is not as disruptive as you think. Mr.Martin explained how the project is supervised.
They will provide an emergency contact list. They have a piping plover plan in place although they are
not there now.
Motion by Patrick Kennedy to close the hearing and issue an Order of Conditions for the harbor
dredging project with the condition of a pre-construction project management plan including a
detailed contact fist for abutters,seconded by Edward Graham and the vote was unanimous(4-0).
8:50 P.M.—589 Jerusalem Road NOI#14-21&5WP#14-24
Chairman Creighton read aloud the public hearing notice. Matt Shannon 24 Avalon Drive;owner of
property was present. Attorney Richard Henderson,John Cavanaro of Cavanaro Consulting and William
Pressley(landscape architect)were also present. Attorney Henderson gave the background to the
commission. The property is currently a 13 unit apartment house. The proposed project is to tear down
the existing building and replace with 3 adjoined single family condominium units. Mr.Cavanaro stated
everything they are proposing will be a positive impact on the property. The lot coverage is being
reduced and Stormwater runoff will be reduced as well. They got a special permit from ZBA. There will
be a reduction in impervious surface. They are reducing the amount of paved surface by 1900 square
feet. There will be over 1000 plants. Paul Shea stated they have a DEP permit number and they had no
comments. This project is overall an improvement from existing conditions. They will need a variance,
order of conditions and SWP. Mr. Pressley provided the commission with a list of the proposed
plantings. He spoke of the existing condition of the site. Mr.Kennedy stated there is a lot of merit to
the project but he would like to have a site visit. He is concerned about the risk during construction if

there is a major weather disruption and would like to be sure there will not be issues with Straits Pond.
The commission will visit the site and continue the hearing until 8/21/14 at 7:30 p.m.
9:10 P.M.—369 Jerusalem Road Nol#14-22
Chairman Creighton read aloud the public hearing notice.John Cavanaro of Cavanaro Consulting and
Sean Papich of Sean Papich Landscape Architecture were present on behalf of the applicant. The
proposed project includes a pool,deck and landscape work. Some of the work is in the 50' buffer zone
to a coastal bank. Some of the patio will be eliminated and they will pull back the lawn. They are
reducing the flow of Stormwater. The pool will retain water which will reduce the flow. Mr.Papich
stated they are proposing 1400 square feet of plantings. He explained the planting plan which includes
coastal tolerant plants. Paul Shea stated it is a good plan. A lot of the replanting is with native species.
This proposal improves the performance of the bank and provides a better flood protection. It is better
than the lawn that is in existence now. The ratio is more than 2:1.
Motion by Patrick Kennedy to close the hearing and issue an order of conditions for proposed
landscaping and pool for 369 Jerusalem Road,seconded by Edward Graham and the vote was
unanimous(4-0).
Motion by Patrick Kennedy to issue a variance for work within the SO'buffer zone for the project at
369 Jerusalem Road,seconded by Edward Graham and the vote was unanimous(4-0).
Motion by Patrick Kennedy to issue a SWP for the project at 369 Jerusalem Road,seconded by Edward
Graham and the vote was unanimous(4-0).
9:20 P.M.—17 Pleasant Street RDA#14-12
Chairman Creighton read aloud the public hearing notice. Greg Morse of Morse Engineering was
present as well as the owner of the property,Melissa Mendenhall. Mr.Morse stated the proposed
project is for an addition to a single family home centrally located on the lot.The addition is at the back
of the house with a deck. They have had Brad Holmes,a wetland scientist,flag a drainage ditch at the
back of the property. Paul Shea stated the project includes work within the 100'buffer zone to an
intermittent stream. They will need a Negative 3 RDA and a SWP. There is no hearing needed for the
SWP.
Motion by Patrick Kennedy to close the hearing and issue a Negative 3 RDA for the project at 17
Pleasant Street,seconded by Edward Graham and the vote was unanimous(4-0).
Motion by Patrick Kennedy to adjourn,seconded by Edward Graham and the vote was unanimous(4-0).
