The applicant is proposing to remove the existing septic system and install a 1500 gallon tank, pump chamber,
d-box, and a leaching field. The components are not in the 100 foot buffer zone to the wetlands but, the retaining
wall will go into the buffer zone by 10 feet. The system failed a Title 5 inspection.
MOTION: Chris MacFarlane moves to close the public hearing and to issue a negative three with a
condition of installing a silt sock in the area between the new construction and the road.

7:19 PM SWP 19-17- 14 Windy Hill Road-Eames Construction — New Construction

Eames Capital Partners, LLC is proposing a new house at 14 Windy Hill Road on a '/ acre vacant lot created in
1967 with a common ownership with the adjacent property at 10 Windy Hill Road. There is an access easement
on the left side of the property. The new house will be centrally located on the property with a foot print of 2200
square feet including a garage. A total of 9 trees will be removed, there will be 16 new plantings and all other
area will be restored as lawn. Runoff from roof will be directed to 3 subsurface drywells that will infiltrate the
water back into the soil. A mulch sock erosion barrier will be in place during construction. Jeff Summers,
Conservation Agent, has concerns with the infiltration chambers being installed due to ledge outcrops on the
property and no test pits were performed. Mallory Cardona-Fox, Andrew Knolton, and Dave Cass, abutters
already have water pooling on their properties and have concerns with additional water once the new house is
built. The Committee members agreed that some changes need to be made to the plans. The hearing will be
continued until August 8, 2019 with revised plans adding test pits, rework the front grading area with the
depression, and add additional trees along the easement area that will help with the stormwater runoff. The
required revised plan have to be submitted by noontime Monday August 5, 2019.
7:52 PM: RDA 19-11-589 Jeruslaem Road-JR Condo Trust-Planting Plan

Todd Breitenstein, Grateful Gardner, promotes native and organic plantings. Grateful Gardner is proposing to
remove trees on top of the bank that were planted within the last few years due to a mitigation order and replace
them with cedars and marsh elder to enhance the property with native landscaping. Mr. Breitenstein
recommends placing rain gardens at the end of the driveway to stop the water from washing out the lawn. The
proposed work is within the 100 foot buffer zone. Invasive species on the property, bitter sweet, and knot weed
would be removed. Mr. Breitenstein would like to remove the locust trees in 4 to 5 feet sections to try to control
them and replace with marsh elders. Mr. Pimpare stated the previous property owner clear cut the property
without the knowledge of the Commission and was ordered to replace the trees that were removed. Mr. Pimpare
and Mr. Eisenhauer will not support complete removal of these trees both agreed if Mr. Breitenstein is serious
about this project revise the plans, break it down to its individual components. Mark trees, define the project, get
approval from Mr. Summers and do it in small sections, then bring it back, and the Commission would consider
going from there. Maria Berndsen, condo owner, apologized to the Commission for the previous property owner
clear cutting the land and questioned what it has to do with the current owners? Ms. Berdsen hired an arborist to
look at the plantings and was told the trees are not healthy and were the wrong type of trees to be planted in that
area. The Commission did agree to let Mr. Brightensein cut down 3 trees that are dead. The hearing will be
continued to August 8, 2019.

Jack O'Leary reviewed the plans to the commission stating the new building and all the work associated with it
originally was located outside the buffer zone, recent events caused the building location to shift due to soft soils.
There will be no work in the 50 foot buffer zone and a slight encroachment into the 100 foot buffer zone as a
result of moving the building over. A fire lane excess will also be added.
MOTION: By Eric Esinehauer to close the discussion and to issue a RDA Negative 2 for the
property located at 380-400 CJC Highway project.

John Cavanaro reviewed the site plans to the Commission. The property is 6112 Acre parcel with a long driveway
with a bridge going over Little Harbor and a salt marsh area. The dwelling is an existing single family home with
a detached three car garage, detached carriage house, in ground pool, a paved driveway turns into a gravel
drive with an auto court.A carport gives access to the 3 car garage. The dwelling was originally built in 1895 and
will be about 9000 square feet. The project has buffer zones to resource areas that consist of coastal beach, salt
marsh, and coastal banks. Cavanaro Consulting is proposing to keep the carriage house intact, square off the
house, attach the garage, reconstruct the pool, and build a cabana. The garage spills outside the 100 foot buffer
zone, new 3 car attached garage falls outside the 50 foot buffer zone and sits within the developed area. The
house does not change foot print, some main features will be reconfigure. Pool footprint will not grow toward the
resource areas it will be closer to the house. The remaining gravel in the driveway will be converted to an
exposed aggregate with catch basins that will discharge to an infiltration system to reduce runoff. A grass swale
would be added along the edge of existing driveway that will drain into a rain garden. Sean Papich reviewed the
landscape design. Mr. Papich is proposing to reconfigure auto court area, attached garage and out building. The
front of house landscaping will stay the same, rebuild some of the stone walls, leave steps and porch, build pool
wider, add a planter, remove existing granite post along the causeway and replace with wooden post.Add native
plantings throughout the property and prune trees. Mr. Papich does take responsibility for a very large hack berry
tree being cut down before receiving the Commissions permission and is willing to pay a penalty or add
additional plantings. Jim Puzinas, abutter and former owner of 63 Nichols Road, questioned the removal of the
hack berry tree and why during the removal a crane was used within the 50 foot buffer zone. Mr. Puzinas is
recommending the Commission request the appropriate mitigation of the unauthorized tree removal. Mr.
Pimpare noted there will be no vote tonight on this project. The Committee agreed it would need more storm
water control and a mitigation plan for the removal of the hack berry tree. Mr_ Papich, Mr. Summers, and the
Puzinas will do a site visit on August 5th to discuss the type of trees that will be used to replace the hack berry
tree. Hearing will be continued until August 8, 2019.

Mr. Cavanaro reviewed the site plan to the Commission. Currently it is a detached single family home on a
narrow strip of land with 2 small structures, a green house and a shed. Property is half wetland and vegetated
wetland that comes into property runs along an existing driveway, circles bath, cuts across the property, and
then goes off property draining toward the ocean. The applicant is proposing to take down the existing house,
green house, and the shed. Build a single family raised dwelling with a deck on sono tubes and relocate the
driveway. The design plan was brought to the honing Board of Appeals initially to maintain the existing non-
h;V-
conforming side yard set back and try to expand the house from what is now. The feedback we received from
the ZBA was to consider redesigning the house so it sits closer to driveway to create more separation to the
abutting line and to eliminate a portion of the gravel driveway that sits adjacent to the wetland .Mr. Cavanaro
decided to bring the new plans to the conservation first before going back to the ZBA. Mr. Summer's main
concern is the removal of the dwelling sitting in the wetlands. Mr. Eisenhauer visited the site a few days ago and
mentioned there was a river of water going right through this plot, the water runs right in front of the house then
goes into the vegetated wetland, it doesn't seem the worksite is manageable, Abutting neighbors have concerns
with drainage issues and with trees being planted that would ruin their view. Mr. Pimpare is requesting a full
mitigation plan for the removal of the dwelling detailing what type of trees will be planted. Hearing continued until
August 8, 2019,

Mary Weathrald was not in attendance for this hearing but did listen to the tape and will sign an affidavit stating
she listened to the tape and is fully able to participate in tonight's hearing. Brendan Sullivan reviewed the revised
plan. The revised plan removed all parking from the 50 foot buffer zone and maintained a mitigation area of 500
square feet. The apartment has been moved once again to keep set back from the James Brooke. There will be
a parking space between proposed structure and the abutting property. The elm tree will be air spaded to try to
save it, but the elm tree might have to come down.
MOTION: Justin Pimpare motioned for approval of a variance for work in the 50 foot buffer at 15
Brook Street

MOTION: Chris MacFarlane moves that the order of condition includes the submission of a revised
planting plan by close of business August 2, 2019 that will include in clarification the five
buffer trees will be 7 to 8 foot junipers and eastern red cedar.Also include the condition
that if it should be determined by the arborlst during construction that the existing elm
needs to be removed a replacement disease resistant elm variety of 5 to 6 inch caliber will
be planted on site at a location to be determined.
