Meeting tailed to order at 7:00 PM.
Minutes for approval were moved to the next meeting.
7:05 PM: SWP 19-13 Lot#3 302 King Street - Davis—New Construction
In attendance to represent agenda item: James Garfield/Morse Engineering

The applicant proposes to build a new single family dwelling on the site which is mainly grass, lawn area and a
common driveway. The construction and new paved driveway will increase the impervious surface.Two sets of
roof drywell systems will capture runoff and a shallow grass depression will mitigate runoff from the rest of the
site. Three trees will be removed and replaced with four new native trees of 2 '/-3-ft. caliper.
MOTION: By Member Kennedy to close the public hearing and issue Stormwater Permit 19-13
for proposed worke at Lot 3, 302 King Street.

(Member Koines abstained because he didn't attend the hearing on 519119)
The applicant is redeveloping this lot. There is an older elm tree site that the arborist feels is worth saving and
suggests trimming and root restructure with all precautions taken to protect the tree. There are concerns about
work done within the flood plain and stone dust being brought it. Brendan Sullivan said the stone dust fortified
the ground to allow parking. Member Kennedy felt that if the area of disturbance in question is substantial it may
be unpermitted work within the buffer zone. Mr. Summers said this conversion of surface area should be
incorporated into the project allowing for the commission to vote on whether or not the area was disturbed.
Member Kennedy said he was ready to vote to issue an Order of Conditions but is now concerned with the
Wetlands Protection Act and disturbance in a resource area to create a parking lot.

The modified plan shows a 3-ft. wide path leading to a 10-ft. wide open area allowing for access to Straits Pond.
There will be no clearcutting. Member Wetherald asked how the area could be cleared without clear-cutting but
the applicant would use hand-tools and natural solvents to clear poison ivy. There was concern where Straits
Pond is an Area of Critical Environmental Concern (ACEC) but Richard Avery stated that this area is part of a
large scheme that runs from World's End and that Straits Pond is a small pant of an ACEC. The applicant agreed
to an alternate bench location closer to Windy Hill and also to submit a full plan before starting any work.
MOTION: By Member Kennedy to close the public hearing and issue a Negative 3 determination for
RDA 19-04 to install a bench and clear a small area at Straits Pond subject to the
condition that Agent Summers received a defined plan before beginning any work.

7:50 PM: DISCUSSION: NOI 18-22 , 55& 137 Beach Street- Daniello(cont from 1124/19)
In attendance to represent agenda item: Guy Daniello/Owner
Mr. Daniello did work without a permit on a section of his property at 55 Beach Street that impacted an abutting
property at 137 Beach Street. He was asked to restore the filled Isolated Vegetated Wetlands that had been
disturbed. He was brought before the commission on January 24, 2019 and told to restore the area no later than
June 1, 2019 but to date, no work has been done. Mr. Daniello said an unusually rainy spring backed up the
project. He feels that doing the project in the summer could kill the plants and wants to extend the project to
October 15, 2019 so he can do the work in September. Member Eisenhauer feels a summer planting can be
done as water is available on site, appropriate plantings are available now and landscapers could do the work.
The commission feels there has been ample time for the applicant to complete this project and there is no cause
to prolong the hearing process.
MOTION: By Member Kennedy to extend the time period to complete the restoration project at 55
and 137 Beach Street from June 1, 2019 to October 15, 2019.
SECOND: Member Koines
VOTE: 4-1 Motion Passes (Member MacFarlane in minority)
MOTION: By Member Kennedy to extend the current Enforcement Order at 55 and 137 Beach Street
to October 15, 2019 and take no action on the current Enforcement Order until the
October 15, 2019 date has passed.
SECOND: Member Koines
VOTE: 4-1 Motion Passes (Member MacFarlane in minority)
With no further business to discuss motion to adjourn made by Member Kennedy, second by Member
Koines, vote 5-0 unanimous.
Meeting adjourned at 9:10 pm
