Restoration Plan and Narrative
The owner was asked to remove unpermitted fill on this site and restore the site to its original condition.
Brad Holmes explained that excessive ledge on the site requires loam be brought in to create an area for
restoration. He is suggesting new plantings that are similar to previously existing vegetation.The plan
presented addresses the restoration only and does not include landscaping. Jeff Summers thinks the plan
is adequate but the northern portion of the site could take some additional plantings and landscaping.
Atty. Lampke asked if a current photo could be superimposed over a prior photo to see the scope of the
restoration. Atty. Nylan agreed to these requests and said they are looking at a fall planting so there is
time to make revisions.Atty. Lampke wants to ensure that none of the work already done will be disrupted
by the summer work. Brad Holmes said that loaming and seeding will be done now to prepare for the fall
plantings.
MOTION: By Vice Chair Creighton to approve the restoration plan for loaming and seeding
activities only and that a revised restoration plan be presented for additional work
to be done at 73 Atlantic Avenue.
SECOND: By Member Eisenhauer.

Member Macfarlane was absent from the initial Public Hearing on 5124118 but listened to a recording of
the meeting and signed an affidavit of consent.
The applicant is looking for approval to construct a single family dwelling on a previously undeveloped lot.
A portion of the proposed driveway would be within the 50-ft. buffer zone.There was discussion about a
proposed rain garden and related maintenance.Greg Morse said the rain garden would be inspected on
a quarterly basis and felt that further specific needs could be addressed in the Order of Conditions.Chair
Pimpare feels there would be a significant amount of disturbance in the buffer zone with the removal of 32
trees in size greater than 6 inches in diameter.Additionally,there is only 18-ft. of buffer between the
driveway and the wetlands and only 3-ft, between the driveway and proposed rain garden. Furthermore
100 linear feet or approximately 1300 sf of the driveway would cross into the 50-foot Buffer Zone to the
bordering vegetated wetland.The work would require a variance and may not meet the guidelines for
`rare and unusual'circumstances. Member Kennedy feels that variance standards have been met,that he
sees no indication of any adverse impact, and there is no evidence stating otherwise. Member

MacFarlane feels removing trees in the 50-ft, buffer zone and building a driveway will create impervious
area that could have an adverse effect. He also wanted a 3111 party consultant to view the site and review
the storm water report and variance request. Member Kennedy asked if there is a technical issue of
concern that would call for a 31d party consultant and feels that it is up to the commission to determine
whether the application meets variance standards.
MOTION: By Member Kennedy to close the public hearing for Notice of Intent 18-09 and
issue an Order of Conditions for work proposed at Lot F,Rust Way.

VOTE: 1-5(Kennedy in minority,motion denied)

issue a variance for work proposed within the 50-ft.buffer zone at Lot F,Rust Way.

Since the Stormwater Permit application was not formally addressed and the NOI was denied,
owner/applicant Mike Stevens was asked if we would like to withdraw the Stormwater Permit application
without prejudice. Mr.Stevens declined and asked for a vote.Vice Chair Creighton noted for the record
that the applicant was given the opportunity to withdraw without prejudice but declined and cannot bring
back the SWP application if denied.Chair Pimpare said he was not ready to vote for the SWP and would
neither support nor deny it.
MOTION: By Member Kennedy to close the public hearing and issue the Stormwater Permit
18-06 for work proposed at Lot F,Rust Way.
SECOND: Member MacFarlane
VOTE: 1-3-2(Kennedy in minority, Pimpare and Creighton abstain,motion denied)
The Conservation Commission's written denial for NOI 18-09 is due by Thursday,June 28,2018.

Greg Morse did a slide presentation showing revisions to the site. Once the bank contours have been
outlined the work within the intermittent stream would be for restoration only. Brad Holmes said non-native
invasive plantings would be removed and replaced with native plantings.The owner of 22 Smith Place
was concerned with any changes in grade causing flooding in her yard but Greg Morse said there is no
change in grade proposed for the area near her home.The only grade changed will be approximately 1
foot of fill near Pleasant Street to even off the parking area with an existing slab.Greg Morse also stated
that while the revision doesn't yet show calculations the runoff as originally shown will not increase in
post-development conditions.Chair Pimpare asked if it would be easier to bring the driveway up and
around the 50-foot buffer zone and eliminate any encroachment. Further revisions will be done to the
plans to reflect the Comments made by the commission and be submitted to Conservation staff by
Monday, July 16,2018 to give the commission time for review.

Other Business
Cohasset Yacht Club:(Vice Chair Creighton recused himself as a member of the club)Agent Summers
said that an existing Order of Conditions for work at the Yacht Club expired 3/10/18 and work is now
being done without a valid permit.A`cease and desistlenforcement order'was sent on Friday,June 1,
2018 requiring the Yacht Club to file a new Notice of Intent by June 26,2018.
With no further business to discuss, a motion to adjourn was made by Member Kennedy, 2111,by
Member MacFarlane and approved by a vote of 6-0
Meeting adjourned at 10:20 pm.
