Meeting called to order at 7:05 PM.

_Documents presented to support agenda item: EcoTech Wetlands Delineation Report from Arthur Allen
Greg Morse agreed with the peer review by Arthur Allen that there is an intermittent stream but not a wetlands
area on the site. Mr. Morse asked about work inside the 50'buffer zone to create access from Pleasant Street
and not Smith Place. No other work would be within the 50'buffer zone.Chair Pimpare said that historically the
Commission has not looked favorably on new construction within the 50-ft. buffer zone unless the work meets
'rare and unusual'circumstances which he feels is not the case here.Vice Chair Creighton was concerned with
the lack of a plan and cited inconsistencies in prior vs.current evaluations of this site.Abutter Chris Plecs
presented a list of concerns which will be submitted to Staff via the Commission and sent to the applicant and his
representatives.The applicant requested continuing to April 26,2018.The Commission set Tuesday,April 17th at
4 p.m.as the deadline to submit revisions. GON'T. TO APRIL 26,2018(last item on agenda)

This is an amended version of a Stormwater Permit from December 2016. Nine chambers at the lowest site
adjacent to the house would capture the roof runoff for the entire house.The gravel drive will help keep down
impervious area but is not part of the stormwater treatment plan.Chair Pimpare questioned the lack of
foundation drains on the plan but Greg Morse said the foundation is at grade and water will find its way out
naturally.There is concern about heavy equipment using the driveway. Chair Pimpare asked what happens
when the erosion controls are removed and the driveway floods.Greg Morse said the upgrades to the driveway
were discussed in depth when the Notice of Intent was being reviewed.Abutter Milanowski had issues regarding
groundwater,surcharge and an increase in the rate of flow.Vice Chair Creighton proposed that a third party
review be initiated.Greg Morse requested to continue the hearing pending a decision from the Superior Court
regarding the Notice of Intent application currently before the court.
COURT DECISION
AGENT UPDATE:The owner of the Atlantica Restaurant met with staff to discuss the wall repair. He assured
staff that an application and plans are forthcoming for the repair/reconstruction of the wall. Fines are still being
assessed for work being done without a permit.Agent Summers will follow up with the owner.
With no further business to discuss motion to adjourn at 9:30 pm was made,seconded and passed.
