HomeMy WebLinkAboutMinutes - CC - 12/14/2017 Cohasset Conservation Commission December 14,2017 Minutes APPROVED COHASSET CONSERVATION COMMISSION MEETING MINUTES FOR THURSDAY, DECEMBER 14, 2017 IN ATTENDANCE: Justin Pimpare, Chair Jack Creighton, Vice Chair Eric Eisenhauer, Member Chris McFarlane, Member Alex Koines, Member Maryanne Wetherald,Associate Member James Rosebach, Associate Member Jeff Summers, Conservation Agent Angela Geso, Conservation Administrator ABSENT: Patrick Kennedy, Member Edward Graham, Member Meeting called to order at 7:05PM. Minutes for Approval: Minutes of August 24, 2017 and October 25, were both approved in one motion made by Vice Chair Creighton and seconded by Member Koines. Motion approved 5-0 Unanimous. 7:05 PM: NOI 17-10: 70 Black Horse Lane1JAK LL.0 applicant Continued from 10/19117 In attendance to represent agenda item: Jack Livingstone/Applicant; Attorneys Adam Brodsky and Matt Wattskey; Jeff Hassett/Morse Engineering Documents presented to support agenda item:Aerial Photographs; Revised Site Plans Jeff Hassett said that the proposed mowing and selective invasive vegetation removal has been scaled back and all of the work has been taken out of the 50-ft. buffer zone.Attorney Wattskey wants to make it clear that future owners are aware that mowing will continue to be done yearly within growing seasons even after the Certificate of Compliance is issued. Chair Pimpare said that the Order of Conditions stays with the property and any new owner would have to file their own application before doing any work in areas under the jurisdiction of the Conservation Commission. MOTION By Vice Chair Creighton to close the public hearing for Notice of Intent 17-10 and issue an Order of Conditions on work proposed at 70 Black Horse Land with the following conditions: the limit of work line at the 50-ft. buffer zone be clearly defined with straw wattles;Agent Jeff Summers to be notified five business days prior to any work being done; any violation outside the limit of work in the Order of Conditions will be subject to fines of$300 per day; the area be mowed twice a year within the growing seasons; three mature trees of minimum 3" caliper and 15-ft. height be planted in the mitigation area on the southern portion of the property outside the 12-ft.wide easement line; and a revised planting and mitigation plan be submitted by 12121117. SECOND: Member Koines VOTE: 4-1 (Member Eisenhauer in minority) Motion Passes 8:15 PM: -Show Cause: 149 King Street--Matt Shannon -Violation In attendance to represent agenda item: Matt Shannon/owner;Attorney Richard Henderson Unpermitted tree-cutting, brush removal and other landscape activities were performed on property subject to the Wetlands and Stormwater Bylaws. A Cease and Desist order was issued on 1217117.Attorney Henderson said the work was necessary to locate utilities and there was no negative impact to abutting properties. Chair Pimpare requested hay bales or a silt sock be installed and that no other work be done on the site until viable application comes before the commission. Cohasset Conservation Commission December 14,2017 Minutes MOTION: By Vice Chair Creighton to issue an Enforcement Order for property located at 149 King Street and authorize Agent Summers to issue fines of$100 per day retroactive to 1211i17 until an acceptable Stormwater Permit application is filed. SECOND: Member Koines VOTE: 4-1 (Member McFarlane in minority) JS if submittal isn't received by a set date, more violation, more enforcement MOTION: By Chair Pimpare allowing for the installation of hay hales or silt sock on property located at 149 King Street by close of business on Tuesday, December 19, 2017 and submittal of an acceptable Stormwater Application no later than 4 pm on Tuesday,January 16, 2018 and to continue Enforcement and fines if this deadline is not met. SECOND: Member Eisenhauer VOTE: 5-0 Unanimous Certificates of Compliance Issued: NOI 10-23 - 10 Beach St./Brown NOI 14-14 - 166 Lamberts Lane/Gooding Update: 44 Border Street101de Salt House—Sea Wall On 11I2117 the Commission issued an Enforcement Order on owner Gerd Ordelheide requiring he file a Notice of Intent by 1211I17.This deadline was not met and fines of$300 per day will continue to be issued until an NOI is filed. Mr. Ordelheide or an authorized representative will be ordered to attend the Conservation Commission meeting scheduled for 1/18/18 and to file an NOI by 211118. If these deadlines are not met, the Commission voted 5-0 that Agent Summers be authorized to file a criminal complaint with the court that will initiate a hearing and have a judge validate the fines. Other Business: Proposed meeting dates for 2018 were presented by staff. MOTION: By Vice Chair Creighton to accept the meetings dates for 2018 as presented. SECOND: Member Eisenhauer VOTE: 5-0 Unanimous With no further business to discuss, motion was made and seconded to adjourn at 9:15 pm.
