Minutes for 9/7117, 10/2117, 1112/17 approved in one motion made by Member MacFarlane, seconded by Member Graham, and passed by a vote of 6-0. 7:05 PM: NOI 17-19 & SWP 17-22: 1 James Island Way—Steinmetz - New Construction In attendance to represent agenda item: John Cava narolCavanaro Consulting; John Steinmetz/Applicant; Sean PapichlLandscape Architect; Abutters Tom Killelea, Dr and Mrs. DeVitre, Steve Brown, James McCann, Documents presented to support agenda item: NOl & SWP Applications: Site Photos; Site Plan *"Member Kennedy arrived 20 minutes into the hearing and recused himself. The applicant want to construct a single family dwelling sited out of the 100' buffer zone to a salt marsh and at least 50' from the nearest coastal bank delineations. Impervious surface is reduced by 2,800 slf. Vice Chair Creighton asked for clarification of impacts to the resource area within the 100' buffer zone. Sean Papich plans to add 2"-3" caliper trees and replace 2-3 trees that will be removed from the 100' buffer zone. Larger trees will be replaced with smaller trees at a 211 ratio and Member MacFarlane said any larger than 3.5" caliper would not work with the ledge. MOTION: By Vice Chair Creighton to close the public hearing for Notice of Intent 17-19 and issue an Order of Conditions for proposed work at 1 James Island Way subject to a mitigation plan being submitted by the close of business on Tuesday, November 28 to address a 211 replacement or better of 315" caliper trees and marking of trees in conjunction with Member MacFarlane and Agent Summers review of the plan. SECOND: Member Graham VOTE: 6-0 Unanimous MOTION: By Vice Chair Creighton to issue a variance for proposed work within the 50' buffer zone at 1 James Island Way. SECOND: Member Graham VOTE: 6-0 Unanimous MOTION: By Vice Chair Creighton to issue the Stormwater Permit 17-22 for proposed work at 1 James Island Way. SECOND: Member Graham VOTE: 5-1 (Member Eisenhauer in minority) *Member Kennedy rejoined meeting Conservation Commission Minutes November 16, 2017 Meeting 7:30 PM: ANRAD NOI 17-17— 126-129 Forest Avenue: Pom eo—Wetlands Delineation In attendance to represent agenda item: John Zimmer/South River Environmental Documents presented to support agenda item: Revised Wetlands Delineation Plan The Commission requested a third-party review of the wetlands delineation at the applicant's expense and hired wetlands scientist Arthur Allen of EcoTec. Mr. Zimmer concurred with the revisions as presented. MOTION: By Member Kennedy to close the public hearing for ANRAD NOI 17-17 and issue a Negative C determination for the revised delineation for property located in 126-128 Forest Avenue. SECOND: Member Graham VOTE: 7-0 Unanimous 7:40 PM: Show Cause: 417 Jerusalem Rd—Landscaping - Rogers In attendance to represent agenda item: Sean Papich/Landscaper; Michelle and Peter Laney/Abutters Documents submitted to support a enda item: **Associate Member Maryanne Wetherald recused herself. Work has been done that was not reflected on the approved plan. There is now a staircase and a large area of open lawn that was supposed to have plantings. The owners decided they wanted more functional lawn area. Sean Papich proposed to create a raised retaining wall with substantial planting within 2-ft. of the wall and add a privet edge at back of stone wall rather than removing ledge and replacing it with lawn. Mr. Papich will file a separate application for work not related to the staircase removal at a later date. MOTION: By Vice Chair Creighton to issue an Enforcement Order for removal of the unpermitted staircase at 417 Jerusalem Road within 30 days of today's date. SECOND: Member Koines VOTE: 7-0 Unanimous *"Associate Member Maryanne Wetherald rejoined meeting 7:55 PM: NOI 17-10 -70 Black Horse Road—JAK LLC — CONTINUED TO 11/30/17 8:20 PM:AMENDED SWP 17-17—92 Howe Road—Brian Baldwin— Continued from 10/19117 In attendance to represent agenda item: Jeff HassettlMorse Engineering; Brian Baldwin/Owner; Attorney Matthew Watskey; Paul Davis/contractor; Abutters Elaine Breslow, Deidre Hobson, Tom Bell; Rolf Gjesteby Documents presented to support agenda item: Revised Plan for 92 Howe Road A revised plan was presented by the owners' representatives.Attorney Watskey said the new design decreases the impervious surface by 70% and increases the size of the stormwater management system. Jeff Hassett presented a revised plan showing the changes to the stormwater management system, more robust plantings along Howe Road and a catch basin at the end of the driveway. MOTION: By Member Kennedy to close the public hearing for 92 Howe Road and issued Amended Stormwater Permit 17-17 with a specific condition that a revised replanting plan showing all 3" to 3.5" caliper trees be submitted by close of business on Thursday, November 21, 2017. SECOND: Member Graham VOTE: 5-0-2 Motion passes (Chair Pimpare and Vice Chair Creighton abstain) Conservation Commission Minutes November 16, 2017 Meeting Topics not anticipated within 48 hours: 604 Jerusalem Road/Brewer-ATF NOI 17-09 In attendance to represent item: Andrew Spaltz, Total Tree Care There is an Enforcement Order on the property requiring the owners to replace trees that were removed without authorization.Andrew Spaltz is having an issue finding trees that comply with the requirements put forth by the Commission. He said the 3" caliper 15-ft. trees require more separation than is available at the location and would necessitate excavating the property. He recommended planting a larger number of smaller trees. The Commission wants to see a revised plan by close of business on November 21, 2017. MOTION: By Member Kennedy to authorize the chair to amend the existing Order of Conditions for ATF NOI 17-09 with the added specific condition to replace the eight previously approved trees with ten smaller caliper trees. SECOND: Member Graham VOTE: 6-0-1 Motion passes (Member MacFarlane abstains) With no further business to discuss, motion to adjourn at 9:46 made by Vice Chair Creighton, 2nd by Member Koines and passed 7-0.
