There were no minutes to approve. 7:06 PM: SWP 17-20: 34 Oak Street—Greenberg-!--New SF Construction In attendance to re resent agenda item: Greg Tanse /Ross En ineerin o Brian Greenberg/Applicant- James Rosebach/Abutter; Maryanne Wetherald Documents resented to supl2ort agenda item: Site Plan; Design Plan; SWPApplica#ion; The applicant want to construct a single family dwelling on previously undeveloped land. Greg Tansey is proposing a specific permeable pavement mix for the driveway that contains very little sand and is supposed to be effective in absorbing runoff. In addition, the drive will be set on crushed stone for further absorption. The Commissioners expressed concern that if the permeable pavement doesn't work would it be replaced with an impervious surface, but it was determined that the size of the driveway would generate a SWP which would address the surface issue. MOTION: By Vice Chair Creighton to close the public hearing and issue SWP#17-20 for work proposed at 34 Oak Street. SECOND: Member Edward Graham VOTE: 5-0-2 (Members Kennedy and Eisenhauer abstained) 7:30: NOI 17-18: 60 Summer Street—Mahone — Garage Addition In attendance to represent-agenda item: John Cavanaro/Cavanaro Consulting Documents presented to support agenda item: The project as proposed will reduce paved area within the 50' and 100' buffer zones by 900+ s/f total. The addition of crushed stone and increase of pervious surface will facilitate recharge and infiltration. Chair Pimpare sees the project as an improvement because a large area of impervious surface within the 50' buffer zone is being reduced. Member MacFarlane suggested a vegetative area instead of crushed stone in some areas but Member Kennedy was concerned with potential pesticide use in proximity to the buffer zone. MOTION: By Member Kennedy to close the public hearing for NO] 17-18 and issue an Order of Conditions for proposed work at 60 Summer Street with the condition that crushed stone and not gravel be used to replace the asphalt driveway. SECOND: Member Graham VOTE: 6-1 (Member MacFarlane in opposition) MOTION: By Member Kennedy to issue a variance for work within the buffer zone at 60 Summer Street. Conservation Commission Minutes November 2, 2017 Meeting SECOND: Member Graham VOTE: 7-0 Unanimous 7.45 PM: SWP 17-21: 120 Pleasant Street—Dunkelber er—New Construction In attendance to represent agenda item: Brian and Marie Dunkelberger/Applicants; Mark Peron!/Abutter; Documents resented to support agenda item: Applicants have made effort to be neighbor-friendly with 15%+ of total lot coverage. There are trees on the property that appear to be dead or dying and will be removed and replaced with 3-4" caliper trees. The lot will not be clear-cut; only dead trees are being targeted. The Commission felt the revegetation plan is a good one. MOTION: By Member Kennedy to close the public hearing and issue SWP 17-21 for work proposed at 120 Pleasant Street by the applicants. SECOND Member Graham VOTE 6-1 (Member Eisenhauer in opposition) 8:05 PM: ANRAD NOI 1-17—126-129 Forest Avenue: Pom eo - CONTINUED TO 11/16/17 8:20 PM:AMENDED SWP 17-17—92 Howe Road —Brian Baldwin —continued from 10/19/17 In attendance to represent agenda item: Jeff Hassett/Morse Engineering; Brian Baldwin/Owner;Attorney Matthew Watskey;Abutters Elaine Breslow, Peter and Deidre Hobson, Tom Bell; Kevin Heine; Lilly Sestito; Joseph Rosano; Rolf Gjesteby; Kevin McKeon; Ellen Freda; Steve Magnell; Brian Davis/contractor Documents gresented to support agenda item: The proposed driveway would no longer run from Tad Lane along the rear of the property on Howe Road. The proposed driveway entrance would be along Howe Road. Utilities are being moved to minimize the disturbed area. The abutters were cautioned to only discuss the project as presented and not prior work done on this and other sites in the area. Member MacFarlane feels the project is an upgrade and could be done in such a way to give everyone comfort. Vice Chair Creighton said the Commission does not design projects but makes decisions based on what is presented by the applicant.A peer review was proposed but the majority of Commissioners feel they have enough information to make an informed decision without a review. There was no vote on an independent review, but Commissioners felt more work is needed to be done on the project in order to cast a formal vote. CONTINUED TO 11/16/17 8:40 PM: Discussion: Atlantica101de Salt House—Sea Wall—44 Border St Jeff Summers reported Town Council has determined that the owner of the Atlantica is responsible for the seawall based on a statue that coastal-owned properties are determined by mean low tide or 100 rods. In a formal letter from the Town to the owner of the property, a Notice of Intent was requested to be filed by October 23_ To date, no filing has occurred. MOTION: By Member Kennedy to issue an enforcement order to Gerald Ordelheiser, owner of the Atlantica/Olde Salt House requiring him to submit a Notice of Intent application no later than Thursday, December 7, 2017. SECOND: By Member Graham VOTE: 7-0 unanimous MOTION: By Member Kennedy to impose a daily fine of$300 starting November 3, 2017 for failure to submit a Notice of Intent by the requested deadline. SECOND: By Member Koines Conservation Commission Minutes November 2, 2017 Meeting VOTE: 7-0 Unanimous 48 Hour Rule: Chair Pimpare said that Associate Member Kathleen Heffernan resigned as of 1111117. In order to participate in hearings scheduled for the November 16 meeting, any commission who has not attended all the public hearings on those hearings need to listen to the recordings, review all previous documents submitted and sign an affidavit to verify that this has been done.
