HomeMy WebLinkAboutMinutes - CC - 08/24/2017 Conservation Commission Minutes August 24, 2017 Meeting CONSERVATION COMMISSION MEETING THURSDAY, AUGUST 24, 2017 -7:00 PM WILLCOTT COMMONS, 91 SOHIER ST -CHART ROOM IN ATTENDANCE: Justin Pimpare, Chair Jack Creighton, Vice Chair Edward Graham, Member Patrick Kennedy, Member Kathy Heffernan, Associate Member Jeff Summers, Conservation Agent ABSENT: Chris MacFarlane, Member Alex Koines, Member Eric Eisenhauer, Secretary/Treasurer Meeting called to order at 7:00 PM Approval of Minutes of July 13, 2017: Motion to approve made by Member Kennedy, 2n" by Member Graham, Approved 4-0 Unanimous 7:05 PM: NOI 17-12--73 Whitehead Road Roger Wade - Pier Construction In Attendance to Represent Agenda Item: Roger Wade/Applicant; John Cavanaro/Cavanaro Consulting Documents presented to support agenda item: The applicant wants to install a permanent pier perpendicular to the shoreline with a 20' removable ramp. The pier is designed to span the saltmarsh and takes high tide conditions into consideration. The pilings for the pier will be 8 feet on center and will go down 10-12 feet. Precautions will be taken to avoid the saltmarsh when installing and removing the pier. MOTION: By Vice Chair Creighton to close the public hearing for NO] 17-12 and issue an Order of Conditions for the proposed work at 73 Whitehead Road. SECOND: By Member Graham VOTE: 4-0 Unanimous MOTION: By Vice Chair Creighton to issue a variance on NOI 17-12 for work within the 50- foot Buffer Zone at 73 Whitehead Road. SECOND: By Member VOTE: 4-0 Unanimous 7.25 PM: NOI 17-13—92A Beach St John Weltman &James Atkins/Owners—Pier Construction In Attendance to Represent Agenda Item: John Cavanaro/Cavanaro Consulting Documents presented to support agenda item: The applicant wants to install a 151-foot pier with a seasonal gangway and float. The pier is designed according to the contours of the shoreline and will span the saltmarsh along Little Harbor. The area is primarily used by canoes, kayaks and small skiffs. MOTION: By Vice Chair Creighton to close the public hearing for NOI 17-13 and issue an Order of Conditions for the proposed work at 92A Beach St. SECOND: By Member Graham VOTE: 4-0 Unanimous Conservation Commission Minutes August 24, 2017 Meeting MOTION: By Vice Chair Creighton to close the public hearing for NOI 17-13 and issue a variance for work within the 50-foot Buffer Zone at 92A Beach Street. SECOND: By Member Graham VOTE: 4-0 Unanimous 7:45 PM: Discussion: Sea Wall Update--Olde Salt House Atlantica -Gerd Ordelheiser Documents Presented to support aen g da item: Letter from Jeff Summers to Gerd Ordelheiser/Owner; Letter from Anderson Structural Engineering dated 8/8/17 Temporary stabilization measures that did not involve an engineer were done on the sea wall to prevent further damage but it appears that additional measures may be required for permanent stabilization. Vice Chair Creighton viewed the site on several occasions and wants the Commission to request the owner provide the Town with both information on the current state of the wall and evidence that the owner is going forward with permanent repairs. The current composition of the wall is under question and the Commission is asking for documentation, among other things, as to what type of fill has been used. The owner has not filed for a Notice of Intent with respect to any work on this project. Vice Chair Creighton would like the application process to start immediately. it is the will of the Commission to potentially issue an Enforcement Order on the property, determine what type of fill was used; and have the owner submit an After-the-Fact Notice of Intent for permanent stabilization. Member Kennedy recommended to involve Town Counsel in the process prior to ratifying the Enforcement Order. With no further business to discuss, motion to adjourn was made by Vice Chair Creighton, 2"d by Member Kennedy and approved 4-0. Meeting adjourned at 8:30 pm.
