HomeMy WebLinkAboutMinutes - CC - 06/22/2017 Conservation Commission Minutes of June 22,2017 Meeting APPROVED MINUTES COHASSET CONSERVATION MEETING THURSDAY, JUNE 22, 2017 IN ATTENDANCE: Justin Pimpare, Vice Chair Jack Creighton, Member(arrived at 7:35) Edward Graham, Member Patrick Kennedy, Member Andrea Buffum, Secretary/Treasurer Alex Koines, Member Eric Eisenhauer, Associate Member Chris McFarlane, Associate Member Jeffrey Summers, Conservation Agent ABSENT: Patrice Vogelman, Chair Meeting called to order at 7:00 pm by Acting Chair Pimpare Minutes for Approval: April 26—Motion: Ed Graham Second: Alex Koines 4-0-1 (Kennedy abstains, not at meeting) April 27—Motion: Ed Graham Second: Alex Koines 4-0-1 (Kennedy abstains, not at meeting) May 25— Motion: Patrick Kennedy Second: Alex Koines 4-0-1 (Graham abstains, not at meeting) 7:06 PM: 71 Nichols Road—Tehranian—Discussion Plantin Plan con't from 5125/17 In attendance to represent agenda item: Susan and Ray Tehranian/applicants Applicant stated 4 trees of 2 '/ inch caliper have been proposed for the street side of the lot. There was discussion as to the size and type of tree being appropriate for the area. The Commission would like to see larger trees. Ms. Tehranian is concerned larger trees would have a higher failure rate. VC Pimpare would like to see trees in the 12' to 15' height range and recommended that Ms. Tehranian look at the list of approved trees on the website. He recommended that the Tehranian's revise the plan to reflect the species and height requested by the Commission. CONTINUED TO 6113117 7:20 PM: SWP 17-13 -54 Rust Way, Hartwell—Reconstruction of Home This home was damaged by a fire last October. The new plan indicates a decrease of 126 slf of impervious surface. All water flows in rate and volume have been decreased. MOTION: By Member Kennedy to close the public hearing and issue the Stormwater Permit 17-13 for work proposed at 54 Rust Way. SECOND: Member Graham VOTE: 5-0-1 in favor(Member Creighton abstains due to late arrival) 7:40 PM: SWP 17-12 -82 Pleasant St—Vickers -New Construction con't from 618/17 In attendance to support a enda item: Jeff Hassett/Morse Engineering; Mike Stevens/Owner; Liam Vickers/Applicant; Abutters Keith Conforte, Chuck Levangie, Fred Davidson, Robert Cunningham Documents Presented: Revised SWP Application dated 6/16/170 Letter from Abutters re: Consultant Jeff Hassett made revisions to the original SWP application. A stone trench was added to capture more runoff. The owner will install piping around the perimeter and received permission from the DPW to direct runoff into the town drainage system. Pavers were added to the driveway in an attempt to stop gravel runoff. Mr. Hassett has elevated the infiltration system to be 2 feet above the water level. Overflow will go over the lawn and run downhill. VC Pimpare felt that the revised plan reflects significant improvement to Conservation Commission Minutes of June 22, 2017 Meeting the site_ When abutters asked about runoff coming down the street VC Pimpare asked Mr. Stevens to ask the DPW if roof runoff overflow from the infiltration basin could also be directed into town drainage. Member Creighton suggested the need for an independent consultant for this project. Member Kennedy said that only members who attended the previous meeting or didn't attend but signed an affidavit saying they had reviewed the transcript of the meeting, are eligible to vote. Members Buffum and Koines were declared ineligible. MOTION: By Member Creighton to arrange for an independent engineer to do a limited study of 82 Pleasant Street in such a manner that they can submit to the commission for the July 13 meeting. SECOND: Vice Chair Pimpare VOTE: 2-2 Motion does not carry (Kennedy and Graham opposed) MOTION: By Member Kennedy to close the public hearing and issue Stormwater Permit 17- 12 for proposed work at 82 Pleasant Street with the condition that the applicant ask Cohasset DPW if it is possible that overflow from the collection chamber could also be tied in to town storm drainage system. SECOND: Member Graham VOTE: 2-1-1 Motion does not carry (Creighton opposed; Pimpare abstained) CONTINUED TO 6/13117 8:15 PM: 55 Beach St: Show-Cause Discussion =Wetlands Violation -Daniello In attendance to represent agenda item: Guy Daniello/owner; Jeff_Hassett/Morse Engineering Mr. Daniello filled a portion of an IVW on abutter Carla Getto's property and she wants her property restored to its original condition. Mr. Daniello submitted several plans showing restoration of the wetlands but Ms. Getto has not approved any of them. VC Pimpare recommends that Mr. Daniello replicate on his property and let Ms. Getto do what she needs on her property since Ms. Getto seems to be uncooperative with signing any paperwork for this project. Mr. Daniello will file a restoration plan for his property and presented at a later meeting. CONTINUED INDEFINITELY 8:20 PM: 589 Jerusalem R: Enforcement/Discussion—Revised Restoration Plan con't from 618/17 At the 618117 hearing the applicant was requested to submit a revised restoration plan by 6/22117 but the owner/applicant did not submit the plan as of this hearing. VC Pimpare asked Jeff Summers to issue an enforcement order and require the applicant and his representatives submit a plan by 6/29/17 and attend the July 13 meeting to present the plan. CONTINUED TO 7113/17 MOTION: By Vice Chair Pimpare to issue an Enforcement Order for property located at 589 Jerusalem Road and have the applicant submit a revised restoration plan by 6129/17 and be present at the public hearing on 711312017 to present such plans. SECOND: Member Graham VOTE: 6-0 Unanimous There is another Enforcement Order on this property for violation of the OOC for silt sock use. MOTION: By Member Kennedy to ratify an Enforcement Order issued by Conservation Agent Jeff Summer to replace a silt sock erosion control barrier that has not been maintained for property located at 589 Jerusalem Road SECOND: Member Graham VOTE: 6-0 Unanimous Conservation Commission Minutes of June 22,2017 Meeting Other Business: Lot Release: Lot 3, Beach Street Attorney Jeff DeLisi requested a Partial Certificate of Compliance to release non-locus lots. The original property was one large lot under common ownership lot but has since been divided into 4 lots. Lot 3 is now 55 Beach Street and has been developed. The other lots need to be unencumbered for individual sale and development. Certificate of Compliance: 130 Gammons/Genovese. This is from a 2006 NOL The project involved restoration and a culvert. Jeff Summers inspected the property and found the work to be satisfactory. 48 Hour Items: 82 Pleasant Street/Stevens; The builder paved over a 725 slf driveway at the owner's request which triggered a SWP. The builder will put cobblestone pavers on the sides and stone pavers at the entrance to restore some of the pervious area_ VC Pimpare deferred to Agent Summers to follow up on the issue and report back to the commission. 390 Atlantic Avenue: Alex Koines reported a damaged silt sock at 390 Atlantic Avenue. Jeff Summers will look at the property and make a determination. With no further business, motion to adjourn at 10:30 pm made by JC, seconded by PK and approved 6-0.
