HomeMy WebLinkAboutMinutes - CC - 06/08/2017 Conservation Commission June 8,2017 Meeting Minutes APPROVED MINUTES COHASSET CONSERVATION MEETING THURSDAY, JUNE 8, 2017 IN ATTENDANCE: Justin Pimpare, Vice Chair Jack Creighton, Member Edward Graham, Member Patrick Kennedy, Member Eric Eisenhauer,Associate Member Jeff Summers, Conservation Agent Angela Geso, Conservation Administrator ABSENT: Patrice Vogelman, Chair Andrea Buffum, Secretary/Treasurer Alex Koines, Member Chris MacFarlane,Associate Member Meeting called to order at 7.05 pm.Approval of minutes was moved to June 22. 7:06 PM: SWP 17-11 —125 Linden Drive—Aberbach New Construction In attendance to represent agenda item: Jeff Hassett/Morse Engineering; Phil Aberbach/applicant Documents Presented: Stormwater Permit Application with Site Photos The applicants want to construct a new single family dwelling. Some trees were removed but there remains a significant number of trees on the property. There are underground chambers to capture runoff.There is no work within any resource areas. MOTION: By Member Kennedy to close the public hearing and issue Stormwater Permit 17-11 for proposed new construction at 125 Linden Drive. SECOND: Member Graham VOTE: 4-0 Unanimous 7:20 PM: SWP 17-12 -82 Pleasant Street--Vickers—New Construction —Single Family Home In attendance to represent agenda item: Jeff Hassett/Morse Engineering; Abutters Keith Conforti, Brian Baldwin, Marty Corey, Paul Humphrey (76 Pleasant), Robert Cunningham; Documents Presented: Stormwater Application-, Submittal Letter; Summary of Revision; 4 photos The abutters are concerned with the slope of the area causing flooding and other problems. Vice Chair Pimpare feels the proposed increase in pervious surface and a solid infiltration system should facilitate runoff. Patrick Kennedy would like more technical evidence to support the abutters' concerns and more input from a larger quorum of commissioners. Jeff Hassett will submit revised plans to staff on June 16. CONTINUED TO .TUNE 22 7:36 PM: RDA 17-03 70 Black Horse Lane—JAK LLC —continued from 6126/17 In attendance to represent a enda item: Jack Livingstone/owner: Jeff Hassett/Morse Engineering John Cavanaro/Cavanaro Consulting Documents Presented: Revised Landscaping Plans from Kennedy's Count Gardens A site visit was done by select members of the commission and the Gulf River Associates_ It was determined the project is larger in scope than anticipated. Member Creighton wants the owner to file a Notice of Intent because of work within the salt marsh. Even if the RDA was amended for vista pruning and Conservation Commission June 8, 2017 Meeting Minutes trails only the bridge repair would still require an NOI. Jeff Hassett requested to withdraw the RDA without prejudice and refile with a Notice of Intent at a later date. 7:60 PM: SWP 17-08 and 17-09 19 8 21 Heritage Lane-- New Construction—Continued from 6/25117 In attendance to represent agenda item: Jeff Hassett/Morse En ineeriin Documents presented to support agenda item: Revised Landscapinq Plan The revised landscaping plan was approved by the commission. MOTION: By Member Kennedy to close the public hearing and issue Stormwater Permit 17-08 for proposed work at 19 Heritage Lane by Stratford Heritage LLC SECOND: Member Graham VOTE: 4-0 Unanimous MOTION: By Member Kennedy to close the public hearing and issue Stormwater Permit 17-09 for proposed work at 21 Heritage Lane by Stratford Heritage LLC SECOND: Member Graham VOTE: 4-0 Unanimous 8:00 PM 8:40 : Discussion—Enforcement—604 Jerusalem Rd Brewer No After-the-Fact restoration plan has been submitted to date. Jeff Summers spoke with Mr. Brewer who will have Morse Engineering file a Notice of Intent. MOTION: By Vice Chair Pimpare to issue an Enforcement Order for restoration work at 604 Jerusalem Road and request an After-the-Fact Notice of Intent be filed by 6/22/17 SECOND: Member Kennedy VOTE: 4-0 Unanimous 8:05 PM 8:45 : Discussion--Enforcement—55 Beach St Daniello In attendance to represent agenda item: Guy Daniello/Owner Mr. Daniello filled a wetlands area on his neighbor's property and was issued an Enforcement Order by the Commission Ms. Getto stated In a letter to Agent Summers, that she wants her property restored to its original condition. Before Mr. Daniello can file a restoration plan he needs Ms. Getto to sign the application for work being done on her property. MOTION: By Vice Chair Justin Pimpare to have a restoration plan from the owner of 55 Beach Street submitted to the Conservation Agent by June 19, 2017 pending a signature from Ms. Getto. SECOND: Member Creighton VOTE: 4-0 Unanimous 8:10 PM 8.50 : Discussion--73 Atlantic Avenue alkla 70 Whitehead Rd —Sullivan In attendance to represent agenda item: Attorney Jim Lampke Attorney Lampke discussed recent revisions to the original suit filed again Thomas Sullivan, owner of record for 73 Atlantic Avenue regarding a 3-Phase plan for removal of improper fill and subsequent restoration of the site to its original condition.Attorney Lampke feels the revision addresses outstanding issues and meets all requirements as previously discussed. It was suggested by the commission that Merrill Engineering serve as a site monitor with Agent Summers performing random inspections as well. Attorney Lampke stated that the applicant doesn't need to file an NOI based on an Enforcement Order. MOTION: By Member Creighton to accept the fill removal plan and narrative revised 618117 as an appropriate response at this time to the Enforcement Order on property located at 73 Atlantic Avenuelaka 70 Whitehead Road with the addition under Phase 31B stating Conservation Commission June 8,2017 Meeting Minutes "regardless all material will be removed", that this action is without prejudice to any prior, pending or future enforcement actions. SECOND: Member Kennedy VOTE: 4-0 Unanimous 8:25 9:15 ATF NOI 17-06 689 Jerusalem Road -Shannon continued from 5125M7 In attendance to represent agenda item: Atty. Richard Henderson; Matt Shannontowner; Josh Bows/Merrill Engineering; John Cavanaro/Cavanaro Consulting; Abutters Deidre & Peter Hobson, Elaine Breslow,Amy Glasmeier The ATF NOI is for unauthorized removal of trees within wetlands jurisdiction. Restoration would involve 13 large tree but Attorney Henderson stated that the landscaper(who was not present) feels the size and amount may not thrive on the bank and suggested starting with 8 trees.Associate Member Eisenhauer felt that 13 trees can work and the landscaper should go with the original plan but Member Kennedy would prefer to condition the decision 8 initial plantings with 5 additional plantings if the original 8 trees thrive. CONTINUED TO JULY 13, 2017 WITH A RESTORATION PLAN SUBMITTED BY JUNE 22, 2017. 8:45 PM 9:35 : Diab Lane—Lots 3 9 15—SWP's - Matt Shannon --A licant—con't from 5/26117 In attendance to represent agenda Item: Atty. Richard Henderson; Josh Bows/Merrill Engineering; John Cavan aro/Cavana ro Consulting; Matt Shannon; Deidre Hobson; Peter Hobson, Elaine Breslow,Amy Glasmeier, Consultant Josh Bows of Merrill Engineering reviewed the revised plan from Cavanaro Consulting dated June 5, 2017_ In his professional opinion, the applicant has addressed all issues as presented to the satisfaction of Merrill Engineering. Member Kennedy feels the bylaw standards have been met.Abutter Deidre Hobson had a list of specific conditions she would like to see incorporated into the OOC to reflect the extremely demanding site. Some of the requests such as maintenance plan and site monitoring would already be addressed in the standard Order of Conditions. MOTION: By Member Kennedy to close the public hearing and issue the Stormwater Permits 16-36, 16-37 and 16-38 for 3, 9 and 15 Diab Lane with additional conditions: the ownerlapplicant provide 14-day notice to commencement of project rather than the standard 3-day notice; that the ownerlapplicant be responsible for an independent site monitor to be engaged at the discretion of the Conservation Agent as needed. SECOND: Member Graham, MOTION: 4-0 Unanimous Certificate of Compliance A Certificate of Compliance was issued for 74 Border Street for dock work done in 1994.
