There were no minutes for approval. 6:05 PM: RDA 17-02 27 Riverview Drive/Baker- Deck In attendance to represent a ends item: Robin and Scott Baker The applicants want to construct a deck near a resource area that will not be impacted by the construction. The Bakers use them offsite during the winter and store them on site in the off-season. They agreed to store them in a more appropriate area. MOTION: By Vice Chair Pimpare to approve RDA 1702 and issue a Negative 2 determination for work being done at 27 Riverview Drive. SECOND: Member Creighton VOTE: 4-0 Unanimous Patrick Kennedy joined the meeting at 6:20 pm. 6:20 PM: NOI 17-07 SWP 17-10 - 137 Hull StreetlJo ce - New construction In attendance to represent agenda item: Jennifer Turcotte/STS Consultants/Applicants John Joyce Documents submitted: Copy of Sewer Plan; The applicant wants to build a single family home on a formerly developed lot. Ms. Turcotte said one tree will be removed and that infiltration plans are proposed. Chair Vogelman asked to see an existing and proposed planting plan in more detail but Jeff Summers said the area as it exists is sparsely vegetated. MOTION: By Member Kennedy to close the public hearing for Notice of Intent 17-07 and issue an Order of Conditions for proposed construction at 137 Hull Street. SECOND: Vice Chair Pimpare VOTE: 5-0 Unanimous MOTION: By Member Kennedy to close the public hearing and approve Stormwater Permit 17-10 for proposed construction at 137 Hull Street. SECOND: Vice Chair Pimpare VOTE: 5-0 Unanimous Conservation Commission May 25, 2017 Meeting Minutes CERTIFICATES OF COMPLIANCE ISSUED: 63 and 63R Summer Street— NOI 13-29 Joseph and Shelly Mahoney 42 Deep Run — NOI 11-04 -Anthony Graziano 42 Deep Run - NOI 05-04—Anthony Graziano Andrea Buffum joined the meeting at 6:45 pm. 6:45 PM: SWP 16-27 Enforcement 3 Tad Lane, Tad Howe LLC Replanting Plan In attendance to represent agenda item: Paul Davis/Tad Howe LLC; Jeff HassettlMorse Engineering Documents presented: Revised Planting Plan dated_5/25/17 A'cease and desist' order had been issued on work outside the home.An Enforcement Order was issued requesting the applicant file an updated planting plan. Chair Vogelman asked to establish a time frame for the replanting plan and a completion date for this phase of the project. Paul Davis wants to start the work soon to take full advantage of the planting season. MOTION: By Vice Chair Pimpare to approve the revised planting plan dated 5/25/17 as presented for the restoration project at 3 Tad Lane. SECOND: Member Creighton VOTE: 5-0-1 (Andrea Buffum abstained-was not present for the complete discussion) MOTION: By Vice Chair Pimpare to issue and Enforcement Order for the completion of the restoration project as shown on the approved planting plan dated 5125117 at 3 Tad Lane and that said work be completed by Monday, August 21. 2017_ SECOND: Member Kennedy VOTE: 5-0-1 (Andrea Butfum abstained-was not present for the complete discussion) 7:05 PM: 71 Nichols Road —Tehranian — Discussion In attendance to represent agenda item: Susan Tehranianlownerr Jeff Hassett/Morse En ineerin Attorney Bruce Issadore; Ray Tehranian/owner Documents resented: Letter from Attorney Issadore to Jeff Summers and Conservation Commission The Commission has been waiting for a planting plan since January 2017, On April 26, 2017 an Enforcement Order was issued demanding a planting plan by May 11, 2017.Atty. Issadore had notified staff prior to 5/11/17 that the Tehranians had a family matter and couldn't comply and also that there was confusion on the part of his clients as to what was expected of them. Member Creighton said the language and instructions on the decision were very clear and specific and a planting plan should be provided within a reasonable time_ Chair Vogelman said the clear-cutting was not on the application but Atty. Issadore insists that all work done was shown on the plan. Mr.Tehranian wants a vegetable garden where the clear- cutting occurred but Member Creighton said this is the first the Commission has heard of this plan.. . MOTION: By Vice Chair Justin Pimpare to issue an Enforcement Order on property located at 71 Nichols Road for the submittal of an acceptable restoration plan to address issues discussed at the May 25 meeting; plan to be received by staff no later than Monday, June 12, 2017 and be revisited at the meeting on June 22, 2017. SECOND: Member Creighton VOTE: 6-0 CONTINUED TO JUNE 22, 2017 Conservation Commission May 25, 2017 Meeting Minutes 7:40 PM: SWP 17-08 and 17-09, 19 and 21 Heritage„Lane—Stratford LLC con'from 4/26/17 In attendance to represent agenda item: Jeff Hassett/Morse Engineering; Ma & Chris Fleming/Abutters Documents Presented: Landscapipq Plans from Kennedy's Country Gardens The most recent landscaping plan was presented at the meeting but not in time for Commission or staff review. The houses and drives have been reduced to decrease impervious surface. Per Jeff Hassett, trees that are shown on the current plan will remain on the property. Since the plan was only received by the Commission at the hearing there was no vote. It was agreed to do a site visit. CONTINUED TO JUNE 8 7:40 PM: NOI 10-14— Extend Order of Conditions—Greek Orthodox Church — 889 Jerusalem Road In attendance to represent agenda item: John Cavanaro/Cavanaro Consulting; Clark Brewer;Attorn@L Richard Henderson There are two OOC's on this property NOI 10-14 is an ATF filing for a gravel driveway. There is another OOC on the foundation and construction that expired. John Cavanaro is going to file a new application for completion of the construction project. 8:15 PM: RDA 17-03 —70 Black Horse Lane and Supper Island — Bridge Restoration In attendance to represent agenda item: Jeff Hassett/Morse Engineering, Jack Livingstone/JAK LLC applicant; Jeff Waal/Conservation Trust; Ted Lubitz/Gulf River Association; John Cavanaro/Cavanaro Consulting [representing Gulf River Association Documents resented: RDAApplication There are two bridges providing access to Supper Island that are in severe disrepair. There are trails on the island that need maintenance and a lawn area that needs to be mowed regularly. The improvements will restore the property to its historic condition. On behalf of the Gulf River Association, John Cavanaro is concerned with work within the buffer zone to a saltmarsh as part of an RDA because they don'tt require an Order of Conditions but it was pointed out by the Commission that a Negative 3 determination can be conditioned. Mr. Cavanaro requested a continuance to allow for a site visit prior to any approval. Richard Hendersonn Matt Shannon/owner; Deidre & Peter Hobson, Elaine & Cliff Breslow, Tom Bell,Amy Glasmeier, Kevin Heine, Kevin McKeon Documents presented: Revised Planting Plan for Slope Restoration Vice Chair Pimpare is not completely convinced that the plan as presented will restore the site to its previous condition and would like to see more variety including larger trees. He has concerns about the stability of the coastal bank with the vegetation as proposed_ Chair Vogeiman wants Eric Eisenhauer and Jeff Summers to visit the site and make recommendations towards larger trees.Abutter Kevin Heine asked if a landscape architect should be present;Atty. Henderson will reach out to Pressley Landscape Design. CONTINUED TO JUNE 8 9:10 PM: Diab Lane— Lots 3, 9, 15—SWP's - Matt Shannon In attendance to represent agenda item: A#ty. Richard Henderson; Josh Bows/Merrill Engineering: John Cavanaro/Cavanaro Consulting; Matt Shannon/owner; Deidre & Peter Hobson, Elaine & Cliff Breslow, Tom Bell Amy Glasmeier, Kevin Heine Kevin McKeon Documents presented: Cavanaro Consulting Response to Merrill Review Comments Dated 5/16/17; Complete Plan Set Requested revisions from Merrill Engineering and Cavanaro Consulting were discussed. Josh Bows wants more documentation regarding the "meets vs. exceeds" standards. John Cavanaro said they are exceeding Conservation Commission May 25, 2017 Meeting Minutes the standards because they are reducing the amount of flow and there is runoff being captured in a catch basin. Cavanaro provided a plan with accurately documented flow pads for pre-and post-construction for review by Merrill Engineering. Vice Chair Pimpare asked how can tree integrity be protected with elevation variations and proposed increase. John Cavanaro said they are doing minimal grading and will get revised plans to staff by Friday, June 2 at 11 a.m. Staff will forward to Merrill Engineering and Josh Bows will have his comments to staff by Tuesday, June 6 at the end of business. CONTINUED TO JUNE 8 New Business Under 48 Hour Rule: 10:16 PM: Discussion: 73 Atlantic Ave (formerly 70 Whitehead)---Enforcement -Sullivan The property owner is under an Enforcement Order to present a plan for removal of unauthorized fill. Information received this afternoon from Attorney Jim Lampke was brought up for discussion. Vice Chair Pimpare had spoken with counsel and presented a summary of the findings to the commission. It was decided to have the commission review the plans in depth and then send any comments to Jeff Summers to be relayed to Attorney Lampke representing the town and Attorney Nylan representing the owner..
