the removal
The Enforcement Order was in response to of trees and brush within a"no disturb" area on the
original plan. Brian Davis said much of the removal was dead trees, shrubs, and vines wrapped around wires.
The Commission felt the conditions of the SWP clearly indicated the"no disturb" area. Jeff Hassett presented a
restoration plan from Brad Holmes of Environmental Consulting and Restoration. The Commission wants to see
some larger trees included in the plan. Brian Davis said ledge in the area wouldn't be conducive to large trees
but Vice-Chair Pimpare suggested a berm with loam to anchor them. .
MOTION: By Vice Chair Pimpare to issue another Enforcement Order for Lot 36, 3 Tad Lane and
request the applicant to provide the Commission with a new restoration order showing
larger trees, a plan to bring in loam to support trees in ledge, a timeline showing the order
in which the project will be done and a robust planting plan submitted to Conservation
staff no later than Monday, May 8 at 8:30 am and to be presented at the May 11, 2017
meeting.

The original driveway for Howe Rd. ran through Lot 36/Tad Lane. The new driveway will be on Lot 37/Howe
Road with a mitigation plan in place to capture and disperse run-off.Abutter Tom Bell took issue with the fracking
plan and feels the runoff will eventually overwhelm the dry well_ Jeff Hassett felt that a 1000-ft. reduction in

impervious surface and increased capacity in the roof drywalls will handle the runoff. The Commission felt a 3ra
party peer review was in order for the site.
MOTION: By Member Creighton to conduct a peer review on the proposed driveway reconfiguration
for work being done at 3 Tad Lane, Lot 36 and Howe Rd, Lot 37.

Jeff Hassett said that runoff will be captured in a drywell and a swale and will be directed towards heavily
vegetated areas and away from abutting properties. There was no "before-and-after" planting plan so the
application was deemed incomplete. Jeff Hassett will have trees tagged and the area staked by May 19.

This is a request to approve the wetlands line as delineated by Brad Holmes: Jeff Summers found no
discrepancy at his site visit. The tagging was done in accordance with methodology accepted by the state.
MOTION: By Member Creighton to accept the wetlands delineation as depicted for property located
at Lot B, Holly Lane.

VOTE: 5-0-1 (Member Andrea Buffum recused herself)
8:30 PM: Discussion: 422 King Street--ATF NOI 14-36—Wetlands Violation-Siler

Documents presented to support agenda item: ATF NOI 14-36 Application and Order of Conditions
This NOI was the result of unpermitted work taking place in the wetlands area on the property_ The restoration
project has not been completed and the OOC will expire shortly. The owners agree to have the work completed
by the end of May.

OTHER BUSINESS: 71 Nichols Road: The Commission has been waiting since January 2017 for a requested
planting and restoration plan on this site where unauthorized clear-cutting was performed. The owners have
been contacted by Staff on several occasions and to date have not complied.
MOTION: By Vice Chair Pimpare to issue an Enforcement Order for 71 Nichols Road requesting the
owner to submit a planting plan by close of business on Thursday, May 11, 2017 an
request the owners appear before the Commission on Thursday, May 25, 2017.
SECOND: Member Graham
VOTE: 6-0 Unanimous
With no further business to discuss, motion was made and seconded to adjourn at 9:30 pm.
