At the meeting on 2/2117 the Commission voted to solicit a 3ro party consultant to conduct an independent Peer Review. Five firms submitted proposals and Merrill Engineering of Hanover was selected. Josh Bows of Merrill presented his findings. Among many other things, he stated that several plans were missing for the submittal. He asked that the impervious surfaces be more clearly depicted on the plans; that run-off patterns need additional calculations to ensure the provisions on the plan do not have a negative impact on the abutters; that more information is needed on ledge removal; and that slab elevation relative to groundwater and direct discharge be addressed. He also stated that test pits were missing and should be performed. It was agreed by all parties that test pits should be done to examine the subsurface conditions more thoroughly. The applicant will conduct the test pits and will coordinate a time with Merrill Engineering to observe and notify Conservation staff 48 hours prior to testing_ Abutters were told that due to Conservation Commission Minutes March 30, 2017 liability issues they would not be allowed on the construction site but can observe the testing from the road. Applicant agreed to revise the report based on the findings of test pit data and submit such report to staff by April 14, 2017 Merrill Engineering will review and provide comments to the revbised report by April 21, 2017. Hearing is continued to April 27, 2017 at which time. Revised versions reflecting the findings from Merrill Engineering will be presented by Cavanaro Consulting along with results from the test pits. Approval of Minutes March 2, 2017: Motion to approve by Member Kennedy, 2nd Member Graham, 3-0 (1 abstention) March 16, 2017: Motion to approve by Member Kennedy, 2nd Member Graham, Vote 4-0 unanimous It was decided to cancel the meeting on April 13 as it was determined there would not be a quorum. All agenda items will be rescheduled pending availability of Conservation commissioners, applicants and their representatives. Staff will notify all involved. 48-Hour Rule: 73 Atlantic (formerly 70 Whitehead —Sullivan A plan to remove the portion of fill in the buffer zone and stockpile it in another location on the site has been presented to staff. The proposal says "restoration plan" but the commission requested that "restoration" be replaced with "removal'. Agent Summers said that since the Stormwater Permit for the site has been violated, all fill needs to be removed. The owner needs to submit a plan addressing fill removal from the entire property and not just wetlands. Agent Summers also suggested an independent Peer Review for the removal plan before any restoration plan can be submitted. MOTION: By Member Creighton to issue an Enforcement Order with a condition that the applicant submit a full Fill Removal Plan by April 13,2017. SECOND: Member Graham VOTE: 4-0 Unanimous Motion to adjourn at 9:20 made by Member Kennedy, seconded by Member Graham and voted 4-0.
