The Land Alteration article would regulate the process of clear-cutting and other site alterations on new
construction by requiring a Special Permit from Planning. Exceptions could be made for homeowners doing
small projects. Minor adjustments were made to the original article. Scenic Roads would establish criteria for
projects conducted on designated roadways to maintain the historic and aesthetic nature of those roads.
-MOTION: By Member Creighton that the Conservation Commission vote to recommend for
approval at Town Meeting the proposed Land Alteration Regulations.

VOTE: 6-0 Motion Passes
-MOTION: By Member Creighton that the Conservation Commission vote to recommend for
approval at Town Meeting the Scenic Road Regulations with amendments to the following
paragraphs: 11.3H, 11.4A, 11.7 Section A,B,C and 11.9.

The applicant wants to open a food establishment. Renovations will be done to the exterior and impervious
surface reduced by over 1200 s/f by replacing asphalt area with grass. The area near Bound Brook will be
cleared of trash and debris. Straw waddles and a silt fence will be used during construction.
-MOTION: By Vice-Chair Pimpare to close the public hearing for N01#7-03 and approve a variance
for work within the 50' buffer zone at 827 CJC Highway with the following special
conditions: all flecking material used be made of composite or non-pressure treated
wood; no mechanical equipment in the area of wetlands; planting plan be performed in
accordance w CC approved planting plan; enhanced siltation barriers be installed during
construction in the area of Bound Brook.

w CC approved planting plan; enhanced siltation barriers be installed during construction
in the area of Bound Brook,

Letters of Support from 3 Abutters
The new owners want to make adjustments to a previously approved plan from October 2016 by extending the
house by 8-ft, reconstructing the garage and moving it away from the coastal bank, and significantly reducing the
impervious surface by replacing the existing paved driveway with crushed stone.Adequate siltation barriers will
be in place to protect Little Harbor.
MOTION: By Member Kennedy to close the public hearing for NOI 17-04 and issue an Order of
Conditions for work proposed at 88B Beach Street with the following special conditions:
planting be done in accordance with species recommended by the Conservation
Commission, and the applicant develop a construction debris management plan suitable
to Conservation Agent Jeff Summers.

proposed within the buffer zone at 88B Beach Street with the following special
conditions: planting be done in accordance with species recommended by the
Conservation Commission, and the applicant develop a construction debris management
plan suitable to Conservation Agent Jeff Summers.

MOTION: By Member Kennedy to close the public hearing and issue Stormwater Permit 17-05 for
proposed work at 88A Beach Street.

Documents Presented to Support Agenda Item: Current Site Photos taken by abutters; Stormwater
Applications for Parcel 36&37• Stormwater Calculations from Morse Engineering
There is evidence that clear-cutting was performed outside of the tree line which the Commission feels was
clearly delineated on the approved plan. The abutters presented photos of work that was done. Tom Bell asked
why the project was approved without a Large Home Review from Planning. Jeff Summers will look into that.
Deidre Hobson said there is an increase in stormwater runoff and agreed to Member Creighton's request that
she file an affidavit confirming this information. it was the will of the Commission to bring the developers in on
April 13, 2017 and in the meantime have the agent serve them a Notice of Violation with fines of$100 per day
and issue a Cease & Desist for all site work being done outside the footprint of the home itself. Jeff Hassett
expects to file an After-the-Fact Amended SWP but Chair Vogelman said the conditions were clearly stated and
the damage is egregious.

MOTION: By Vice-Chair Pimpare to issue a Cease& Desist order to Tad Howe LLC for all site work
being done outside the footprint of the home as per site plan.
SECOND: By Member Koines
VOTE: 6-0 Unanimous
MOTION: By Vice-Chair Pimpare to issue and Enforcement Order that requires the applicant to have
a restoration plan filed by March 20, 2017 with staff and be required to present the plan at
the April 13, 2017 Conservation meeting for comments.
SECOND: Member Creighton
VOTE: 6-0 Unanimous
OTHER BUSINESS:
The following documents were signed by the Commission:
• Order of Conditions for 401 Jerusalem Road/Muriey for an After-the-Fact NOI 17-02
• Enforcement Order for 589 Jerusalem Road/Shannon
• Certificate of Compliance for new construction at 46 Stockbridge St
• Certificate of Compliance for new construction at 114 Forest Ave
The Trustees of Cohasset Reservations asked Jeff Summers to see who wants to represent the Commission in
the management of Turkey Hill. Jack Creighton offered to do it.
MOTION: By Vice-Chair Pimpare to designate Member Jack Creighton as representative to the
Trustees of Cohasset Reservations.
SECOND: By Chair Vogelman
VOTE: 6-0 Unanimous
48-HOUR RULE: 73 Atlantic (formeriv 70 Whitehead —Fill Removal
The Commission has so far rejected the 2-step plan presented by the applicant's representatives as not being
specific enough. Chair Vogelman suggested to go with the 2-step plan just to get it started but Vice-Chair
Pimpare wants to bring in the developer before going forward.Attorney Lampke has asked the Commission to
decide on the wording for the enforcement plan for him to review. Jeff Summers will prepare a draft to present for
approval for the Commission and Town Counsel.
With no further business motion to adjourn at 10:15 pm was made, seconded and approved unanimously.
