The following minutes were approved: 8/18/16; 9/22/16; 12115/16, 115117 MOTION: By Member Kennedy to approved the minutes for 8118/16, 9/22/16, 12/15/16 and 1/15117. SECOND: By Member Graham VOTE: 6-0 Unanimous Minutes will be posted on town website. 7:05 DIAB LANE: #3 SWP 16-36 #9 SWP 16-37 #15 SWP 16-38 RDA 16-24—Shannon cont from 12/15/16 In attendance to represent a enda item: Matthew Shan nonlapplicant; Attorney Richard Henderson; John Cavanaro and Carmen Hudson —Cavanaro Consulting; Pressley Associates: John Meyer, David McGwan, Marion Pressley,Jim Pardy; Abutters Deidre and Peter Hobson,Amy Glassmire,Tom Bell, Kevin Heine; Elaine Breslow; Dennis Newman Documents presented to support agenda item: SWP and RDA Applications; Planting Plans for 3, 9 and 15 Diab Lane; Original and Revise Site Plans; Letter and Photos from Abutters; Carmen Hudson said the planting plans from Pressley Associates showed trees in ledge being preserved which increases the impervious surface from what she originally calculated so the proposed paved driveways will now be pervious. Member Creighton wants a third party brought in for an independent review. The Commission is in agreement. Amy Glassmire asked about new owners increasing the impervious surface but Member Kennedy said that would be a violation of the SWP and lead to enforcement. Chair Vogelman asked about significantly reducing the flow to "match or reduce" existing conditions_ Carmen Hudson said the stormwater requirements for reduction have been met but adjustments could be made regarding pervious surfaces. Chair Vogelman was not sure where water comes from and isn't convinced a pervious driveway or french drain can solve the problem. It was decided to solicit the services of a third party consultant to review the calculations. Carmen Hudson asked if there could be a vote on the RDA application for 15 Diab Lane. Jeff Summers said 100' buffer delineation based on MA GIS Wetlands Survey is fairly accurate and doesn't see how a move of 10'either way could have impact MOTION: By Vice Chair Pimpare to close the public hearing on RDA 16-24 and issue a Negative 2 determination for proposed work at 15 Diab Lane. SECOND: By Member Graham VOTE: 7-0 Unanimous MOTION: By Vice Chair Pimpare to solicit proposals for a third party independent engineer to Cohasset Conservation Commission February 2,2016 Meeting conduct a stormwater review to be paid for by the applicant for 3, 9 and 15 Diab Lane. MOTION: By Member Kennedy to close the public hearing and issue Stormwater Permit 17-01 for proposed work at 33 Tower Lane by Malcolm Nicholls, applicant. Henderson asked to continue due to a lawsuit on the property pending in Land Court but Town Counsel Rick Hucksham had advised that municipalities don't get involved with land court issues. The home is very close to an abutting property. There are concerns with proposed demolition and removal of materials. The work as proposed does not impact the land involved in the pending lawsuit is not affected by the proposed construction. MOTION: By Vice Chair Pimpare to close the public hearing and issue an Order of Conditions for NOI 17-01 with the following conditions: a 72-hour notice must be given prior to any demolition work for Conservation Agent Jeff Summers to observe; the siltation barrier must be secured to existing fencing for added stability; the applicant must make preconstruction plans available to the Conservation Agent.
