Vice Chair Pimpare assumed the Chair in Patrice Vogelman's absence. 6:35 PM 465 Jerusalem Rd - Extension OOC NOI 13-19 In attendance to represent agenda item: Attorney Richard Henderson; Jean Lennon/mother of applicant; Andrew Muirtabutter Documents to Support Agenda Item: 3 letters from Attorney Henderson. Formal Request for Extension dated 11130/16; Denial Letter and Copy of Application dated 9119/16. Outline of Pro'ect History dated 12/15/16 RH said circumstances prevented work being done. During 2013-14 the existing tenants did not want construction going on while living there so work was suspended. The Commission asked if the applicant would be willing to file a new RDA or NOI. RH said nothing has changed since the initial application. In accordance with the Cohasset Wetlands Regulations Section 2,A.5 the deadline for an extension request is no earlier than 90 and no later than 30 days prior to the expiration of the OOC. The applicant applied for an extension outside of this time frame. MOTION: By Member Creighton to deny the extension request. SECOND: Member Buffum (Member Kennedy wanted to include an explanation but Chair Pimpare stated the extension request was filed outside of the timeframe and no further explanation was necessary) VOTE: 4-2--(Members Kennedy and Graham in minority) 6.55 PM: 734 CJC Highway Gulf Station RDA 16-23-Septic upgrade In attendance to represent agenda item: Jack O'LearWSITEC Environmental Documents to support agenda Item: Letter from SITEC Environmental dated 11/30/16 This is a currently failed system. The existing tank will remain with a grease trap, pump chamber and new leaching field. MOTION: By Member Kennedy to close the public hearing and issue a Negative 2 determination on RDA 16-23 for a septic upgrade at 746 CJC Highway. SECOND: Member Graham VOTE: 6-0 Unanimous Cohasset Conservation Commission December 15,2016 Meeting 7:10 PM: 140 Beach StlZild'ian RDA 16-22 -Wall re air Andrew CollinslCraigie Zildiian_ The applicant wants to repair and extend the existing wall along the driveway. The wall is approximately 10' from a resource area and there were concerns by the Commission on impacts to the resource area as a result of the new construction. MOTION: By Member Kennedy to close the public hearing and issue a Negative 3 determination for RDA 16-22 with a condition that the RDA does not include any new construction of the wall within the resource area for property located at 140 Beach Street. SECOND: Member Graham VOTE: 6-0 Unanimous 7:30 PM: 390 South Main SVStevenson RDA 16-20-Landscape and Hardscape Upgrade In attendance to.represent agenda item: Frank SnowiFS /contractor; Gordon Stevenson/applicant The driveway slopes towards the house and water builds up. FS wants to put in a French drain for run-off, add pavers and crushed stone, and install a new patio.All work is outside the 50' but within the 100' buffer zone. MOTION: By Member Kennedy to close the public hearing and issue a Negative 2 determination for RDA 16-23 for property located at 390 South Main Street. Invasive species will be removed by hand and replace with native species and grasses.The driveway is being reconfigured out of the buffer zone and impervious area will be decreased. MOTION: By Member Creighton to close the public hearing and issue the Order of Conditions for Notice of Intent 16-27 with the condition that no herbicides or mechanical equipment be used to remove plantings in the resource areas and that removal of invasive species be done by hand. SECOND: Member Koines VOTE: 6-0 Unanimous MOTION: By Member Creighton to grant a variance on NOI 16-27 for work being done within the 50' and 100' buffer zones at 123 Atlantic Avenue. Impervious surface is reduced by 69 s/f. Abutter Rutledge would like noise and privacy controls, runoff controls and a pre-blast inspection if needed, Jeff Hassett said no runoff is directed towards Rutledge's property and that hammering rather than blasting will be used for ledge removal. MOTION: By Member Kennedy to close the public hearing and approve the Amended Order of Cohasset Conservation Commission December 15,2016 Meeting Conditions on Notice of Intent 16-05 for proposed work at 121 Nichols Road. Jeff Summers verified the lot lines with Assessors and stated that some of the proposed plantings appear to be on the neighbor's property. The applicant was asked to come back with a revised application and were advised that the neighbors may have to be involved if it impacts their property. Sean Papich said he didn't anticipate removal of invasive species and that some work would be done within a coastal bank. Mr. Papich stated the contractors were "a little aggressive" in their actions. Acting Chair Pimpare requested a newAfter- the-Fact NOl filing for work within the buffer zone to a resource area and coastal bank should be filed and the Commission would not rule out future enforcement action if deemed appropriate. MOTION: By Member Kennedy to resolve the Cease & Desist on work done without permitting by requiring the applicant to file an After-the-Fact Notice of Intent no later than 4 pm Thursday, February 16, 2017 and appear before the Commission on Thursday, March 2, 2017. The foundation will be pinned and requires no drilling. There was significant discussion on stormwater mitigation. JP raised concerns about the proximity of the driveway to the coastal bank. To accommodate this, the amount of impervious surface will be reduced; only one deck will be added; and a drywell system will be installed for roof runoff. Jeff Summers stated that with these updates, the impervious surface is under the 500 s/f threshold so the SWP can be withdrawn. The gutters will be on the garage and will feed the drywell to control runoff. Proposed drives will have catch basins that capture runoff from and flow in to infiltration systems, however, there is no capture of runoff from the dwellings. PK wants a tree legend to see what remains as it is not shown on the original application; JP wants a revised planting/removal submitted for the commission to review prior to the next hearing on 2/2/I7. The abutters have several concerns with the scope and potential impact of the project as there is already a significant amount of runoff to Howe Road. Applicants agreed to continue the hearing and agreed to flag the three house lots as well as flag all trees on the property that would be remaining. In addition, applicants would be submitting a full landscaping plan outlining trees that would be removed and remain on the property. CONTINUED TO FEBRUARY 2, 2017 AT 7:05 PM. 10:10 PM: 83 Spring St Con't NOI 16-25 and SWP 16-30 In attendance to represent agenda item: Greg Morse/Morse Engineering; David Wonla licant• Michael Milanoskilabutter• On November 22, 2016 the Commission unanimously denied a variance (work within the buffer zone to a resource area) as part of this NOI. The applicant presented to the Commission a revised plan and is requesting an order of conditions and SWP. Among other issues, the Commission raised serious concerns about the stability of the existing driveway during the construction phase as well as the future upkeep of the driveway. MOTION: By Member Creighton to deny the issuance of an Order of Conditions on NOI 16-25 for the proposed work at 83 Spring Street. SECOND: Member Graham VOTE: 5-1 (Member Kennedy in minority) With no further business a motion was made and seconded to adjourn.
