Meeting called to order at 7:10 PM.
APPROVAL OF MINUTES FOR 11 3 16
MOTION: By Vice Chair Pimpare to approved the minutes for November 3, 2016.
SECOND: By Member Graham

DISCUSSION: REPLICATION PLANTING
Eric Eisenhauer is creating a list of commercially available plants that are native to this area for
replication purposes. He is working with local botanists and Holly Hill Farms for their input. He will have
a formal presentation for the mid-January meeting.

JP is concerned with the proximity of the project to the coastal bank and wants assurances that fill used
for the new driveway will be clean fill.The driveway will be asphalt because of the steep slope and
runoff will go downhill towards the existing turnaround. Commission requesting clarification of runoff
flow,tree removal count and calculation of fill amount.

Documents Presented for Agenda Item:Stormwater Assessment; Invasive Plant Management; RDA
Application
Applicant wants to remove invasive species and do trimming. Michael Talbot said removal with mower
or other mechanical methods will not get desired results due to rubble on the property and the large
size of the infested area and recommends spraying with an organic material.The portion of work within
the 100' buffer zone will be done by hand-cutting only.
MOTION: By Member Kennedy to close the public hearing and issue a Negative 3 Determination
on RDA 16-15 for 555 Jerusalem Road with the condition that no chemical herbicides
be used with 100' of the edge of conservation resource areas within our jurisdiction.
SECOND: By Member Graham

7:50 PM: 53 Old Coach Rd—Carcio RDA 16-19, SWP 16-33 -Addition and Patio Expansion

Package
This project involved an addition, two new rear decks and patio expansion. Abutter Czerkanski is
concerned about increased impervious area causing erosion on the property line and affecting the
applicant's leaching field.The engineer and contractor indicated there will be gutters directing water to
a natural dip on the site and that sand will be brought in to facilitate ground absorption. An interceptor
trench for extra capacity could also be installed between the two properties. PV and JP asked for a
revised plan showing runoff mitigation.

Trees within conservation jurisdiction have been removed. Owner agreed to mitigation planting of 3
trees between 3' and 4' in height to rear of property.
MOTION: By Vice Chair Pimpare to close the public hearing and issue a Negative 2 determination
on RDA 16-18 for property at 28 Bow Street.
SECOND: By Member Graham
VOTE: 6-0 Unanimous
8:25 PM: 83 Spring St—Won—NOI 16-26 and SWP 16-30 continued

There is a major concern with the driveway expansion as proposed having negative impact on the
wetlands during construction. Applicant is requesting a variance to do work within the buffer zone.
MOTION: By Chair Vogelman to deny the request for a variance on NOI 16-26 for work to be
conducted within the buffer zone at 38 Spring Street.
SECOND: By Member Graham
VOTE: 5-0 Unanimous (Vice Chair Pimpare left prior to this hearing)

Greg Morse asked for clarification on the motion and was told only the variance was denied. He
requested a continuance on the NOI and SWP.

9:00 PM:73 Atlantic(70 Whitehead)—Enforcement Discussion -continued
In attendance to represent agenda item:Attorney Jim Lampke;Attorney Richard Nylen
Atty. Nylen wants to remove part of the fill before razing and removing the existing home out of the
buffer zone,then filing an application for construction of a new single family dwelling and to remove the
remainder of the fill.Attorney Lampke (as counsel for the town) asked that all fill be removed before
filing an application for new construction and to keep the issue of fill removal separate from potential
filings for further work on the site. Members Creighton felt all fill should be removed prior to any further
work on the site but other commissioners were amenable to a 2-tier process. Jeff Summers asked if a
restoration plan could be in place prior to any work. Owner will need to file an NOI for the first stage of
fill removal.The Commission wants to impose deadlines for filings and work. Atty. Nylen will have Tier 1
prepared by the end of 2016 and will have the NOI for Tier 2 in time for a January meeting.
Other Business
A Certificate of Compliance on NOI 14-40 for new construction at Lot 1/333 Beechwood Street
requested by Dustin Wheelwright was approved.
With no further business to discuss, meeting was adjourned at 10:25 pm.
