HomeMy WebLinkAboutMinutes - CC - 11/03/2016 Conservation Commission Minutes November 3, 2016 APPROVED MINUTES COHASSET CONSERVATION COMMISSION DATE: Thursday, November 3, 2016 TIME: 7:00 PM PLACE: Cohasset Town Hall, Basement Meeting Room IN ATTENDANCE: Patrice Vogelman (PV), Chair Justin Pimpare (JP), Vice Chair Andrea Buffum (AB), Secretary/Treasurer Alexander Koines (AK), Member Edward Graham (EG), Member Jack Creighton (JC), Member Patrick Kennedy(PK), Member Chris MacFarlane (CM),Associate Member Jeff Summers (JS), Conservation Agent ABSENT: Eric Eisenhauer,Associate Member Meeting called to order at 7:05 PM. 7:00 PM:Approval of Minutes The following sets of minutes were approved: 2111116, 2125116, 417116, 515116, 5119116: Motion to Approve PV, Second JP Vote 7-0 5125116, 6122116— Motion to Approve JP, Second AB,Vote 6-0 (1 abstention/PK) 7121116, 918116, 10120116: Motion to Approve JP, Second EG--Vote 7-0 7:15 PM SHOW CAUSE SPREADSHEET UPDATE: JP reported that considerable progress has been made. . 7:20 BY LAW REVIEW -Vote needed on Town of Cohasset Bylaw amendment which Conservation Commission proposes to Town Meeting On November 28'h. Based on MA General Law,Attorney Lampke recommended bylaws around non-criminal disposition be updated to specific amounts instead of the non-specific terms currently in use, such as "up to" and "not to exceed". . MOTION: Made by Vice Chair Pimpare to approve the amendment to the Town of Cohasset Cohasset Bylaws. Specifically, to recommend to Town Meeting to make amendments to the General Bylaws Article 1, General Provision, Section 1(h) and Article XIV Wetlands Protection, Section 10, Enforcement. SECOND: By Member Graham VOTE: 7-0 Unanimous 7:30 PM —28 Bow Street RDA 16-18 Stazsko There was no one in attendance to represent the agenda issue and no proof of abutter notification. Motion was made by PK and seconded by EG to continue the Public Hearing on 28 Bow Street to 11/17/16 at. 8:15 PM. Vote was 6-1 with Member Creighton in the minority due to lack of evidence on abutters notification. HEARING CONTINUED TO 11/17/16 AT 8:15 PM 7:40 PM--81 DOANE ST RDA 16-17 -81 Doane LLC -Septic Upgrade In attendance to represent agenda item: Greg Morse, Documents presented at meeting:Abutter Notification This is to replace a cesspool that failed Title 5. There will be minor grading 10' into the buffer zone for the leaching area but the system components are all outside of the 50'buffer zone. Conservation Commission Minutes November 3, 2016 MOTION: By Member Kennedy to close the public hearing and issue a Negative 2 determination for the proposed septic upgrade at 81 Doane Street. SECOND: Member Graham VOTE: 7-0 unanimous 7:50 PM 83 SPRING ST - NOI 16-25& SW 16-30 -New Construction -Won In attendance to re resent a enda item: GregMors elMorse En ineerin • David Won/Applicant Robert Ross Mike Milanowski JennF Milanowski abutters Documents Presented at Meetiin :A fications for NOI and SWPIMorse Engineering; Alternative Plans and CalculationslMike Milanowski The applicant wants to raze and reconstruct an existing home.A pre-existing driveway exists next to a Bordering Vegetated Wetland and intermittent stream. Morse plans for 6 infiltration dry wells and a grass depression to absorb runoff but the commission had concerns with the proximity to the BVW and the possibility of additional usage moving gravel from the drive into the wetlands as well as the proposed expansion of the driveway, which would encroach on the wetland area.. The property is within the flood plain and abutters have concerns with runoff, tree removal and any blasting being done to remove ledge. PK has concerns with the wetlands delineation and JS felt the flags should be further south on the property. SITE VISIT SET UP FOR MONDAY, 1117 AT 8:00 AM. HEARING CONTINUED TO 11/17 AT 8:25 PM 8:20 71 NICHOLS RD--DISCUSSION ON TREE REMOVAL AND RI=PLICATION In attendance to re resent agenda item: Susan and Raymond Tehranian/owners• Andrew Swanson/Cohasset Tree Warden; Pam Ehriander/Abutter PV said that trees shown on the permit are not found on site so there is non-compliance with the SWP. Pre-and post-development plans are identical for tree placement but there has been obvious clear-cutting done. Susan Tehranian said trees were removed to allow for utility access. JS said the plans presented showed existing and proposed vegetation and it was inferred that trees shown on both sets of plans would remain. Mr and Mrs. Tehranian agreed to provide a replanting plan in a January time frame. JS will work with the Tehranians on replication. OTHER BUSINESS: Patrick Kennedy nominated himself to be Conservation Commission's representative to the Master Plan Committee. No formal vote was taken on this issue. A Certificate of Completion was issued on NOI 11-29 to Paul Ognibene for dock work at 44 Beach Street. With no further business, motion to adjourn was made, seconded and approved at 9:30 pm.
