COHASSET CONSERVATION COMMISSION

Meeting called to order at 6:00 pm. Commission voted unanimously to enter into Executive Session to discuss 70
Whitehead Road with Attorney Jim Lampke regarding enforcement and violations on this property. .
MOTION: Made by Member Jack Creighton to go into Executive Session.
SECOND: Member Edward Graham
ROLL CALL VOTE: Vogelman, Pimpare, Koines, Creighton, Buffum, and Kennedy in favor 6-0
Executive Session closed at 6AS PM.

7:05 PM -55 Beach St—Cease & Desist—A-T-P—Guy Daniello owner
The homeowner hired a landscaper to do work in his yard and was unaware of any wetlands on his property.The
work was done without proper permitting. Mr. Daniello did admit that he encroached on neighboring property but
the owner of that property, Carla Getto, had no problem with what was done. Mr Daniello was instructed to file an
After-the-Fact Notice of Intent for work within the 50' buffer zone.
7:15 PM- 47 Lothro Lane—Discussion
JP stated that both parties—the Naimis and the Jordans—have retained legal representation.The Jordans asked for a
continuation to give their lawyers time to prepare for the discussion. Discussion continued to Thursday,August 18.
7:15 PM - Show Cause Tracker Update
We are down to 13 unresolved properties down from 26. We have 70 Whitehead (ongoing with enforcement); 589
Jerusalem Rd (Templar—ongoing); 544 Jerusalem Rd (filed an ATF SWP for clearcutting hillside (site restoration was
completed but not verified by agent).
28 Bow Street/5tazsko—The Commission requested an After-the-Fact RDA but to date none has been filed.There is a
question as to whether 3 or 8 trees were removed.JS does not agree with the tree count given by Paul Shea.JS will
visit the area with JP to see where the trees were cut and then send a letter to the owners concerning the RDA.
28 Otis Ave/Avers—There was evidence of unauthorized removal of vegetation and fragmites within the buffer zone.
To date no RDA has been filed. Property is located in both Cohasset and Scituate.JS will send letter to owner.
153—163 Sohier St—1.53 is a bank-owned property.The owners were evicted. Cease and desist orders were issued to
both properties.JS will see if the home is vacant as there were outstanding issues on this property with Conservation.
47 Lothrop—being discussed on August 18.
Vacant Lot--55 Beach St: Per discussion with the owners(Beach St Builders)the property is to be restored by 2017
and will be followed up at the time.

604 Jerusalem Rd—Staff sent a certified letter to the owners asking them to appear before the Commission on August
18 at 8 pm for an After-the-Fact discussion regarding possible unauthorized tree removal.The owners refused to
appear at tonight's meeting.JP has been dealing with the Brewers. (Follow up note:Staff member Angela Geso who
was not present at the 7/21 meeting received a signed return receipt from the Brewers so they are aware that they
have to appear on August 18 at 8:00 pm)
Certificates of Compliance to be Signed:
37 Elm Street—O'Halloran—JS noticed an additional 300 s/f of impervious surface that straddles the neighbor's
property where concrete wasn't removed. Commission decided the owner has no control over his neighbors so they
agreed to sign.
31 Nichols Road—garage addition and extra mitigation plantings which are in place.JS was fine with this.
19 Border St/Wimberly—Demo'd and rebuilt SF dwelling.JS has no issues.
294 South Main St/Coleman—peastone walkway put in to allow access to Gulf River for kayaking.JS has no issues.
8:00 PM - Lot 9 Jerusalem Lane—NOI 16-17 SWP 16-20—New Construction-Davis continued from July 7 2016

The Commission requested at the prior hearing that the resource areas and buffer zone be staked out.JP and JS
verified this had been done.JH presented revised plans tonight showing new delineation.There is no work within the
50' buffer zone but some within the 100' buffer zone.There were concerns about the lot coverage and stormwater
runoff. Morse presented a revised plan that adds more mitigation, reduces the amount of impervious surface and
adds an underground chamber to further capture runoff.Any ledge removed will be replaced with loam and brought
up to the current elevation.The footprint of the house increased but the garage was eliminated.There is a walk-out
basement under half the home. Abutters Carl and Sandy Forsythe were satisfied with the revisions.
MOTION: Made by Member Patrick Kennedy to close the public hearing and issue an Order of Conditions for
the project work proposed at Lot 9,Jerusalem Lane.

8:30 PM-555 Jerusalem Rd—RDA 16-15—Millerd—will be continued—no date set yet.JS is working the the Millerds
to facilitate a further hearing.
With no further issues, motion to adjourn at 8:35 pm made, seconded and unanimously approved.
