HomeMy WebLinkAboutMinutes - CC - 07/07/2016 (2) Conservation Commission July 7, 2016 APPROVED MINUTES COHASSET CONSERVATION COMMISSION DATE: Thursday,July 7, 2016 TIME: 7:00 PM PLACE: Cohasset Town Hall, Basement Meeting Room IN ATTENDANCE: Patrick Kennedy(PK), Chair Patrice Vogelman (PV),Vice Chair Alexander Koines(AK), Member Justin Pimpare(JP), Secretary/Treasurer Jack Creighton (JC), Member Edward Graham (EG), Member Jeff Summers(JS), Conservation Agent Eric EisenhauEr,Alternate Chris McFarlane, Alternate ABSENT: Andrea Buff um (AB), Member Meeting called to order at 7:00 PM. 7:00 PM - reorganization of Board The Commission reorganized as follows: Patrice Vogelman—Chair (Motion by Creighton, Second by Koines, Unanimous) Justin Pimpare—Vice Chair(Motion by Koines, Second by Creighton, Unanimous) Andrea €3uffum—Secretary/Treasurer(Motion by Vogelman, Second by Graham, Unanimous) Alex Koines—Community Preservation Designee(Motion by Creighton, Second by Graham, Unanimous) 7:00 PM—47 Lothro Lane -Naimi/Jordan= Discussion LContinued to 7121116 Prior to tonight's hearing, both parties requested and agreed to a continuation to consult with attorneys. 7:00 PM: Show Cause Policy Update A Show Cause Tracker has been designed to track outstanding projects,facilitate their completion and follow up on any cease-and-desist or enforcement orders. Under the new fee structure, applicants are charged$150 up front for a Certificate of Completion on every Notice of Intent filing to encourage them to contact staff when the job in complete for a final inspection. Outstanding projects 3 years or older will be looked into to see if work is complete or needs a continuation. JS can sign off Stormwater Permits at his discretion but NOI's will require commission review and recommendation before receiving a Certificate of Completion. 7:50 PM - 55 Beach Street—Cease&Desist—Daniello (Moved to 7121/16) Owner would not be available and requested hearing be moved to the next meeting date. 8:00 PM—Lot 9,Jerusalem Lane—NOI 16-17, SWP 16-20—New Construction -Davis In attendance to represent agenda item; Jeff Hasset(Morse;Art Davis and Jim Leonardiowners;Jen Thomas and Sandy Forsythe/abutters This is new construction on a previously undeveloped site.There will be no grading and any trees cut down within the buffer zone will be replicated 2-to-1.Abutters expressed concern over additional runoff,the amount of impervious surface and the size of the home on what is a small lot. It was suggested that a site visit be conducted by the commissioners. PV asked JH to delineate the edge of the saltmarsh. HEARING CONTINUED TO 7/21/16 8:30 PM—711 Jerusalem Road—NOI 16-16, SWP 16-19—Meade In attendance to represent agenda item:Jeff Hassett fJH1lMorse Engineering;Tom Meadelowner; Art Conservation Commission July 7,2016 O'Keefelabutter Vice Chair Pimpare and Member Graham recused themselves as abutters. This filing is a request to raze and rebuild the current home to bring it out of the flood plain. Mr. O'Keefe asked if there would be any tree removal near his property line and was told by JH there would be none. MOTION: By Member Kennedy to close the public hearing for NOI 16-16 and issue an Order of Conditions for proposed work at 711 Jerusalem Road. SECOND: Member Creighton VOTE: 4-0 (2 recusals) MOTION: By Member Kennedy to issue a variance for work within the 50' buffer zone for proposed work at 711 Jerusalem Road. SECOND: Member Creighton VOTE: 4-0 (2 recusals) MOTION: By Member Kennedy to close the public hearing and issue SWP 16-19 for proposed work at 711 Jerusalem Road. SECOND: Member Creighton VOTE: 4-0 (2 recusals) 9:00 PM—555 Jerusalem Road—RDA 16-15—Tree Removal -Millerd In attendance to represent agenda item: Michael TalboVConsultant Michelle Millerdlowner This is a request to remove overgrowth of invasive species on the site.There is an outstanding After-the-Fact SWP for this property which PV would like to resolve before issuing any new permits. The owner said the SWP was closed out by her landscaper but staff had no evidence of this being done. HEARING CONTINUED TO 7121116. 9:15 PM—49 Pleasant Street RDA 16-14—Purdy In attendance to represent agenda item: Purd lowner The owner is having an in-ground pool installed.The location was moved out of the buffer zone and within the setback requirements. MOTION: By Vice Chair Pimpare to close the public hearing and issue a Negative 3 determination for RDA 16-14 subject to the condition that prior to starting any work a revised site plan be submitted showing the pool out of the buffer zone to a Bordering Vegetated Wetland for proposed work at 49 Pleasant Street. SECOND: Member Graham VOTE: 6-0 Unanimous New Business: Show Cause and Enforcement Discussion Once a complaint is received regarding work being done without a permit or in violation of our bylaws, a `cease and desist'should be immediately issued and the owner/applicant needs to appear before the commission. If the owner/applicant takes no action an enforcement notice will be ratified and issued.Jeff Summers and Patrice Vogelman will work with Attorney Jim Lampke to establish a strong enforcement standard.
