COHASSET CONSERVATION COMMISSION

Meeting called to order at 7:00 PM.
7:00 PM -James Brook Tidal Gates—RDA 16-13—Town of Cohasset DPW
In attendance to represent agenda item: Mike Clark/Engineer with Desi-cin Consultants
With the current tidal gate, DPW uses a generator to control function when power goes out. The new tidal
gate will function by pressure when the water reaches a certain level and will not need a generator.
MOTION: By Vice Chair Vogelman to close the public hearing for RDA 16-13 and
issue a Negative 2 decision for work done at the James Brook Tidal Gates.
SECOND: By Member Koines

7:30 PM -336R North Main Street—Barnes--Discussion continued
In attendance to represent agenda item: Vicky Barnes Williams/Owner• Nicole Engels/Abutter;
The commission performed site visits and found no activity within their jurisdiction. Abutters claim that
conditions have changed resulting in an increase in runoff. Vicky Williams said she never had a problem
with wafter until Powers Lane was developed. After due discussion it was suggested that all parties work
together to resolve problems with runoff in that area but the commission is taking no action on this issue.
7:45 PM -27 Ox Pasture Rd—NOI 16-13 -- Retaining Wall Upgrade - Mulhern

This is an application to replace a deteriorating retaining wall and patio. There were concerns as to how
the property would be accessed to avoid excessive encroachment in the wetlands areas but conditions in
the OOC will cover those. Silt socks and other precautions will be taken.
MOTION: By Member Pimpare to close the public hearing for NOI 16-13 and issue an
Order of Conditions for 27 Ox Pasture Road with conditions requiring that
any heavy equipment not encroach upon the 50'wetlands setback, that all
accessibility to the project be routed around the south side of an existing
garage and that any work done to the existing wall have no heavy
equipment to the north side of the wall.

8:15 PM -28 Black Horse Lane-NOI 16-14 SWP 16-18-Raze and Rebuild - Green

The new owners want to raze the current dwelling and construct a new single family home with attached
garage. There are various resource areas on the property and the entire site is located in Land Subject to
Coastal Flooding. All necessary precautions will be taken regarding runoff and recharge. JS has
concerns regarding a line of trees providing a natural barrier between the driveway and saltmarsh but JC
said that the tree line will remain.
MOTION: By Member Creighton to close the public hearing for NOI 16-14 and issue
an Order of Conditions for proposed work at 28 Black Horse Lane.

MOTION: By Member Creighton to close the public hearing for NOI 16-14 and issue a
variance for work within the 50' buffer zone.

proposed work done at 28 Black Horse Lane.

8:45 PM - 159 South Main St-NOI 16-15-Garage - Ross
In attendance to represent agenda item: Richard Ross/owner; Jeff HassettlMorse Engineering;
The applicant wants to build a 24' x 24' detached 2-car garage partially within the 50' buffer zone to a
bordering vegetated wetland. The amount of impervious surface within the buffer zone stays the same.
JC asked if the garage could be moved out of the buffer zone but JH said it would result in healthy trees
being removed.After due discussion it was agreed to leave the garage as planned but turn a section of
the impervious drive into a pervious seeded lawn.
MOTION: By Vice Chair Vogelman to close the public hearing for NOI 16-15 and issue
an Order of Conditions with the condition that the proposed sawcut
pavement be removed and replaced with a seeded lawn area for the
proposed work at 159 South Main Street.
SECOND: By Vice Chair Vogelman

MOTION: By Vice Chair Vogelman to close the public hearing for NOI 16-15 and issue
an Order of Conditions variance for work within the 50' buffer zone for 159
South Main Street.

In attendance to represent agenda item: Susan Tehraniantowner, Mr. & Mrs. Ichiharala butters,• Jeff
Hassett/Morse Engineering:
The owner is asking to construct a single family dwelling with a swimming pool.There will be grading of
a depression and ledge removal associated with the project.JH stated the property slopes from Nichols
Road to the Sandy Beach area. Pervious pavers will used in construction wherever possible; there will be
a grass depression at rear of property to hold back stormwater and avoid increased runoff; a swale will
be installed at the rear slope to redirect runoff away from the abutting property on Sandy Beach Lane.
MOTION: By Member Creighton to close the public hearing and approve SWP 16-17
for proposed work at 71 Nichols Road.
SECOND: By Vice Chair Vogelman
VOTE: 6-0 Unanimous
OTHER BUSINESS:
MINUTES FOR MARCH 10 AND MARCH 24, 2016 APPROVED UNANIMOUSLY
CONSERVATION RESTRICTION ON SUPPER ISLAND
Per PI(the language drafted by Jeff Summers to justify the Commissions' approval of a conservation
restriction to allow this property to be put into perpetuity needs commission approval The restriction will be
beneficial to the public regarding recreational, educational and environmental concerns.
MOTION: Made by Member Creighton to approve the municipal certification of the public
benefits of a conservation restriction on the land at Supper Island.
SECOND: Vice Chair Vogelman
VOTE: 6-0 Unanimous
CERTIFICATE OF COMPLIANCE issued to ATLANTICA RESTAURANT, 44-46 BORDER STREET for
a bridge constructed in 2001-02. The property is being sold and the certificate is needed for the closing.
With no further business motion to adjourn at 9:35 was made and seconded,,
