The new system will be a 1500 gallon tank with a leaching field. The system will be gravity-fed. MOTION: By Member Alex Koines to close the public hearing and issue a Negative 2 determination for RDA 16-11 for a proposed septic upgrade at 423 South Main Street. The new system consists of a 1500 gallon tank with 1000 gallon pump chamber and leaching field. There will be grading work within the 50' buffer zone but the pool and cabana will be out of the buffer zone. Native restoration plantings and a fence will be installed. SECOND: Member Graham VOTE: 5-0 Unanimous Jack Creighton arrived at 8:15 pm and joined the discussion in progress for 47 Lothrop Lane 7.46 PM., 47 Lothrop Lane—Discussion—Jordan and Naimi Families continued from May 5, 2016 In attendance to represent agenda item: Robert and Leticia Jordan; Tim Naimi Susan Naimi In 2014, the Jordans took steps to shore up a low-level sea wall supporting their yard area in front of the Massachusetts Bay by installing mortar and concrete without first obtaining a permit. Enforcement proceedings were initiated by a complaint brought to the Commission's attention by abutters, the Naimis. At the Commission's August 5, 2015 meeting it was determined, by agreement of all parties, that the Jordans would remove the binding mortar and concrete holding the rock wall together, and would restore the site to its pre-2014 condition by November 1, 2015. During winter, 2016, the Naimis notified the Commission that the Jordans had not complied with the agreed-upon resolution. At its May 5, 2016 meeting, the Commission proceeded with an enforcement hearing regarding compliance with the agreed-upon resolution without the Jordans being present or having been notified. Following the hearing, Commission Chair Kennedy reviewed the matter with Town Counsel Richard Hucksam, who advised that any enforcement order should be withdrawn and that a new hearing should take place de novo. In light of that advice, Chair Kennedy advised the Commission that he had not signed or sent the enforcement order to the Jordans. The Commission agreed that this was the proper procedure in light of the acknowledged administrative error in going forward without the Jordans present or having been notified of the hearing. The Commission also agreed that a site visit was needed in order to review the work that had been completed by the Jordans and the current site condition, and that a new enforcement hearing would proceed after the site visit. SITE VISIT SET UP FOR WEDNESDAY, JUNE 15, 2016 AT 8.00 AM. MOTION By Member Creighton to reconsider and hold in abeyance the prior Order of Enforcement from May 5, 2016 pending further fact-finding and conclusions by the Commission. Some work is within the 50' buffer zone which calls for a variance. Applicant also needs a Stormwater Permit and was told until the application is filed the commission will not take action on the NOI. Discussion followed regarding total disturbance area and Susan Hoadley said the new footprint is 680 slf but subtract the 220 slf for the deck not within the buffer zone and it is under 500 slf. Chair Kennedy agreed to go forward with the NOI hearing. MOTION: By Member Koines to close the public hearing and issue an Order of Conditions for NO[ 16-11 for proposed work at 142 Lamberts Lane. SECOND: Member Graham VOTE: 6-0 Unanimous 8:45 PM:—Bound Brook Dam Pro'ect—NOI 16-12 Beechwood Street—Cohasset DPW In attendance to represent a enda item: Brian Joyce]DPW Director-Town of Cohasset; Magdalena Lofstedt/CDM Smith Consultants Documents to support agenda Item: Notice of Intent Application The Bound Brook Dam needs rehabilitation work to bring it into compliance with the Office of Dam Safety. The area will be cleared of vegetation and reestablished as grass growth. The intention is to avoid any tree growth in the area of the slope. There will be regrading and added rip rap. Metal piping will be replaced with box culverts. Flow will be diverted around the work area during construction.
