Patrice Vogelman served as chair for the hearing on James Island Way in Patrick Kennedy's recusal absence. 7:00 PM: 1 James Island Way—Amended OOC for NOI#15-15 and SWP#15-21-Steinmetz In attendance to represent agenda item:John Steinmetz/applicant;John Cavanaro en ineer• David Waterfall Ko elman & Page; Peter Rosen Coastal Geologist;John Zimmer Wetlands Scientist;John Tir aki Architect•Atty. Michael Rosen Counsel for the Opposition; The applicant presented a revised plan.Various experts presented calculations and plans to support the reconfiguration and the reduction of impacts to protected areas. Attorney Rosen asked for a continuation to give the opposition time to review recent submittals. Both sides were given specific submittal deadlines to allow time for each side to prepare and review new presentations. HEARING CONTINUED TO WEDNESDAY MAY 25 AT 7:00 PM. PATRICK KENNEDY ASSUMED THE CHAIR AND RECONVENED THE MEETING AT 8:15 PM 8:30 PM: 17 Black Horse Rd—RDA#16-10—Faulkner-Tree Removal In attendance to represent agenda item: Bernadette and Phil Faulkner The Faulkners appeared before us in 2015 on a Show Cause for 4 dead and 3 live trees that had been removed and were going to be replaced. Mr. Faulkner had filed an RDA with JS and thought he was all set to do the work.There will be 10 trees total. MOTION: By Member Pimpare to close approve RDA#16-10 for proposed work at 17 Black Horse Lane. SECONDED: Member Graham VOTE: 7-0 Motion carries 8:45 PM:47 Lothro Lane—Discussion Naimi and Jordan—Seawall Construction -Continued In attendance to represent agenda item:Tim Naimi, Dr. and AmV Naimi;Susan Naimi;Cam Naimi This discussion involved a constructed rock wall.The Naimi's consider it an unpermitted and permanent structure and want it removed and have the beach restored to its previous state.At a hearing in 2015 the Jordans were instructed to remove the wall by November 1, 2015 but this has not been done. PK Con Com Minutes May 5, 2016 feels that the request was agreed on by all parties to complete the work as requested and should be honored.The Naimi's would like an Enforcement Order issued.JP would like to give the Jordans until June 1, 2016 to remove the wall or face fines.All parties will be requested to appear at the Conservation Commission meeting on Thursday, May 19,2016. MOTION By Member Pimpare to issue an Enforcement Order to the Robert and Leticia Jordan (owners)for the removal of an engineered wall on property located at 47 Lothrop Lane,to restore the property to its original condition and to face a$300 per day fine for work not completed by June 1, 2016 SECOND: By Member Edward Graham VOTE: 7-0 Motion Carried 9:20 PM: 35 Beach Street—Beach St. Builders Donald Staszko—Discussion -Continued In attendance to represent agenda item:Terry McGovern Morse Engineering;Jeff Waal Cohasset Conservation Trust There is an After the Fact Order of Conditions on the above referenced property. The property is under a Cease& Desist.There had been activity in an area under the jurisdiction of the Conservation Trust and the owners were asked to provide siltation control, restoration of a damaged stone wall and pull back debris.Jeff Waal said this has not been done but IS performed a site visit and saw evidence of some work being done.JC had requested a letter from Brian Davis of Beach St. Builders stating that no work has been done on the project since the Cease & Desist was issued.JC wanted an affidavit with the letter verifying the statement as true under penalty of law. Brian Davis did submit a letter but without an affidavit. There is no evidence of an Order of Condition. (Staff left the meeting to see if there has been an Order of Condition issued. There was an NOI and SWP filed but no evidence of an OOC being issued.) Discussion to be continued at a date to be determined. 84 Gammons Road Wise—3-Year Extension for Existing Order of Conditions Owner has completed some of the work. He has been living out of the country.IS performed a site visit and saw evidence of work on the home and carriage house but nothing on a 2-car garage and patio. MOTION By Member Pimpare to extend the OOC on the above property for 3 years. SECOND: By Member Edward Graham VOTE: 7-0 Motion Carried Show Cause Tracker Update: 604 Jerusalem Rd/Brewer:This involved unpermitted tree removal from 2015.The owners will be contacted via phone call by staff to appear at the hearing on May 19 orJune 2, 2016. PV asked that in cases of unpermitted tree removal to place a reasonable time limit on replacement.JP offered to work with IS on the Show Cause Tracker as most incidents happened before JS was on staff.
