Meeting called to order at 7:05 PM
7:00 PM:430 Atlantic Avenue-DeVitre Shahanian RDA 16-01-retaining wall at Guest House
(continued from 1/21116)& RDA#16-02(new filing-sewer&driveway retaining wall)

There is a slight encroachment of the driveway and sewer retaining wall onto the Steinmetz property
but AB said the encroachments were not intentional and existed for several years.The applicants are
asking to correct the encroachments as they now exist (RDA#16-02).The driveway retaining wall will be
moved; the sewer wall will be removed.
JS asked if there are any written conditions to ensure his property will be restored to its original state. PS
said that we can add conditions to an RDA determination.
MOTION: By Member Pimpare to close the public hearing for RDA#16-02 for 430 Atlantic
Avenue and issue a Negative 3 determination with conditions that siltation barriers be
used around the area of disturbance and that upon completion of the work the
excavated area be properly restored with loam and seeding.
SECOND: By Member Graham
VOTE: 5-0 Unanimous
RDA#16-01 concerns the retaining wall along the driveway to the guest house. Both were built in 2003
in a previously disturbed area. MR questioned whether it will do more harm than good to remove the
wall in this area. PS asked if the guest house wall is different in construction from the other walls on the
property which seems to be fieldstone walls with no footings.The guest house wall seems to have

footings and be mortared and may require an NOL MR said the footings would most likely be gravel and
easily removed. PS said we issued an OOC on construction of the guest house;there was not a wall
indicated on the plan and the driveway was supposed to be pervious but appears to be paved. PS felt
that if a Certificate of Compliance had been requested there wouldn't be issues now. If the wall stays it
would require an ATF NOI; if the wall is to be removed, it requires approval of the RDA application.
MOTION: By Member Pimpare to close the public hearing for RDA#16-01 for 430 Atlantic
Avenue and issue a Negative 3 determination with conditions that siltation barriers be

8:35 PM: 24 Atlantic Avenue—Humphreys—RDA#16-03 -Pruning&Vista Cutting
In attendance to represent agenda item.Atty.Charles Humphreys/owner;Jen Terrio abutter
The applicant wants to create a narrow corridor to improve the vista by removing several trees.
MOTION: By Member Pimpare to close the public hearing for RDA#16-03 and issue a Negative 3
determination for proposed work at 24 Atlantic Avenue.
SECOND: By Member Graham
VOTE: 5-0 Unanimous
8:45 PM: 121 Nichols Road—Nichols LLC—SWP 16-04 -Opened and Continued to 3 10 16
PS requested the applicant file a Notice of Intent forwork being done within the buffer zone.
9:00 PM: 30 Sanctuary Pond Rd—Sookasian—RDA#16-04 -Removal of Trees
In attendance to represent agenda item: Mr. & Mrs. Sookasian owners
Work will be done within the 100' buffer zone. There are 5 damaged trees that present a danger.
MOTION: By Member Koines to close the public hearing for RDA#16-04 and issue a Negative 2
and Negative 3 determination for proposed work at 30 Sanctuary Pond Road.
SECOND: By Member Graham
VOTE: 5-0 Unanimous
9:10 PM: 130 Forest Avenue—Dr. Pompeo—ORAD#13-03 (continued from 1/21)
In attendance to represent the agenda item:
PS said in 2013 Dr. Pompeo filed an ANRAD to verify the wetlands. Per DEP an extension is allowed as
long as the conditions and topography haven't changed.The ORAD is good until 11/6/16 but there is
other work being planned for this property.
MOTION: By Member Koines to extend the ORAD approved for 130 Forest Ave for one year until
November 6,2017.
SECOND: By Member Graham
VOTE: 5-0 Unanimous
Other Business:
• Issued a Certificate of Compliance for a dock at 332 South Main Street.

• Continued a request for a 1-year Extension on an Order of Conditions 13--issued to 44 Joy Place.
Commissioners want to review the OOC.
• Discussed way to make the Show Cause Tracker more effective and responsive to the needs of
the Commission and the Conservation Agent. Issues including enforcement,fines, Cease and
Desist orders were brought up. individual issues on the tracker were also discussed and it was
decided to bring in applicants in who had been issued requests for filings or work completion
that hasn't been done. Previous filings will be reviewed by staff to determine if a Certificate of
Completion has been or should be issued and the applicants will be contacted.
With no further business, motion to adjourn was made and seconded. Meeting adjourned at 10:15 pm.
