Meeting called to order at 7:00 PM
7:00 PM: Lot 3 Beach Street—NOI 16-01 SWP 16-03—Beach St Builders—Stockpiling Supplies
In attendance to represent agenda item:Jeff Hassett Morse Engineering;Carla Getty/Abutter;Jeff

Beach Street Builders have completed construction on 55 Beach Street and are now looking to develop a
2"6 lot on the site. PS stated the limit of work line is different every time he views the property and that
it appears materials have been brought in from outside jobs.This debris and fill need to be defined.
There is also the issue of materials and equipment being stockpiled on the site.JH says that anything
currently being store is temporary and will be used for the upcoming project.The Conservation Trust is
concerned with the wall at Great Brewster woods being compromised and that the completion dates for
the SWP and NOI are inconsistent.JH agreed to an end date of July 2017 for both applications;to repair
any damage to the wall incurred prior to this hearing;to install siltation controls and other safeguards
during construction; and to store only equipment and materials being used on the current building
project and not for other projects off site. Abutter Getto said sometimes access to her driveway and
home are blocked.JP requested an evaluation of the contents of the fill in a signed statement from the
contractors/owner.JC said he is not happy with Beach Street Builders because they have been before
Conservation in the past and should be aware of local bylaws and restrictions as they apply to
construction projects. He asked for a statement of verification under penalty of perjury to accompany
the letter regarding the fill contents.
MOTION: By Member Creighton to issue a Cease&Desist order of further stockpiling,to have a
signed statement from the contractor verifying the fill content,to restore the wall at

Great Brewster Woods to its original location and to install hay bales and other
precautions as needed.

7:50 PM:294 South Main Street—NOI 16-02--Extend Walking Path
In attendance to re resent agenda item: Elaine Coleman&Victor Martuzza Owners•Carmen

Carmen Hudson presented the applicants' proposal to extend an access walkway along an easement
between 294 and 296 South Main Street with a 20' long x 6'wide gravel path. The applications want to
extend the path to the wetlands keeping it within the parameters of the easement so they can access
the riverfront area. There would be some work within the buffer zone involving clearing of debris and
overgrowth. Discussion followed regarding whether the work within the BZ would be considered
improvements to the area.The owner of the easement, Mrs.Johnson of 296 South Main would like
peastone but members of the commission would like to see natural restoration. The applicants
expressed no preference.
MOTION: By Member Marten to close the public hearing for NOI 16-02 and issue an Order of
Conditions+for work at 294 South Main Street.
SECOND: Member Graham
VOTE: 5-0 Unanimous
MOTION: By Member Marten to close the public hearing for NOI 16-02 and approve the variance
for work within the 50' buffer zone for work at 294 South Main Street.

8:20 PM: 130 Forest Street--Dr. Pom eo—Request to Extend ORAD#13-03
PS stated that the DEP allows permits to be extended after 3 years if no changes in the wetland edge
have occurred. The commission expressed concern because the ORAD in question does not expire until
11/16/16 so there is no urgency at this point.

8:25 PM: 17 Norfolk Road—Discussion—Continued

PS said there have been variations in the SWP plan as submitted but additional erosion controls are in
place. However, non-compliance with the existing SWP could require an amended SWP.JH indicated
that there have been additional hay bales installed and then when he ran the SW calculations he found
they are the same as originally proposed and there is no plan to increase the impervious area.The
Commission feels that the contractor has done his due diligence regarding this project and no further
discussion is required.

The abutters were reminded that from the prior meeting it was established that any zoning concerns do
not fall under our jurisdiction. However, PK stated that work within our jurisdiction area being done
without permits would be our concern.VW stated they know of wood storage but of no other work
being done on the property. DN says the residents are being negatively affected by wood being dumped,
trucks going in and out.AS stated the wood delivered is already cut and is there to be sold, and that no
wood-cutting is done on the premises. DN and other abutters say there have been chain saws and wood
chippers on the site as well as sheds,tires,debris and other equipment.The commission has performed
site visits and found no evidence of any activity within their jurisdiction. VW is going to be out of the area
for several weeks so it was decided to revisit this issue at a later date to be determined.
With no further business, motion to adjourn was made and seconded. Meeting adjourned at 9.35 pm.
