COHASSET CONSERVATION COMMISSION

Meeting called to order at 7:05 pm.
7:00 PM: 430 Atlantic Avenue— RDA#16-02—Gaar Realty Trust (DeVltre)
Public hearing was opened and continued to 2/25/16 @ 7 pm.
7:20 PM: 71-123 Atlantic Ave/Treats Pond - NOI #15-31 —(continued from 1/7/16)
In attendance to represent agenda item: Brian Joyce/Director of DPW; John Cavanaro/Consultant; Mike
Clark/Design Consultants
Documents presented at meeting: Project Narrative/Appendix B; Plans for Treats Pond Outlet Pipe
Brian Joyce stated this project addresses flooding issues and residential concerns. MC stated the project
will reinforce the concrete weir which will allow the DPW to lower the pond for increased precipitation. BJ
reported all resident who received the easement information drafted by Town Council signed a letter of
support for the project. MC said the Order of Conditions won't be recorded until the easement issue is
completed and that there will be follow-up inspections after major storm events and an Operation &
Maintenance plan as part of the OOC.
MOTION: By Member Pimpare to close the public hearing and issue a Notice of Intent and
Order of Conditions for proposed work at 71-123 Atlantic Ave/Treats Pond.

within the 50' Buffer zone for proposed work at 71-123 Atlantic Ave/Treats Pond.

7:50 PM: 604 Jerusalem Road— Brewer—Show Cause Hearing
In attendance to represent agenda item: Andrew Spalt (AS)/Total Tree; Tom Carroll (TC) and Anson
Wheeler(AW)/abutters
Documents presented at meeting: Correspondence from Debby Brewer
PS said there were several dead or damaged trees on the site. Member Justin Pimpare conducted a site
visit and witnessed contractors cutting of trees along Rattlesnake Run. Crushed stone had also been
deposited at the end of the pathway. AS was under the impression it was alright to remove the trees and
do other landscaping work. JP reported that all of the trees that were removed were within the 50' buffer

to the wetland and placed an immediate 'Cease & Desist" order on the property since no permits have
been filed.
Individual site visits are advised. Hearing will be postponed until Deb Brewer returns in April.
8:05 PM: 14 Haystack Lane—Beach Street Builders—SWP#16-01
In attendance to represent agenda item: Jeff Hassett(JH)/Morse Engineering
This is new construction with no work being planned within the buffer zone. Beach St. Builders are
installing a front rain garden to capture roof and yard run-off; straw wattles will be on site for the duration
of the project.
MOTION: By Member Koines to close the public hearing and issue a Stormwater Permit for
proposed work at 14 Haystack Lane.

8:35 PM: 336R North Main Street— Discussion—Violation of Wetlands
In attendance to represent the agenda item: Vicky Williams (VW)and Judy Salvaggi (owners); Andrew
Spalt/Total Tree; Jennifer Powers, Nicole Engels, David Nussbaum (abutters)
Per PS, Zoning Enforcement Officer Bob Egan sent a letter to the owners regarding commercial use
(landscaping business) in a residential area but PS said the zoning is not our jurisdiction. However, PK
stated that work within our jurisdiction area being done without permits is our concern. VW stated they
know of wood storage but not of any other work on the property. DN says the residents are being
negatively affected by dumping of wood, trucks going in and out. AS stated the wood delivered is already
cut, is there to be sold and there is no wood-cutting on the premises. DN and other abutters said there
have been chain saws and wood chippers on the site as well as sheds, tires, debris and other equipment.
Site Visit scheduled for Saturday, January 23 at 8:30 a.m for Commission members only: no
abutters to be allowed on property per owners as they will not be there.
8:55 PM: 91 Doane Street— Flaherty—Cease & Desist/Show Cause Hearing
In attendance to represent agenda item: Michael Flaherty (owner)
PS has received complaints of earth-moving activity near various wetlands in the area. When MF bought
the property in August he was told there were no wetlands but an elevated flood zone so he assumed it
was alright to do grading and other landscaping activities. PS said the owner would need to file an ATF
Stormwater Permit and that PS will follow up on this.
9:00 PM: Beach St(Vacant Lot 3)—D. Stazsko—Cease & Desist con't to March 10 with NOI and
SWP filings
9:15 PM: Show Cause Tracker- Discussion
The Commission would like PS to update the tracker with current information and to follow up on
outstanding filings and to ensure that Show-Cause requests are addressed in a timely manner.
Other Business
Tim Naimi and Amy Naimi were asking if progress has been made on Lothrop Lane regarding a wall to be
either restored or removed. PK said there is no formal process for follow-up but the commission is
working on it. TN asked if the commission could penalize the owners and PK said the commission has
that option and may address it at a future hearing.
Per a request from the Town Clerk's office, the Commission agreed to move meeting on Thursday,
September 8, 2016 to 8:01 PM to accommodate the State Primary Elections.
With no further business, motion to adjourn was made and seconded. Meeting adjourned at 10 p.m.
