HomeMy WebLinkAboutMinutes - CC - 10/15/2015 October 1,2015 1 APPROVED MINUTES COHASSET CONSERVATION COMMISSION DATE: Tuesday, October 15, 2015 TIME: 7:00 PM PLACE: Cohasset Town Hall, Basement Meeting Room 41 Highland Avenue, Cohasset, MA 02025 IN ATTENDANCE: Patrick Kennedy, Chair(remote via phone) Patrice Vogelman, Vice Chair James Marten Alexander Koines Justin Pimpare, Secretary/Treasurer Paul Shea, Conservation Agent ABSENT: John Creighton, Member Andrea Buffum, Associate Member Meeting called to order at 7:00 pm. 7:00 PM: 807 CJC Highway—Notice of Intent(NOI)#15-24 and Stormwater Permit(SWP)#15-35— Applicant: Jiginder Sailan In attendance to represent agenda item:Jeff Hassett, Morse Engineering; Robert Ferrara (abutter) This project involves reconfiguring the existing access and parking areas, adding a walkway and installing a new septic system at an existing dental office. Runoff will be directed from the driveway to a peastone diaphragm and rain} garden on the property. There is a maintenance plan outlined in the stormwater report for the rain garden. MOTION: By Member Koines to close the public hearing for Notice of Intent#15-24 and issue an Order of Conditions for 807 CJC Highway. SECOND: Member Pimpare VOTE: 5-0 MOTION CARRIES MOTION: By Member Koines to close the public hearing for SWP#15-35 and issue a Stormwater Permit with documentation for maintenance of the rain garden tied to the deed for 807 CJC Highway. SECOND: Member Pimpare VOTE: 5-0 MOTION CARRIES 7:15 PM: 8 James Lane—Amended Order of Conditions—continued from 1015/15 In attendance to represent agenda item: Paul Sullivan (Village Development Partners) Documents Submitted at this meeting: Status of Finances-8 James Lanes/James Lane Partners LLC Updated Site Plan Village Development LLC is reverting back to a previous Order of Conditions. Minor changes made to the existing plans were presented. There is an issue with monies owed to the Planning Board that must be resolved prior to releasing any permits. Paul Sullivan will drop off a check within the week. 7.30 PM: 46 Stockbridge Street—NOI#15-23 and SWP#15-34 In attendance to represent agenda item: John Cavanaro (Engineer) and Eric Davis (Owner/Applicant) The plan is to demo and rebuild the existing dwelling on a new footprint and to demo a shed within the Flood Plain. According to John Cavanaro, the Zoning Board has already granted approval for this project. The owner/builder has filed this project with the DEP. Mr. Cavanaro said the increase in pervious surface and easing to the grade of ledge will be an improvement to the site. SECOND: Member Pimpare VOTE: 6-0 MOTION CARRIES CERTIFICATES OF COMPLIANCE APPROVALS: Certificates of Compliance issued to: Wise, 77 Jerusalem Road; Whoriskey, 11 Sankey Rd; Whoriskey, 36 Stockbridge Street 8:00 PM: 365 Atlantic Avenue—Discussion of Drainage In attendance to represent agenda item: John Cavanaro(engineer);'Mont'Phelps, Jane Linder(owners); Mr. Calderone(abutter) Recusak Member Koines identified himself as an abutter Paul Shea issued an Order of Conditions and SWP in 2014�to,Jane Linder.:On 4115/45, John Cavanaro submitted an amended site plan to the existing OOC showing',catch basin beingpiped underground to coastal waters. Abutter Calderone had concerns about backflow'onto his property but Mr. Cavanaro explained that the drainage design has been upgraded•to alter the`flow and is expected to have no adverse affect on abutting properties. JC suggested to amend areas of interest-on-the'existing site plan from April 2015, enter the revised plans into the file and designate such as the plan of record. Since this is a minor modification allowed under an existing OOC and SWP.issued.in 2014, no vote is required. 8:16 PM: 28 Norman Todd Road-Amended SWP#12-29. -- ( ,...,.a'. In attendance to represent agenda item:-Jeff Hassett Morsel=n ineerinp; Brian 5huell (owner) New owner Brian Shuell wants to install a pool on the property Paul Shea indicated no wetlands issue: the in-ground pool will add pervious,paving and a tree-line along the pool's perimeter. Since this is a minor modification allowed under anexisting SWP issued in 2012 for new construction no vote is required.. 8:30 PM: 430 Atlantic Avenue—Show Cause Hearing In attendance to represent agenda item: John•Steinmetz(abutter Paul Shea outlined encroachrr erit issues on the above referenced property and is expecting two Requests for Determination of Applicability to be filed within the week. Patrick Kennedy asked if an engineer has been hired to;pcovide a site plan. Paul Shea said that Dr. DeVitre was going to hire a gentleman named McManus who is a biologist and not an engineer. There are issues on the property that may require permits as mentioned previous to this hearing, some going back as far.as.1998.To.date Paul Shea has not received As-Builts for the pool and also there was never a permit flied with.the Building Department for a generator on the site. He feels there are too many issues unresolved and.the-lack'of plans on several issues is cause for concern. Patrick Kennedy said the Commission has'asked for site plans specifically and can't understand why none have been filed. Regardless of whether or not the Commission has received new filings, there needs to be a site plan. Patrice Vogelman suggested to give Dr. Devitre until December 31, 2015 to produce plans. Mr. Steinmetz asked.why no fines have been incurred since this is the third Show Cause hearing and it was made clear at the last hearing that site plans were needed. Patrick Kennedy said there are existing violations and enforcement could be issued for restoration of affected areas but he prefers to wait until December 31, 2015 to see if plans will be presented. He also said that if it is determined that fines need to be applied, they could be retroactive. Justin Pimpare requested that Paul Shea issue a letter to the homeowner requiring a full schematic site plan by December 31, 2015 that is signed, stamped and dated by a licensed engineer. October 1,2015 3 8:45 PM: 555 Jerusalem Road—Show Cause Hearin In attendance to represent agenda item: Paul Caruso landsca er t Mr. And Mrs. Millard owners The Millards hired Mr. Caruso to do yardwork that increased the impervious surface but no SWP was filed. Mr. Caruso said he assumed it was a non-issue when no one came out to the property but will immediately file an After-the-Fact SWP. 9:00 PM: 792 Jerusalem Road —Discussion of Previous OOC and SWP In attendance to represent agenda item: Leah Pgpielarski (owner): Ryan Conb Robert Egan (Cohasset Building Inspector), John Cavanaro (Cavanaro Consulting): Attorney Richard Henderson According to Paul Shea, there is no consistency to the site plans being used by various departments. Other inconsistencies include: a change to private water after-the-fact but no well permit filed with Board of Health; lot line changes generated by the Assessor's office not being reflected on all sets of plans. Richard Henderson said lot line changes are not approved locally but through the Registry of Deeds so that point is moot. PV feels the inconsistency with plans is an internal problem and not under the jurisdiction of the Conservation Commission and that if proper permitting software is in place, much of this confusion will resolve itself. She will pursue this with Town Manager Chris Senior. 9:15 PM: Other Business • There were no minutes for approval. • New code updates from the National Fire Prevention Association (NFPA) require that access to all buildings be at least 20' wide and less than 50' from the street for to accommodate emergency vehicles. JC expressed concerned about tree removal and asked if there would be allowances for relief. Building Superintendent Robert Egan said local chiefs have the right of refusal. PK and PV will discuss this with Chris Senior and Chief Silvia. • It was brought up that Phil Ayers, owner of 28 Otis Avenue, removed fragmites without a permit. PS will follow up with Mr. Ayers. • PV wants to know what parameters are in place regarding follow-up on Enforcement, OOC's and other Conservation business. She has offered to devise a system to track these issues and will report back at the next meeting. With no further business, motion to adjourn was made and seconded.
