HomeMy WebLinkAboutMinutes - CC - 08/20/2015 Conservation Commission Meeting Minutes Date: Thursday, August 20, 2015 Time: 7:00pm Place: Town Hall Basement Meeting Room,Cohasset, MA Commissioners Present: Patrick Kennedy(PK), Chairman Patrice Vogelman (PV),Vice Chairman Jay Pimpare (JP),Secretary/Treasurer Alex Koines (AK), Designee to CPC Edward Graham (EG) Jack Creighton (JC) Andrea Buffum (AB), Associate Commissioners Absent: James Marten Commissions Consultant Present: CCC/SW Agent, Paul Shea Chairman Kennedy called the meeting to order at 7:00pm 153 Sohier Street—Show Cause Hearin When inspecting for evidence of unpermitted work, Paul Shea found pruning and soil alterations done within the 100 foot buffer zone to the BVW. It was determined to issue a Cease and Desist to the owner of record as the property is currently in foreclosure. MOTION: By Member Alex Koines to issue a Cease and Desist order for any work within the jurisdictional area of the Conservation Commission at 153 Sohier St. SECOND: By Member Ed Graham. MOTION PASSES 6-0 80 Lantern Lane—Discussion In attendance foragenda item: Attorney Adam Brodsky The property owner submitted a request for an Order of Conditions and a Stormwater Permit with a variance to do work within the Buffer Zone to an IVW/Vernal pool. As a result of a site visit the Commission denied the variance request and Order of Conditions for the proposed work and the owner/applicant withdrew the Stormwater permit without prejudice. This issue was deliberated on in the past and evidence supported the Commission's decision to deny the proposed project and there is nothing submitted that would indicate a reversal of the decision is called for. MOTION: By Member James Marten to deny the request for reconsideration of a variance an Order of Conditions for 80 Lantern Lane. SECOND: By Member Ed Graham. MOTION PASSES 6-0 38S Atlantic Avenue—Amended Order of Conditions (Alex Koines Recused) In attendance to represent agenda item: Carmen Hudson/Cavanaro Consulting; Mr& Ms Gibbons/owners; Ms. O'Neil/abutter(391 Atlantic) Due to the change in the FEMA Flood Map,the coastal bank and flood zones were altered;the approved - engineered plans need to show these changes. It is proposed that the house be moved back 15 feet and out of the buffer zone. To improve drainage the paved driveway will be changed to crushed stone or Conservation Commission Meeting Minutes August 20,2015 shell,the downspouts will be directed away from neighboring dwellings, and native plantings will be increased. The size of the proposed deck will be reduced by four feet. Paul Shea thought it would be necessary for DEP to comment on this project because there would be changes to the limits of the resource area. Ms. O'Neil said she couldn't do any work behind her house but the Gibbons were able to bring in fill when they put in a fence. Gibbons said no fill was brought in,only plantings and mulch. The Commission agreed that they would need to hear from DEP before a decision is made. Continued to September 20th 3 Stanton Road NOI 15-18—Septic Upgrade The proposed project will replace the failed septic system with a new system. There is a BVW that runs along the property line on the adjacent side, all of which has been delineated. Because the tank will be in the buffer zone there would need to be a variance issued along with an Order of Conditions. MOTION: By Member Alex Koines to close the public hearing and issue an Order of Conditions for a septic upgrade at 3 Stanton Road. SECOND: By Member Ed Graham. MOTION PASSES 6-0 100 Forest Avenue Lot 2 —NO]Application continued In attendance for agenda item:Jeff Hassett/Morse Engineering; Johann and Stacy Heinlein (abutters) Jeff Hassett submitted revised site plans showing an upgrade to an 18 inch pipe under the driveway to level out Stormwater on both sides which would reduce the risk of clogging. Paul Shea said the current plans look much better than the previous plans. The Heinlein's had raised concerns regarding runoff from the property getting into a potable well. Jeff Hassett explained the revised site plan shows the driveway made of a pervious asphalt which allows the stormwater to penetrate and collect rather than run off into the adjacent areas. There will be a crushed stone shoulder along the driveway as well. Paul Shea stated that this project would not need a variance in accordance with the Cohasset Town bylaws. MOTION: By Member Creighton to close the public hearing and issue an Order of Conditions for the proposed project at 100 Forest Avenue.
