HomeMy WebLinkAboutMinutes - CC - 08/06/2015 Conservation Commission Meeting August 6, 2015 Date: Thursday,August 6, 2015 Time: 7:00pm Place: Town Hall Basement Meeting Room 41 Highland Avenue Cohasset, MA Commissioners Present: Patrick Kennedy, Chairman Patrice Vogelman,Vice Chairman Jay Pimpare,Secretary/Treasurer Alex Koines, Designee to CPC Edward Graham Jack Creighton Andrea Buffum, Associate Commissions Consultant Present: CCC/SW Agent, Paul Shea Chairman Kennedy called the meeting to order at 7:00pm 589 Jerusalem Road—Continued The Commission asked for Revised site plans for plantings;the Commission wanted more plantings overall. Landscape Architect Gary Claiborne went over the revised site plans. The Commission decided to go ahead with this planting plan and review in the fall to see progress. Sanctions on the property owner will take place at a later date as discussed by the Commission. Motion by Jack Creighton to accept the planting plans and push off sanctions until a later date, seconded by Ed Graham,Vote was unanimous, 5-0. 100 Forest Avenue Lot 2: N01#15-17 and SWP#15-25—K&E Development Jeff Hassett from Morse Engineering was in attendance on behalf of K&E Development. This is for a new single family dwelling to be constructed.The location is neither in a Floodplain nor Endangered Species habitat. The Engineers minimized the work that would need to be done in the IVW Buffer Zone but some work was unavoidable;the 1VW is at a higher elevation where they would be working. Paul Shea explained they are meeting the performance standards required. Roof runoff will flow into three dry chambers at the back of the house. The Heinleins were in attendance as abutters to the property. Mr. Heinlein brought up some issues regarding the plans and remediation efforts;the main concern being the runoff directed towards the well on their property. The Commission will conduct a site visit. Slight changes to the plan will be made by Morse Engineering and the Commission will continue the meeting until August 20tn Conservation Commission Meeting Minutes September 3,2015 47 Lothro Lane—Show Cause/L.Jordan owner A mortared storm wall was installed without filing with the Commission. The wall is located in an area of coastal storm flowage, 100 year storm, and a costal bank; this would require filings with the Zoning Board of Appeals, DEP,and the Conservation Commission. The owner explained the stones were always washed up and back so she cemented the stones together. The wall was made in March or April. The Commission determined it became a jurisdiction area when the mortar was put into the picture. The wall was small but would cause unknown environmental issues; the wall was ordered to be removed. Alex Koins moves to close the Dearing and order the owners to disassemble the wall and return it to previous conditions by November 1st,Seconded by Ed Graham,vote unanimous 5-0. The Commission discussed the remedying of the fines issues by the Conservation Commission;the issue was raised with Town Counsel who determined that when there is an enforcement action it is a stand- alone action and fees cannot be shifted to the owner or operator. The Commission will uphold Town Council's message. The Commission will look to revise the regulations via public hearing and enforce the enforcement fines.
