HomeMy WebLinkAboutMinutes - CC - 06/18/2015 Conservation Commission Meeting June 18, 2015 APPROVED MINUTES CONSERVATION COMMISSION Date: Thursday, June 18, 2015 Time: 7:00pm Place: Town Hall Basement Meeting Room 41 Highland Avenue Cohasset, MA Commissioners Present: Jack Creighton, Chairman Patrick Kennedy, Vice Chairman James Marten, Secretary/Treasurer Alex Koines James Gilman Edward Graham Justin Pimpare, Associate Patrice Vogelman, Associate Commissions Consultant Present: CCCISW Agent, Paul Shea Chairman Creighton called the meeting to order at 7:00pm 28 Bow Street—Show Cause Hearing: Cease and Desist(verbal &written) In attendance to represent agenda item: Donald Stazko ro ert owner Following the previous hearing, Paul made a site visit on May 26, 2015 and counted eight trees: three were 8" in diameter, three were 5" in diameter, one was about 7" in diameter, and one was a smaller sapling that was cut. There also seemed to be vegetation removed after the first hearing which would violate the existing Notice of Intent. An After the Fact RDA will have to be filed for the work conducted on the property. The mitigation would be replanted in a planted to remove ratio of 2 to 1. Mr. Stazko was directed to plant three trees on the property as a mitigation planting plan and to file an ATF RDA. 792 Jerusalem Rd Cemete Rd —Po ielarski -SWP 15-19 Lot 85 and 15-20 Lot 33A In attendance to represent agenda item: Leah Popielarski (owner): Carmen Hudson (Cavanaro) This filing is for construction of new single family homes. The property was subdivided into three lots so they submitted two Stormwater filings for Lot 33A and Lot 85. Crushed stone trenches are proposed to be placed in multiple areas which would help with the treatment of the runoff from the additional pavement. Two infiltration systems on Lot 33A with an overflow pipe are proposed; a 30x67 subsurface infiltration system will also be installed about 5 feet under. This project is outside of the 100 foot buffer zone so it does not trigger an NOI. The amount of ledge on the property is concerning for reaching the desired depth but the project can be flexible on the placement to make it work. Motion by Patrick Kennedy to close the public hearing and issue Stormwater Permit#15-19 for the project proposed at 792 Jerusalem Road, Lot 85,seconded by Ed Graham and vote was unanimous. Conservation Commission Meeting Minutes June 18, 2015 100 Forest Ave—Heinlein - RDA 15-09& SWP 15-18 In attendance to represent agenda item: Johann and Stacy Heinlein lowners)� Carmen Hudson (Cavanaro Consulting) The owners intend to raze and rebuilt an existing dwelling with attached garage. A gravel driveway serves the house and There is an isolated vegetated wetland in the front of the property: part of the driveway is located within the 25' buffer zone where a small amount of work will be done. The rear part of the dwelling will be facing a subsurface infiltration system. 400 sq. ft. of native plantings are also proposed along the driveway. Motion by Patrick Kennedy to close the public hearing and issue a Negative 3 Request for RDA #15-09 for the project proposed at 100 Forest Ave, seconded by Ed Graham and vote was unanimous. Motion by Patrick Kennedy to close the public hearing and issue Stormwater Permit#15-18 for the project proposed at 100 Forest Ave,seconded by Ed Graham and vote was unanimous. 70 Whitehead Road_-_Show Cause Hearing (continued) The property is owned by Thomas Sullivan; Joe Yerardi is the General Contractor. A site visit indicated abundance of fill and rocks being dumped on the property and fill running into the BVW around the Treats Pond area. There were no erosion controls or management plans in place. Since then a Cease and Desist has been ordered for the outside portion only of the project. The Commission and DEP want a full restoration of the property rather than an After the Fact filing. Plans were requested but never received by the Commission; subsequently a fine was put in place. Recent developments show a new foundation on the property that was not permitted by the Building Department; the foundation was ordered to be removed by Building Inspector Bob Egan. Test pits were conducted to see how much fill was put on the property: #4 found fill with a depth of 8'; #3 found fill down 5'4"; #2 went down 6'; #1 went down 8' and all fill material was found to be recent. A water service and gas line brought in within the last year was noticed. A shipment of lumber in the jurisdiction area was ordered to be removed. The Commission ordered a full site restoration on the property and the owner is responsible for submitting plans to the Commission. Everything must be removed from the 100' buffer zone as well. Patrick Kennedy moved to adjourn, Seconded by Ed Graham,vote Unanimous.
