HomeMy WebLinkAboutMinutes - CC - 04/16/2015 9 Conservation Commission Meeting April 16, 2015 Date: Thursday,April 16, 2015 Time: 7:00 p.m. Place: Town Hall Basement Meeting Room 41 Highland Avenue Cohasset,MA Commissioners Present: lack Creighton, Chairman Patrick Kennedy James Gilman James Marten Commissioners Absent: Edward Graham Alex Koines Patrice Vogelman Justin Pimpare,Associate Commissions Consultant Present: CCC/SW Agent, Paul Shea Chairman Creighton called the meeting to order at 7:00 p.m. 80 Lantern Lane NOI &SWP(Daniels)-continued Attorney Adam Brodsky was present on behalf of the applicant. Chairman Creighton stated the Commission had a site visit at 6 p.m.tonight. Attorney Brodsky discussed with the Commission the vernal pool,the intermittent stream and whether or not there is an IVW. He stated the proposed project will not have an adverse effect on the area and will be better than what exists there today. This area will be improved and enhanced. Jeff Morse of Morse Engineering gave an overview of the storm water impact and how it will be handled. There is no increase in runoff. Kevin Leary-79 Lantern Lane asked who would be responsible for maintaining the conditions that are set. Chairman Creighton stated the conditions run with the deed;which goes along as a requirement of ownership. Jeffrey Bernier-73 Lantern lane stated he has concerns with compromising the environmental character. Dan MacDonald- 74 Lantern Lane stated the area has been wet for forty years. He has an issue with how a house can be built at this location when he was told in the past that he couldn't put an addition with a foundation because of the wetlands. Paul Shea stated in his opinion there is an intermittent stream that flows into a pooling area. This is a BVW. Patrick Kennedy referred to Section 26(e) of the Cohasset bylaws that states there can be no construction in the 100' buffer to a vernal pool. The vernal pool per the bylaw is to be treated as an ACEC. Attorney Brodsky stated this plan is one of the most comprehensive mitigation proposal for a single family home. Jeff Hassett of Morse Engineering spoke of the SWP. The size of the proposed project has a limited amount of disturbance. The rear and side yard will be replanted with woods. They are proposing a gravel driveway(6"of crushed stone). They are proposing a roof drywall system. This project has less storm water runoff than most single family homes. There will a sump pump in the basement as a precautionary measure. Paul Shea asked Mr. Morse how many storm water management systems he has designed within 100'of a vernal pool. Mr.Morse responded that vernal pools are rare and therefore he has never designed a system in the area of a vernal pool. The Commission had a discussion about the jurisdictional issues with wetlands. The Commission discussed how much land is being proposed to be mitigated and the impact on wetlands. Motion by Patrick Kennedy to deny the requested order of conditions,the NOI,for the proposed project at 80 Lantern Lane,seconded by James Marten and the vote was unanimous(4-0). 1 ConCom-4.16.15-TC Conservation Commission Meeting April 16, 2015 Motion by Patrick Kennedy to close the public hearing and deny the request for a variance for the project at 80 Lantern Lane, seconded by James Gilman and the vote was unanimous(4-0). The applicant requested to withdraw the 5WP application without prejudice. The Commission allowed the withdrawal. 80 Lantern Lane RDA(Leary)-continued Attorney Henderson requested on the behalf of the applicant to withdraw the RDA application without prejudice. Minutes Motion by Patrick Kennedy to approve the minutes of March 19,2015,seconded by James Marten and the vote was unanimous (4-0). Motion by Patrick Kennedy to approve purchase order warrants,seconded by James Gilman and the vote was unanimous(4-0). Motion by Patrick Kennedy to adjourn,seconded by James Gilman.
