Conservation Commission Meeting January 22, 2015

Vice-Chairman Patrick Kennedy called the meeting to order at 7:15 p.m.
80 Lantern Lane—continued
Adam Brodsky was present. He stated they are proposing a small house on the site with a permeable
driveway. There is a vernal pool within the 100' buffer zone (not certified). Jeff Hassett of Morse
Engineering spoke about the storm water system. The drainage pipe will be relocated to the side of the
J house. The rear and side yard will be replanted as woods. There will be a stone trench along the right
side of the driveway. The runoff from the roof will go to the roof recharge system. Chris Lucas-Lucas
Environmental spoke of the 4 proposed mitigation areas. They are proposing 880 square feet of limited
maintenance under the proposed deck. Mr.Lucas spoke of the buffer enhancement area. They would
remove fill,bring in loom,plant shrubs and trees. He discussed the invasive species management area in
the 25'-50' buffer. They will remove all the invasive species and keep all the natural vegetation, There
will be a 2 year monitoring plan for the survival of the new plant species. Paul Shea stated there is still a
question of whether or not there is an IVW. There is an intermittent stream coming in on one side
(Leary's property)and another intermittent stream coming in from 100 Pond Street. Mr.Shea believes
there is a state wetland here and this project needs to be filed with the DEP. Mr. Brodsky stated what
they are proposing is better that what exists there today. Attorney Richard Henderson was present
along with John Chessia from Chessia Consulting representing Kevin Leary. Attorney Henderson asked if
the Commission would keep the hearing open so that it can be determined whether or not this is a
Wetland protected under the State Wetlands Protection Act. This will determine whether the
application before the commission is appropriate. Mr.Chessia stated the plans lack important
information about house,foundation and soil testing. Patrick Kennedy stated the applicant did bring
forth a complete set of plans at the original hearing. Mr. Kennedy stated he does believe the
Commission should allow a continuance to allow for the wetland determination. Mr.Shea stated the
question that needs to be answered is whether or not the project requires a filing with the state. The
hearing was continued until 2/19/15 @ 7:00 p.m.

Lot 3 Black Rock Road—continued
Patrice Vogelman recused herself from the hearing. Patrick Kennedy stated the Commission had a site
visit last week. Jeff Hassett was present from Morse Engineering. At the last hearing an abutter
expressed concern about a ditch at the rear of the property that could be a regulated area. Mr. Morse
submitted correspondence from a wetland scientist stating that the area was not jurisdictional. It is not
considered a stream. It is not an IVW because it doesn't have 50%vegetation. Abutters Bob and
Wendy Wilfran-560 Jerusalem asked about the blasting. Paul Shea stated blasting is regulated by the
fire department not the Conservation Commission. Mr. Kennedy stated the Commission does not have
control over blasting on private property. Patrice Vogelman-46 Black Rock Road (recused from hearing)
asked if the Commission could have professional engineer look at this issue and she also asked for if they
can go through the storm water mitigation again. Mr. Morse reviewed the storm water mitigation plan
again. James McLaughlin-29 Black Rock Road and owner of the property stated this hearing has been
continued since December for the issues with the ditch. The abutters voiced their opinion and the
hearing was continued and they did their due diligence as requested. The opportunity for the abutters
to hire an engineer has passed. He would like the hearing moved along. Mr. Hassett reiterated what
Mr. McLaughlin stated and asked for a decision to be made.
Motion by Alex Koines to close the hearing and issue a SWP for the project at Lot 3 Black Rock Road,
seconded by Edward Graham and the vote was unanimous.
169 Border Street—RDA#15-01
Vice Chairman Patrick Kennedy read aloud the public hearing notice. Kevin Sullivan-169 Border Street
was present and is proposing to install a new retaining wall with in a river front area and 100' buffer
zone. The intent is to stop erosion at the top of the hill. Paul Shea stated he has no issue with the
project.
Motion by Alex Koines to close the public hearing and issue a Neg 2&Neg 3 determination for the
project at 169 Border Street,seconded by Edward Graham and the vote was unanimous.
61 Joy Place—NOI#15-01 SWP#15-01
Vice Chairman Patrick Kennedy read aloud the public hearing notice. John Cavanaro from Cavanaro
Consulting was present. The house is outside of the 100' buffer zone. There is some cleanup work to
be done in the 50'—100' buffer zone.They are proposing a pool area and a patio and approximately
2000 square feet of mitigation plantings. For storm water control they are proposing to install an
infiltration area and outlet with a splash pad to reduce the amount of flow to adjacent properties. The
majority of the flow will go in the direction of the tidal area. They will capture the runoff from the roofs
and send the treated flow directly into the ground to create recharge. They are reducing the amount of
runoff. They are installing a seashell driveway. The pavement with this project is reduced by 1800
square feet. Paul Shea stated the project is pretty straight forward. DEP had no comments on the
project. Patricia Van Buskirk-Landscape Architect explained some of the proposed landscape plans.
Motion by Alex Koines to close the public hearing and issue a variance for the project at 61 Joy Place,
seconded by Edward Graham and the vote was unanimous.

264 Jerusalem Road—RDA#15-02
Vice Chairman Patrick Kennedy read aloud the public hearing notice. Margarita Nelson was present and
is proposing to remove a damaged tree within the buffer zone.
Motion by James Gilman to approve a Neg#3 determination for the project at 264 Jerusalem Road,
seconded by Edward Graham and the vote was unanimous.
Wompatuck State Park/Cohasset Reservoir-ATF-NOI#15-02
Vice Chairman Patrick Kennedy read aloud the public hearing notice. Thomas Vaiton-DCR was present.
The Army Corps demolished and removed two existing bunkers. All of the steel was taken out.
Motion by James Gilman to approve the ATF order of conditions for the project at Wompatuck State
Park,seconded by Edward Graham and the vote was unanimous.
96 Howard Gleason Road-NOI#15-03
Vice Chairman Patrick Kennedy read aloud the public hearing notice. John Cavanaro of Cavanaro
Consulting was present on behalf of the applicant. They are looking to prune some trees and
phragmites removal. Paul Shea stated it is a great project. This project will increase the value of the
resource area. They can condition that the applicant report back. DEP issued a file number. They
commented they wanted more clarity on the phragmites removal and the method being used.
Motion by Alex Koines to close the public hearing and issue a variance for work in the 50'buffer for
the project at 96 Howard Gleason Road,seconded by Edward Graham and the vote was unanimous.
