HomeMy WebLinkAboutMinutes - CC - 11/06/2014 Cohasset Conservation Meeting November 6, 2014 Date: Thursday, November 6, 2014 Time: 7:00 p.m. Place: Town Hall Basement Meeting Room 41 Highland Avenue Cohasset, MA Commissioners Present: Jack Creighton, Chairman Patrick Kennedy,Vice Chairman Edward Graham Alex Koines James Marten James Gilman Justin Pimpare,Associate Patrice Vogelman,Associate Commission's Consultant Present: CCC/SW Agent, Paul Shea Chairman Jack Creighton called the meeting to order at 7:00 p.m. 7:00 p.m.—Wetlands Seminar-Jacob's Meadow Paul Shea reviewed with the commission information about the Massachusetts Wetlands Protection Act, and the Cohasset Wetlands Bylaw and Regulations,including Conservation Commission filings-Requests for Determination of Applicability,and Notice of Intent Applications. He discussed what activities require filings with DEP and the Conservation Commission. He also covered the areas of protection and jurisdiction, protected wetland resource areas,flood zone areas, riverfront areas and wetland buffer zones. He discussed invasive species management and required environmental permitting,controlling the spread of invasive species within wetland resource areas,wetland buffer zones and restoration of wetland resource areas. He also discussed the public hearing process and regulatory appeals. 7:30 p.m.—Manor Way-continued-NQI and SWP Matt Shanley property owner/developer was present. The proposed project is a cluster sub-division of 6 houses. There is a retention pond at the top of the hill. There will be a raingarden at the bottom of the hill which is 65'from the BVW wetland. He is basically trying to return the property to how it was before. He is reducing the paved surface. Kevin Flaherty, Engineer from Flaherty and Stefani of Plymouth was present and discussed the drainage for the project. There are catch basins for the runoff from the road that run through manholes to the drainage easement. Paul Shea stated this was a former subdivision where some work was started and then stopped and it was sold. This is a new sub-division plan that the Planning Board has approved. The closest alteration to the work area is 65'. There is no variance required. There is a BVW with an intermittent stream. They are reducing the run off and improving the quality. He doesn't have any problem with the project. Motion by Patrick Kennedy to close the public hearing and issue an order of conditions for the proposed project at Manor Way,seconded by Edward Graham and the vote was unanimous. 1 ConCom- 11/6/14-TC Cohasset Conservation Meeting November 6, 2014 Motion by Patrick Kennedy to issue a SWP for the proposed project at Manor Way,seconded by Edward Graham and the vote was unanimous. 7:50 p.m.—18 Hugh Strain Road-continued Paul Shea advised the commission they have received revised site plans.The commission asked them to perform test pits for the recharge area and use a swale to accommodate the runoff to abutters. Paul Shea stated this is done with the revised plan. Joe Kennedy,the applicant,was present. His engineer was not present. Paul Shea stated it is just a file for SWP. The proposed swale is at the northern part of the property. He doesn't have any issues with the updated plans submitted 11/3/14. Motion by Patrick Kennedy to close the public hearing and issue a SWP for the proposed project at 18 Hugh Strain Road,seconded by Edward Graham and the vote was unanimous. 8:10 p.m.—97 Forest Avenue—NO]#14-34&SWP#14-42 Chairman Creighton stated the applicant has requested a continuance. 8:30 p.m.—Cook Estates/Abbott Homes Discussion Paul Shea stated this discussion will be continued until next month. Attorney Richard Henderson was here earlier tonight and had another commitment tonight and asked to move it to December 4`h The next hearing is at 8:50. The commission completed some documents requiring signatures. Minutes-9/18/14 Motion by Alex Koines to approve the minutes of 9/18/14,seconded by James Gilman and the vote was 4-0-2. Patrick Kennedy and Edward Graham abstained from the vote. Paul Shea stated they have had a number of N01 filings for this property. All of them have been closed out. The applicant is looking to remove phragmites and Japanese knotweed within the wetland itself. They are also proposing invasive species in the buffer zone. They are proposing to replace with native species plantings. There is also a sign there that they are looking to replace. Paul Shea stated this is probably a zoning issue but they have included it on the application since it is in the 100' buffer zone. Ann Martin will be here on behalf of the applicant. 8:50 p.m.—132 CJC Highway/Old Colony-NOI#14-35 Chairman Creighton read aloud the public hearing notice. Ann Martin from LEC Environmental was present on behalf of the applicant. She advised the commission that this is a vegetation management project. They are looking to improve sight visibility based on comments from residents and customers. The goal is to improve the vegetation. The plan would be to remove in the fall. In the spring they would cut again and then swipe the vegetation two weeks later. They would then come back in August and repeat this. They would like to use a seed mix in the buffer zone to help with the transition. Paul Shea stated he considers this a wetland enhancement project. He would request a five year order of conditions. It will take at least five years to begin to see a change. The other thing here is with all this vegetation overgrown it is actually becoming a safety issue in that area. DEP has issued a number. 2 ConCom- 11/6/14-TC Cohasset Conservation Meeting November 6, 2014 Motion by Patrick Kennedy to close the public hearing and issue a variance for work in the 50' buffer zone for the project proposed at 132 CJC Highway, seconded by Edward Graham and the vote was unanimous. Motion by Patrick Kennedy to issue an order of conditions for five years for the proposed project at 132 CJC Highway,seconded by Edward Graham and the vote was unanimous. Documents Requiring CCC Signatures Motion Patrick Kennedy to approve invoices for Paul Shea for work completed through 10/22/14 totaling 55 hours as listed,seconded by Edward Graham and the vote was unanimous. Motion by Patrick Kennedy to adjourn,seconded by Edward Graham and the vote was unanimous.
